A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM VACATING A PORTION OF PUBLIC SERVICE
EASEMENTS GENERALLY LOCATED AT' 311 EAST LA
PALMA AVENUE PURSUANT TO CALIFORNIA STREETS
AND HIGHWAY CODE SECTION 8333 - SUMMARY
VACATION.

WHEREAS, an applicant has requested the vacation of a portion of public utility
easements generally located at 3311 East La Palma Avenue in the City of Anaheim, County of
Orange, State of California, as more particularly described below (collectively, the 'Public Service
Easement "), in order to clear title to the land in conjunction with future development. and
WHEREAS, the City of Anaheim ( "City ") acquired the Public Service Easement for
public utility purposes and storm drain and incidental purposes ('Public Utility Purposes "): and
WHEREAS, pursuant to Section 8333 of the California Streets and Highways Code,
the City may summarily vacate a Public Service Easement under one or more of the following
circumstances: (i) if, for a period of five consecutive years, the Public Service Easement has not been
used for the purpose for which it was dedicated or acquired, or (ii) if the Public Service Easement
has been superseded by relocation, or determined to be excess by the City, and there are no other
public facilities located within the Public Service Easement, or (iii) the date of dedication or
acquisition is less than five years, and more than one year, immediately preceding the proposed
vacation, and the Public Service Easement has not been used continuously since that date: and
WHEREAS, the Public Service Easement to be vacated has been superseded by
relocation and there are no other public utility facilities located within the Public Service Easement.
WHEREAS, the City Council finds and determines, based upon the existing uses of
the subject real property, that the proposed vacation of the Public Service Easement will not result in
a direct or reasonably foreseeable indirect physical change in the environment and is not, therefore,
subject to the California Environmental Quality Act ( "CEQA ") pursuant to Section 15060 of the
State CEQA Guidelines.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Anaheim does hereby order the vacation of the Public Service Easement, as more particularly
described in Exhibit A and Exhibit B attached hereto and incorporated herein by this reference.
BE IT FURTHER RESOLVED that the City Council of the City of Anaheim hereby
makes this vacation pursuant to the requirements of the California Streets and Highways Code,
Division 9, Part 3, Chapter 4.
BE IT FURTHER RESOLVED that the vacation authorized by this Resolution shall
not be effective until a certified copy of this Resolution is recorded in the Office of the Recorder of
the Countv of Orange, California.
BE IT FURTHER RESOLVED that the City Clerk be, and she is hereby, authorized
and directed to cause a certified copy of this Resolution to be recorded in the Office of the Recorder
of the County of Orange, California.
BE IT FURTHER RESOLVED that from and after the date the certified copy of this
Resolution is recorded in the Office of the Recorder of the County of Orange, the vacation shall be
complete and the Public Service Easement vacated shall no longer constitute a public service
easement.
THE FOREGOING RESOLUTION is approved and adopted by the City Council of
the City of Anaheim this 7th day of January , 2014, by the following roll call vote:
