RES-2014-004RESOLUTION NO. 2014- 004 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AUTHORIZING THE FIRE CHIEF OR HIS /HER DESIGNEE TO SUBMIT AN APPLICATION ON BEHALF OF THE CITY OF ANAHEIM TO THE CALIFORNIA DEPARTMENT OF RESOURCES RECYCLING AND RECOVERY (CALRECYCLE) FOR AN USED OIL COMPETITIVE GRANT, TO AUTHORIZE ACCEPTANCE OF THE GRANT IF AWARDED, AND AMEND THE BUDGET FOR THE FISCAL YEAR IN WHICH THE GRANT IS AWARDED. WHEREAS, Public Resources Code Section 40000 et seq. authorizes the Department of Resources Recycling and Recovery (CalRecycle), to administer various Grant Programs in the State of California. CalRecycle ( "Grantor ") now offers a Used Oil Competitive Grant (UOC) (the "Grant "); and WHEREAS, the purpose of this grant is to expand or implement UOC projects that include the following: reduce the potential for illegal disposal of used oil by increasing oil and filter collection; additional recycling opportunities; public education programs; source reduction and reuse of used oil; and, the prevention of stormwater pollution caused by used oil; and WHEREAS, in furtherance of this authority, CalRecycle is required to establish procedures governing the application, awarding, and management of the Grant; and WHEREAS, CalRecycle grant application procedures require, among other things, an Applicant's governing body to declare by Resolution certain authorizations related to the administration of CalRecycle grants; and WHEREAS, the City of Anaheim ( "City ") desires to submit an application to Grantor for said Grant for Fire Department purposes; and WHEREAS, the City is familiar with the terms, conditions and limitations of the Grant; and WHEREAS, the City is willing and able to conform to each of the terms, conditions and limitations imposed upon any such Grant to the City; and NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim as follows: 1. The Anaheim Fire Chief or his designee is hereby authorized to submit a Grant application for and on behalf of the City of Anaheim, a public entity established under the laws of the State of California, and to execute any documents and take any actions necessary for the purpose of obtaining federal financial assistance provided by the Department of Resources Recycling and Recovery. 2. The City Council of the City of Anaheim hereby agrees to, and by this resolution, does accept any such Grant so awarded to the City of Anaheim without further action of the City Council being required therefore. 3. The City of Anaheim hereby agrees to comply with each and all of the terms, conditions and limitations imposed by the Grantor upon said Grant, and the Anaheim Fire Chief or his designee is hereby authorized and directed to execute ly agreements, assurances or other documents as may be necessary in connection with the eptance of said Grant and required by the Grantor, if such Grant is awarded to the City. 4. Contingent upon the award of said Grant, the annual budget of the City of Anaheim is hereby amended by increasing revenue and expenditures in an amount equal to the amount of the Grant Funds awarded. BE IT FURTHER RESOLVED that these authorizations are effective for five (5 years from the date, of adoption of this Resolution by the City Council of the City of Anaheim.
