RES-2013-144RESOLUTION NO.2 013 -14 4 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AUTHORIZING THE CHIEF OF POLICE OR HIS DESIGNEE TO SUBMIT A GRANT APPLICATION ON BEHALF OF THE CITY OF ANAHEIM TO THE STATE OF CALIFORNIA, OFFICE OF TRAFFIC SAFETY (OTS), AUTHORIZING THE CHIEF TO EXECUTE ALL REQUIRED GRANT DOCUMENTS AND TO ACCEPT THE GRANT ON BEHALF OF THE CITY, AND AMENDING THE BUDGET FOR FISCAL YEAR 2013 -14 ACCORDINGLY. WHEREAS, The State of California, Office of Traffic Safety (the "Grantor ") has heretofore invited public agencies, including the County of Orange, to submit applications for Sobriety Checkpoint Grant Program to the Grantor (the "Grant "); and WHEREAS, the City of Anaheim desires to submit an application to Grantor for said Grant; and WHEREAS, the City is familiar with the terms, conditions and limitations of any such Grant; and WHEREAS, the City is willing and able to conform to each of the terms, conditions and limitations imposed upon any such Grant to the City; and WHEREAS, the City desires to accept any such Grant which may be awarded to the City; and WHEREAS, the City Council desires to amend the annual budget of the City to reflect and incorporate any Grant so awarded to the City, and to increase the annual appropriations and expenditures in the appropriate City program to reflect such award. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim as follows: 1. The Anaheim Chief of Police or his designee is hereby authorized to submit a grant application for and on behalf of the City of Anaheim, a public entity established under the laws of the State of California, and the Anaheim Chief of Police is authorized to execute any documents and to take any actions necessary for the purpose of applying for and obtaining financial assistance provided by the Office of Traffic Safety (the "Grantor "), including execution of any Agreements or other documents required to obtain such funds and any extensions and amendments thereto. 2. The City Council of the City of Anaheim hereby agrees to, and by this Resolution does, accept any such Grant funds awarded to the City of Anaheim without further action of the City Council being required therefor. 3. The City of Anaheim hereby agrees to comply with each and all of the terms, conditions and limitations imposed by the Grantor upon said Grant, and the Anaheim Chief of Police is hereby authorized and directed to execute any agreements, assurances, or any other documents as may be necessary or required by the Grantor in connection with the application for and acceptance of said Grant, if such Grant is awarded to the City. 4. The annual budget of the City of Anaheim for Fiscal Year 2013 -14 shall be amended by increasing the appropriations and authorized expenditures in Program No. 218- 309 -3047 in such amounts as are equal to the amount of Grant funds to be received by the City.
