A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM ACCEPTING CERTAIN DEEDS CONVEYING TO
THE CITY OF ANAHEIM CERTAIN INTERESTS IN REAL
PROPERTIES.
WHEREAS, certain deeds described in Exhibit "A ", attached hereto and incorporated
by reference ( "DEEDS "), have been presented to the City of Anaheim ( "CITY" or "City of
Anaheim "); and
WHEREAS, the grantors, property interests conveyed and location of the property
described in the DEEDS are set forth in Exhibit "A "; and,
WHEREAS, except the Orange County Transportation Authority (OCTA), the
owners of those properties described in Exhibit "A" have offered to convey to the CITY certain real
property interests in connection with the CITY utility service provided to their property ( "Services "),
or (ii) ; and
WHEREAS, OCTA has offered to convey to the CITY certain real property interests
in connection with OCTA's obligations for the Tustin/Rose Grade Separation Project ( "Grade
Separation Obligations "); and
WHEREAS, the City Council of the City of Anaheim does hereby find and determine
it is in the best interests of the CITY to accept the DEEDS, and the real property interests therein.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Anaheim as follows:
1. The DEEDS and the real property interests therein are hereby accepted by the
City Council for no other consideration than (a) the furnishing of Services in accordance with the
Water Rates, Rules, and Regulations and /or Electric Rates, Rules, and Regulations; and (b) meeting
its Grade Separation Obligations in the case of OCTA.
2. Nothing herein shall be construed to be an acceptance of any parcel or
property into the CITY street system (Streets and Highways Code Section 1806).
3. The City Clerk is authorized and directed to take any actions to cause the
DEEDS to be recorded in the Office of the County Recorder of the County of Orange.
THE FOREGOING RESOLUTION is approved and adopted by the City Council of the City
of Anaheim this 23rd Day of July , 2013, by the following roll call vote:
