RES-2013-120RESOLUTION NO 2013- 120 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM APPROVING A LETTER OF UNDERSTANDING BETWEEN THE INTERNATIONAL BROTHERHOOD OF ELECTRICAL WORKERS, LOCAL 47, AND THE CITY OF ANAHEIM WHEREAS, the City of Anaheim, and the International Brotherhood of Electrical Workers, Local 47, have met and conferred and reached an understanding to establish an agreement on one -time retention benefits for specified classifications; and WHEREAS, the International Brotherhood of Electrical Workers, Local 47, is in agreement with the recommendation contained in said Letter of Understanding, and WHEREAS, as a result thereof, the Letter of Understanding dated July 18, 2013, between the parties has been prepared and signed; and WHERAS, the City Council of the City of Anaheim does find that it is in the best interest of the City of Anaheim to approve said Letter of Understanding. NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Anaheim that the Letter of Understanding dated July 18, 2013, between the International Brotherhood of Electrical Workers, Local 47, and the City of Anaheim, a copy of which is attached hereto and incorporated herein by reference herein, is hereby approved. THE FOREGOING RESOLUTION is approved and adopted by the City Council of the City of Anaheim this 13` day of August, 2013 by the following roll call vote: AYES: Mayor Tait, Council Members Eastman, Murray, Brandman and Kring NOES: None ABSENT: None ABSTAIN: None e - - /- ' / MAYOR OF THE CITY OF ANAHEIM ATTEST: CITY CLERK OF THE CIT OF ANA IM LETTER OF UNDERSTANDING between the INTERNATIONAL BROTHERHOOD of ELECTRICAL WORKERS, LOCAL 47 and the CITY OF ANAHEIM The International Brotherhood of Electrical Workers, Local 47 (IBEW) and the City of Anaheim (ANAHEIM) have met and conferred and reached an agreement on one -time Retention Benefits for specified classifications. The Parties hereby agree to the following: 1. Whereas, EMPLOYEE, represented by IBEW, is employed by ANAHEIM Public Utilities Department in any of the below listed classifications, at the time this Agreement is ratified by the City of Anaheim City Council: a. Line Mechanic b. Line Crew Supervisor c. Electric Crew Supervisor d. Public Utilities Troubleshooter e. Public Utilities Troubleshooter Supervisor ANAHEIM shall pay EMPLOYEE, in addition to the EMPLOYEE's regular compensation, Retention Benefits for a period commencing on the effective date of this Agreement through June 30, 2014 (hereinafter "Retention Period "), in accordance with the following payment schedule: a. Effective paycheck issued December 27, 2013 $5,000.00 b. Effective paycheck issued July 11, 2014 $5,000.00 2. Any EMPLOYEE hired by ANAHEIM in one (1) of the above listed classifications after the ratification of this Agreement shall only be eligible for the July 11, 2014 Retention Benefit. 3. ANAHEIM shall withhold applicable taxes from the foregoing Retention Benefits, and EMPLOYEE shall be responsible for any additional taxes that may be incurred as a result of such bonus. 4. The Retention Benefits paid to EMPLOYEE pursuant to this agreement shall not be included in EMPLOYEE's base compensation reported to the State Retirement System (CalPERS) for purposes of any pension calculations. 5. IBEW acknowledges and agrees that in the event EMPLOYEE voluntarily terminates his /her employment with ANAHEIM or if EMPLOYEE is terminated for cause by Pagel of 2 ANAHEIM prior to the completion of the Retention Period, EMPLOYEE shall not be entitled to any Retention Benefits after the effective date of such termination. 6. IBEW acknowledges and agrees that in the event EMPLOYEE voluntarily promotes or transfers out of any of the above listed classifications, EMPLOYEE shall not be entitled to any Retention Benefits after the effective date of such promotion or transfer.
