RESOLUTION 2013- 113
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM VACATING A PORTION OF A PUBLIC SERVICE
EASEMENT LOCATED AT 800 WESTERN AVENUE
(ABA2012- 00252) PURSUANT TO CALIFORNIA STREETS
AND HIGHWAY CODE SECTION 8330, ET SEQ. -
SUMMARY VACATION.
WHEREAS, an applicant has requested the vacation of a portion of a public utility
easement generally located at 800 Western Avenue, in the City of Anaheim, County of Orange, State
of California, as more particularly described below ( "Public Service Easement "), in order to clear
title to the parcel of land in conjunction with the development of a before and after school child care
program; and
WHEREAS, the City of Anaheim ( "City of Anaheim ") acquired the Public Service
Easement for public utility purposes ( "Public Utility Purposes "); and
WHEREAS, the Public Service Easement is not necessary for present or prospective
Public Utility Purposes or any other public purpose; and
WHEREAS, the Public Service Easement to be vacated has not been used for Public
Utility Purposes for more than five (5) consecutive years and there are no other public facilities
located within the Public Service Easement.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Anaheim does hereby order the vacation of the Public Service Easement shown on a map recorded in
Book 3436, Pages 538 of Official Records, and as more particularly described in Exhibits "A" and
"B" attached hereto and incorporated herein by this reference.
BE IT FURTHER RESOLVED that the City Council of the City of Anaheim hereby
makes this vacation pursuant to the requirements of the California Streets and Highways Code,
Division 9, Part 3, Chapter 4.
BE IT FURTHER RESOLVED that the vacation authorized by this Resolution shall
not be effective until a certified copy of this Resolution is recorded in the Office of the Recorder of
the County of Orange, California.
BE IT FURTHER RESOLVED that the City Clerk be, and she is hereby, authorized
and directed to cause a certified copy of this Resolution to be recorded in the Office of the Recorder
of the County of Orange, California.
BE IT FURTHER RESOLVED that from and after the date the certified copy of this
Resolution is recorded in the Office of the Recorder of the County of Orange, the vacation shall be

complete and the Public Service Easement vacated shall no longer constitute public service
easements.
THE FOREGOING RESOLUTION is approved and adopted by the City Council of
the City of Anaheim this 23 day of July , 2013, by the following roll call vote:
AYES: Mayor Tait, Council Members Eastman, Murray, Brandman and Kring
NOES: None

Legal Description of Abandonment
The abandonment of a portion of a Six feet wide Public Utility Easement in the
City of Anaheim, County of Orange, State of California. Said portion of said easement
being more particularly described as follows:
The easterly 70.19 feet of that portion of an easement recorded March 2nd, 1956 in
Book 3436, page 538 of Official Records of said Orange County, said portion described
therein as being:
A strip of land , 6 feet in width, lying within the North one -half of the North one -half of the
Southwest one - quarter of the Southeast one - quarter of Section Fourteen, Township Four
South, Range Eleven West, San Berardino Base and Meridian; the Northerly line of said
strip is described as follows: Beginning at the Northwesterly corner of Lot 2 in said
Tract #2794, thence South 89 0 36'59" West 95.19 feet.
Total area of abandonment = 421 +/- square feet.
All as shown on exhibit'B' and made a part hereof.
