A RESOLUTION OF THE ANAHEIM CITY PLANNING
COMMISSION RECOMMENDING THAT THE CITY
COUNCIL APPROVE RECLASSIFICATION NO. 2013 - 00255,
UNCONDITIONALLY AND MAKING FINDINGS IN
CONNECTION THEREWITH (HOUSING OPPORTUNTIES
REZONING PROJECT)

WHEREAS, by adoption of Resolution No. PC2004 -95 on May 25, 2004, the City
Council of the City of Anaheim ( "City Council ") adopted a comprehensive update to the General
Plan and Zoning Code for the City of Anaheim (the "2004 General Plan Update "); and,
WHEREAS, following the comprehensive update of the General Plan in 2004, forty -
two (42) separate amendments to the General Plan have been approved by the City Council,
including the 2006 -2013 Housing Element; and,
WHEREAS, the 2006 -2013 Housing Element contains Housing Production Strategy
IV: Rezoning of Housing Opportunity Sites, which commits the City to develop an approach to
allow "by- right" residential development on non - residentially -zoned properties that are designated
for residential land use by the General Plan and have a strong development or redevelopment
potential to accommodate housing affordable to moderate and low- income households
( "Opportunity Sites "); and,
WHEREAS, the Planning Director has initiated Reclassification No. 2013 -00255 to
implement General Plan Housing Element Housing Production Strategy IV: Rezoning of Housing
Opportunity Sites; and,
WHEREAS, Reclassification No. 2013 -00255 is proposed in conjunction with (i)
General Plan Amendment No. 2013 -00488 to update Tables LU -5: Residential Buildout Estimates
and LU -6: Non - Residential Build -Out Estimates of the Land Use Element of the General Plan and
related text to reflect the forty -two (42) amendments to the General Plan that have been adopted
since the 2004 General Plan Update, and (ii) Zoning Code Amendment No. 2013 -00110 to amend
the Mixed Use (MU) Overlay Zone to allow residential development by -right on properties
designated as Housing Opportunity Sites in the General Plan Housing Element (collectively, the
"Housing Opportunities Sites Rezoning Project "); and,
WHEREAS, Reclassification No. 2013 -00255 proposes to rezone or reclassify
certain properties as follows:
1. Those certain properties as shown on Exhibits A -1 through A -22 attached hereto
and incorporated herein by this reference, to add the Residential Opportunities (RO) Overlay Zone
to each property's existing zone.
2. Those certain properties as shown on Exhibit A -23 attached hereto and incorporated
herein by this reference, to add the Mixed Use (MU) Overlay Zone to each property's existing zone.

WHEREAS, the Planning Commission did hold a public hearing pertaining to
Reclassification No. 2013 - 00255, notice of said hearing having been duly given, as required by
law and in accordance with the provisions of Chapter 18.60 of the Anaheim Municipal Code, to
hear and consider evidence for and against said Reclassification and to investigate and make
findings and recommendations in connection therewith; and
WHEREAS, by the adoption of a separate resolution concurrently with but prior
in time to this Resolution, this Planning Commission has heretofore found and determined and
has recommended that the City Council so find and determine that Draft Supplemental
Environmental Impact Report No. 2012 -00346 ( "EIR No. 2012 - 00346 "), which has been
prepared in connection with the Housing Opportunities Sites Rezoning Project, serves as the
appropriate environmental documentation for the proposed Reclassification No. 2013 -00255 and
satisfies all of the requirements of the California Environmental Quality Act (California Public
Resources Code Section 21000 et seq.; herein referred to as "CEQA "), the State of California
Guidelines for Implementation of the California Environmental Quality Act ( "CEQA
Guidelines "), and the City's Local CEQA Procedure Manual and that no further environmental
documentation need be prepared for proposed Reclassification No. 2013 - 00255.
WHEREAS, this Planning Commission, after due consideration, inspection,
investigation and study made by itself, and after due consideration of all evidence and reports
offered at said hearing, does hereby find and determine as follows:
1. That this City- initiated proposal will establish a resolution of intent to reclassify
certain properties within the City of Anaheim, as described above; and
2. That proposed Reclassification No. 2013 -00255 is being considered in
conjunction with General Plan Amendment No. 2013- 00488, Zoning Code Amendment No.
2013 -00110 and EIR No. 2012 - 00346; and
3. That proposed Reclassification No. 2013 -00255 is consistent with the goals and
policies established for residential and mixed -use development as set forth in the City of
Anaheim General Plan; and
4. That proposed Reclassification No. 2013 -00255 is necessary and /or desirable for
the orderly and proper development of the community; and
5. That proposed Reclassification No. 2013 -00255 does properly relate to the zones
and their permitted uses locally established within and immediately surrounding the subject
properties and to the zones and their permitted uses generally established throughout the
community.

NOW, THEREFORE, BE IT RESOLVED, that the Planning Commission has
reviewed and considered the environmental information contained in Draft EIR No. 2012 -00346
and does hereby recommend that the City Council certify EIR No. 2012- 00346, including
adoption of Findings and a Statement of Overriding Consideration and Mitigation Monitoring
Program 122A, and determine that EIR No. 2012 -00346 fully complies with CEQA and the
CEQA Guidelines, and is adequate to serve as the environmental documentation for
Reclassification No. 2013 - 00255.
BE IT FURTHER RESOLVED, that pursuant to the above findings, this Planning
Commission does hereby recommend that the City Council approve Reclassification No. 2013-
00255, as described above, to authorize an amendment to the Zoning Map of the Anaheim
Municipal Code, contingent upon and subject to the approval of General Plan Amendment No.
2013 -00488 and Zoning Code Amendment No. 2013- 00110, now pending.
THE FOREGOING RESOLUTION was adopted at the Planning Commission
meeting of September 9, 2013. Said resolution is subject to the appeal provisions set forth in
Chapter 18.60 (Procedures) of the Anaheim Municipal Code pertaining to appeal procedures and
may be replaced by a City Council Resolution in the event of an appeal.
