RES-2013-181RESOLUTION 2013 -181 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AUTHORIZING THE SALE OF CERTAIN CITY OWNED PROPERTIES LOCATED AT 1773 SOUTH CAROLEEN LANE AND 1772 SOUTH RAINIER COURT AND 1773 SOUTH RAINIER COURT AND 1772 SOUTH GARDENAIRE LANE (APNS 127 - 612 -38, 127 - 612 -25, 127 - 612 -24, 127 - 612 -11). WHEREAS, the City of Anaheim ( "City ") owns those certain real properties located at 1773 South Caroleen Lane (APN 127 - 612 -38), 1772 South Rainier Court (APN 127 - 612 -25), 1773 South Rainier Court (APN 127- 612 -24), and 1772 South Gardenaire Lane (APN 127 - 612 -11) in the City of Anaheim, County of Orange, State of California (the "Properties "); and WHEREAS, the Properties are zoned Single- Family Residential (RS -2) and have a general plan designation of Low Density Residential; and WHEREAS, the Properties are no longer required for municipal use; and WHEREAS, an appraisal of the Properties was conducted and determined that the fair market value of the Properties to be as follows: Address APN Lot Area Value 1773 South Caroleen Lane (APN 127 - 612 -38) 5,675 SF $113,500 1772 South Rainier Court (APN 127 - 612 -25) 5,378 SF $107,500 1773 South Rainier Court (APN 127 - 612 -24) 5,734 SF $114,600 1772 South Gardenaire Lane (APN 127- 612 -11) 5,978 SF $119,500 WHEREAS, pursuant to California Government Code § §54222 — 54232 ( "Surplus Land Act "), the City provided a written offer to sell the Properties to public agencies and City departments; and WHEREAS, no public agency or City department notified the City of its intention to purchase the Properties within the Surplus Land Act's sixty (60) day notification period; and WHEREAS, Section 1222 of the City Charter states that no municipal real property with a fair market value in excess of Fifty Thousand Dollars ($50,000.00) be sold at not less than fair market value to the highest bidder after publication of a request for bids in a the official newspaper of the City; and WHEREAS, the City desires to proceed with the sale of the Properties in accordance with the requirements of the Surplus Land Act. NOW, THEREFORE, BE IT RESOLVED that, in accordance with Section 1222 of the City Charter, the Properties shall be advertised for sale and sold by sealed bid. Said bids shall be opened at 2:00 p.m. on January 9, 2014 in the Office of the City Clerk located at 200 South Anaheim Boulevard, 2nd Floor, Anaheim, CA 92805. All bids shall be accompanied by deposit in the form of a certified or cashier's check in the sum of at least ten percent (10 %) of the bid price. Notice is given that the City must reject any bid which does not equal or exceed the Properties' appraised values as follows: 1773 South Caroleen Lane (APN 127- 612 -38) $113, 500 (5,675 square feet); 1772 South Rainier Court (APN 127- 612 -25) $107,500 (5,378 square feet); 1773 South Rainier Court (APN 127- 612 -24) $114,600 (5,734 square feet); and, 1772 South Gardenaire Lane (APN 127- 612 -11) $119, 500 (5,978 square feet), unless the City Council, by at least a two - thirds vote, determines that the sale of any of the Properties at a lesser amount to be in the best interests of the City of Anaheim. BE IT FURTHER RESOLVED that the City Clerk shall open said bids and forward qualified bids to the Director of Public Works for evaluation and recommendation of the bid to be accepted by the City Council. The City reserves the right to reject any and all bids.
