RES-2013-130RESOLUTION NO. 2013- 130 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM EXPANDING PERMIT- ELIGIBLE PARKING DISTRICT NO. 13 AND DESIGNATING WEST SIDE OF NUTWOOD STREET FROM BALL ROAD TO CRONE AVENUE, EAST SIDE OF NUTWOOD FROM 910 NUTWOOD TO BEACON AVENUE AND BOTH SIDES OF BEACON AVENUE FROM TRIDENT STREET TO FANN STREET /FALCON STREET AS "PERMIT PARKING ONLY" STREET WITHIN PERMIT- ELIGIBLE PARKING DISTRICT NO. 13 WHEREAS, Section 14.32.450 of Chapter 14.32 of Title 14 of the Anaheim Municipal Code authorizes the City Council to, by resolution, designate any streets, or portions thereof, as "Permit Parking Only" streets; and WHEREAS, on August 7, 2007 the City Council approved a Council Policy relating to Permit Parking recommending that neighborhood residents work with Neighborhood Services District Teams in identifying solutions and that Permit parking be considered a solution of last resort to be considered only after other options have been evaluated and determined to be infeasible (the "Council Policy "); and WHEREAS, the Council Policy sets forth a process to create a Permit- Eligible Parking District, and, following approval of the District, establishing a process enabling individual streets within the identified District boundary to request implementation of permit parking; and WHEREAS, the City Council previously adopted Resolution 2001R -53, restricting parking on certain city streets to permit parking only, thereby creating Permit - Eligible Parking District No. 13 ( "District No. 13 "), consisting of Minerva Avenue from Trident Street to Fann Street; and WHEREAS, it is recommended that District No. 13 now be expanded to include the following additional city streets, as depicted in attached Exhibit "A ": Nutwood Street and Beacon Avenue; and WHEREAS, the steps recommended in the Council Policy have been duly followed to expand the Permit- Eligible Parking District No. 13 and designate Nutwood Street and Beacon Avenue as "Permit Parking Only" in the areas described and depicted in attached Exhibit "A "; and WHEREAS, representatives of the community have met with the Neighborhood Services District Team and the Public Works Department, and efforts to identify and implement solutions to the parking other than permit parking have been determined to be insufficiently effective to resolve or significantly improve parking problems, so that no solution other than permit parking appears to be feasible; and WHEREAS, the Police Department has performed field evaluation and determined that the criteria for proceeding with consideration of a district exist; and WHEREAS, a survey was sent to determine if residents are in favor of being included in the existing Permit- Eligible Parking District No. 13, and a minimum 30% response rate among single family homes was achieved with a simple majority of returned surveys in favor of expanding the District in conformance with the Council Policy; and WHEREAS, the City Council finds that the approval of the expansion of the subject Permit- Eligible Parking District No. 13 is exempt from the California Environmental quality Act (CEQA) pursuant to Regulation No. 15061(b)(3), incorporated herein by this reference, which provides that CEQA applies only to projects which have the potential for causing a significant effect on the environment; and WHEREAS, due to parking congestion on those streets hereinafter set forth, the City Council hereby finds and determines that parking on Nutwood Street and Beacon Avenue, as described below, should be limited to persons possessing permits; and WHEREAS, the establishment of a "Permit Parking Only" area on Nutwood Street and Beacon Avenue, as described below and as hereinafter set forth, is necessary to enhance the public health, safety and welfare of the residents of the area, the users of the public streets and the public at large. WHEREAS, City Council wishes to expand Permit- Eligible Parking District No. 13. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim, that Permit- Eligible Parking District No. 13 be, and the same is hereby, expanded to include those additional streets identified in accordance with attached Exhibit "A." BE IT FURTHER RESOLVED by the City Council of the City of Anaheim that parking on the following City street segments, which are hereby designated as Permit Parking Area No. 13, shall be limited to those persons possessing a properly displayed valid parking permit: 1) Nutwood Street (west side) from Ball Road to Crone Avenue; 2) Nutwood Street (east side) from 910 Nutwood to Beacon Avenue; and 3) Beacon Avenue from Trident Street to Fann Street /Falcon Street. 2 Nothing contained in this resolution shall be construed to authorize parking or stopping where such parking or stopping is otherwise prohibited or to prohibit parking as it may otherwise be permitted by the California Vehicle Code or the Anaheim Municipal Code. Residents at the meetings voiced concerns that residents from the nearby apartments were parking on their streets, leaving them nowhere to park themselves. As a result, the majority of the meeting attendees requested inclusion in the existing permit parking area. Please complete the attached ballot and return it by the date specified on the ballot. If a minimum of 30% response rate is achieved and a supermajority (two- thirds or greater) of returned ballots desire Permit Parking on their street segment, a permit will be required to park on their street segment. Here are some basic questions and answers that may assist you in completing the ballot. How many permits can I purchase and how much are they? Each home can purchase up to three biennial permits at the cost of $30 each. Each permit is good for two years In addition, one -day guest permits are available for $1 each. Guest permits are sold in packs of 25 for $25 to control costs. Where do I purchase the permits? In order to purchase a permit, residents must provide proof of residency and have current vehicle registration. Permits can be purchased online, by mail and over the counter at City Hall. After Permit Parking gets implemented what if vehicles park on the street without a permit? Permit parking streets will be actively enforced in the beginning. After some time, violations will be less common and will need to be reported for enforcement. Vehicles without permits will be ticketed for a $72 violation. Do I or my guests need a -permit if we park in the garage or driveway? No, you only need a permit if you park on the street. 200 S.
