2002-039RESOLUTION NO. 2002R-39 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AMENDING SPECIFIC PLAN NO. 90-1 FOR THE ANAHEIM HILLS FESTIVAL AND AMENDING RESOLUTION NO 90R-87, AS PREVIOUSLY AMENDED, ACCORDINGLY (AMENDMENT NO. 4). WHEREAS, pursuant to the procedures set forth in Chapter 18.93 of the Anaheim Municipal Code, the City Council of the City of Anaheim adopted Ordinance No. 5110 amending the zoning map to reclassify certain real property described therein into the Anaheim Hills Festival Specific Plan No. 90-1 Zone subject to certain conditions as specified therein, and Ordinance No. 5109 relating to establishment of zoning and development standards for Specific Plan 90-1 by the addition of Chapter 18.74 to said Code; and WHEREAS, pursuant to the procedures set forth in Chapter 18.93 of the Anaheim Municipal Code, the City Council of the City of Anaheim adopted its Resolution No. 90R-86 approving the Anaheim Hills Festival Specific Plan No. 90-1 and Resolution No. 90R-87 approving Zoning and Development Standards with conditions of approval for Specific Plan No. 90-1; and WHEREAS, in connection with adoption of Specific Plan No. 90-1 (Anaheim Hills Festival), the City Council certified Supplemental EIR No. 300 and adopted the corresponding Mitigation Monitoring Program (Attachment C of Resolution No. 90R-86); and WHEREAS, on July 28, 1992, the City Council amended Specific Plan No. 90-1 by approving Resolution No. 92R-160 (amending Resolution Nos. 90R-86 and Resolution No. 90R-87) and adopting Ordinance No. 5423 (amending Ordinance No. 5110) amending conditions of approval of the Specific Plan and the Zoning and Development Standards relating thereto ("Amendment No. 1"); and WHEREAS, on July 22, 1997, the City Council amended Specific Plan No. 90-1 by approving Resolution No. 97R-41 (amending Resolution Nos. 90R-86 and Resolution No. 90R-87) and adopting Ordinance No. 5603 (amending Ordinance No. 5110) amending conditions of approval of the Specific Plan and the Zoning and Development Standards relating thereto ("Amendment No. 2"); and WHEREAS, on August 18, 1998, the City Council amended Specific Plan No. 90-1 by approving Resolution No. 98R-164 (amending Resolution Nos. 90R-86 and Resolution No. 90R-87) and adopting Ordinance No. 5645 (amending Ordinance No. 5109) to permit senior citizen apartments in Development Area 4 and amending the Zoning and Development Standards relating thereto ("Amendment No. 3"); and WHEREAS, the petitioner now proposes Amendment No. 4 to Specific Plan No. 90-1 Sign Program in the Zoning and Development Standards to allow additional wall signage for in-line tenants that rear onto Santa Ana Canyon Road; and WHEREAS, the proposed amendment to the Sign Program is specifically described in Attachment Nos. 1 through 4 to the Planning Commission Staff Report dated December 17, 2001, which attachments are on file in the Planning Department and incorporated herein as though set forth in full (hereafter ~Attachment Nos. 1 through 4"); and WHEREAS, the City Planning Commission did hold a public hearing at the Civic Center in the City of Anaheim on December 17, 2001, at 1:30 p.m., notice of said public hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03, to hear and consider evidence for and against said proposed amendment and to investigate and make findings and recommendations in connection therewith; and WHEREAS, said Commission, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, did adopt its Resolution No. PC 2001-173 recommending to the City Council (1) the adoption of Amendment No. 4 to the Anaheim Hills Festival Specific Plan No. 90-1 Signage Program as set forth in Attachment Nos. 1 through 4, and (2) recomraending amendment of Ordinance No. 5109, as previously amended, relating to Zoning and Development Standards for Specific Plan No. 90-1 in Chapter 18.74 of the Anaheim Municipal Code; and WHEREAS, the City Council did hold a public hearing upon Amendment No. 4 to the Anaheim Hills Festival Specific Plan No. 90-1, notice of which hearing was given in the manner required by law; and WHEREAS, the City Council after due consideration of Planning Commission Resolution No. PC 2001-173 and all evidence, testimony, and reports offered at said hearing does hereby find that Amendment No. 4 is consistent with The Anaheim Hills Festival Specific Plan No. 92-1, and further finds: 1. That this property has unique site characteristics such as topography, location and surroundings which are enhanced by special land use and development standards and the amendment to the sign program would allow signage consistent with these existing characteristics; 2. That the specific plan, as amended, results in development of desirable character which will be compatible with existing and proposed development and the surrounding neighborhood; 3 That the specific plan, as amended, contributes to a balance of land uses and equitable allowance of signage for all tenants within the shopping center; 4. That the specific plan, as amended, respects environmental and aesthetic resources consistent with economic realties. 5. That the specific plan, as amended, is consistent with the goals and policies of the General Plan and with the purposes, standards, and land use guidelines therein. WHEREAS, pursuant to the provisions of the California Environmental Quality Act ("CEQA"), the City Council has reviewed the proposed Amendment No. 4 to Specific Plan No. 90-1 amending the Anaheim Hills Festival Sign Program (to allow additional wall signage for in-line tenants that rear onto Santa Ana Canyon Road) for an irregularly-shaped, 85-acre property is located at the southwest corner of Santa Ana Canyon Road and Roosevelt Road (8182 East Santa Ana Canyon Road), further described as The Anaheim Hills Festival Shopping Center; and does hereby approve the Negative Declaration upon finding that the declaration reflects the independent judgement of the lead agency and that it has considered the Negative Declaration together with any comments received during the public review process and further finding on the basis of the initial study and any comments received that there is no substantial evidence that the project will have a significant effect on the environment. NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim as follows: 1. That Resolution No. 90R-87, as previously amended, be, and the same is hereby, amended to revise the Specific Plan Zoning and Development Standards provision relating to permitted wall signs for In-Line Shop Buildings in the set forth in subparagraph IV.D.8.d.4.a to read as follows: "4. In-Line Shop Buildinqs One primary Wall Sign per store shall be permitted with a maximum letter height of thirty (30) inches, If two rows of letters are required, the maximum letter height shall be twelve (12) inches per row, with the total height not to exceed thirty (30) inches. In no case shall the primary Sign Width be greater than thirty (30) feet nor the total Sign Area exceed twenty (20) percent of the storefront footage. In addition to the foregoing, a maximum of three (3) in-line tenant secondary wall signs per building shall be permitted for buildings rearing onto Santa Ana Canyon Road, subject to the foregoing maximum letter height requirements, and subject to the following additional requirements: In no case shall the secondary Wall Sign be greater than fifteen (15) square feet. (2) Each sign shall be limited to the same sign language and logo as displayed on the primary sign. Logos shall be included in calculating the total sign area. (3) Signs shall be in conformance with Attachment Nos. 1 through 3 to the Zoning and Development Standards set forth in the Specific Plan. (4) The location of the secondary Wall Sign shall be limited to the area above the architectural archways as shown in Attachment No. 3 to the Zoning and Development Standards (excluding the tower elements). Both the primary and secondary signs shall be channel letters, flush mounted with no exposed raceways and consistent in design, color, illumination and text." BE IT FURTHER RESOLVED that, except as expressly amended herein, Resolution Nos. 90R-86 and 90R-87, as previously amended, and The Anaheim Hills Festival Specific Plan No. 90-1, as previously amended, shall remain in full force and effect.
