RES-2014-021RESOLUTION NO. 2014-021 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM APPROVING AND ADOPTING GENERAL PLAN AMENDMENT NO. 2013 -00489 PERTAINING TO THE ADOPTION OF THE HOUSING ELEMENT. WHEREAS, the City Council of the City of Anaheim ( "City Council ") did adopt the Anaheim General Plan by Resolution No. 69R -644, showing the general description and extent of possible future development within the City; and WHEREAS, on May 25, 2004, the City Council, by its Resolution No. 2004 -95, adopted a comprehensive update of the Anaheim General Plan, with the exception of the Housing Element, which is required to be updated within the timeframes established by State law; and WHEREAS, the Housing Element is one of seven General Plan elements mandated by the State of California, as articulated in Sections 65580- 65589.8 of the California Government Code ( "State law "); and WHEREAS, the Housing Element identifies and analyzes existing and projected housing needs and includes a statement of goals, policies, quantified objectives, and scheduled programs for the preservation, improvement and development of housing for all economic segments of the community; and WHEREAS, the City, in adopting a Housing Element, must comply with the statutory provisions of State law; and WHEREAS, the City is required to review its Housing Element as frequently as appropriate to evaluate (1) the appropriateness of the housing goals, objectives, and policies in contributing to the attainment of the state housing goal, (2) the effectiveness of the Housing Element in attainment of the community's housing goals and objectives, and (3) the progress of the City in implementation of the Housing Element; and WHEREAS, on August 11, 2009, the City Council, by its Resolution No. 2009 -141, revised its Housing Element for the 2006 -2014 planning period in accordance with State law; and WHEREAS, General Plan Amendment No. 2013 -00489 proposes to revise and amend the current Housing Element in its entirety for the 2014 -2021 planning period, as required by State law; and WHEREAS, the City has prepared a revised draft Housing Element which describes the current status of housing in the City, reviews the City's accomplishments in meeting the objectives set forth in the current Housing Element, provides an overview of the housing market as it relates to population and household trends, assesses the City's existing and future housing needs, and discusses both governmental and non - governmental constraints in meeting identified housing needs; and WHEREAS, the revised Draft Housing Element describes the housing goals for the City through the year 2021; and WHEREAS, pursuant to Government Code Section 65585, the City Council approved transmittal of the Draft 2014 -2021 Housing Element to the Department of Housing and Community Development ( "HCD ") on September 24, 2013, for review and comment by the Department of Housing and Community Development ( "HCD "); and WHEREAS, HCD has reviewed the Draft 2014 -2021 Housing Element and has reported its findings to the City; and WHEREAS, the City has considered the findings made by HCD and addressed all of the comments and findings made by HCD to the City and incorporated them into the Draft 2014 -2021 Housing Element; and WHEREAS, by letter dated December 2, 2013, HCD determined that the Draft 2014 -2021 Housing Element substantially complies with the requirements of State law; and WHEREAS, the Planning Commission of the City of Anaheim ( "Planning Commission ") did hold a public hearing on January 13, 2014 to consider the adoption of Draft 2014 -2021 Housing Element, designated as General Plan Amendment No. 2013 - 00489, for the purpose of amending the Housing Element of the Anaheim General Plan, including the revisions incorporated in response to the comments and findings made by HCD; and WHEREAS, on September 9, 2013, the Planning Commission conducted a public hearing, notice of said public hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code (the "Code "), to hear and consider evidence and testimony concerning the contents and sufficiency of Draft Supplemental Environmental Impact Report No. 2012 -00346 ( "DEIR No. 2012 - 00346 "), which had been prepared in connection with proposed General Plan Amendment No. 2013 -00488 to update Tables LU -5: Residential Buildout Estimates and LU -6: Non - Residential Build -Out Estimates of the Land Use Element of the General Plan and related text to reflect the forty -two (42) amendments to the General Plan that have been adopted since the 2004 General Plan Update, and Zoning Code Amendment No. 2013 -00110 and Zoning Reclassification No. 2013 -00255 to implement Housing Production Strategy IV: Rezoning of Housing Opportunity Sites; and WHEREAS, upon the recommendation of the Planning Commission, the City Council, by the adoption of its Resolution No. 2013 -150 on September 24, 2013, which is incorporated herein by this reference, certified Final Supplemental Environmental Impact Report No. 2012 -00346 ( "FSEIR 2012 - 00346 ") and adopted Findings and a Statement of Overriding Considerations and Mitigation Monitoring Program 122A for General Plan Amendment No. 2013 - 00488, Zoning Code Amendment No. 2013 -00110 and Zoning Reclassification No. 2013 - 00255; and WHEREAS, pursuant to the provisions of the California Environmental Quality Act, the City Council, as lead agency for General Plan Amendment No. 2013 - 00489, does hereby find and determine that the previously - certified FSEIR No. 346 is adequate to serve as the required environmental documentation in connection with said General Plan Amendment No. 2013 -00489 upon finding that FSEIR No. 346 reflects the independent judgment of the lead agency and that it 2 has considered FSEIR No. 346 and further finding on the basis of FSEIR No. 346 that there is no substantial evidence that proposed General Plan Amendment No. 2013 -00489 will have a significant effect on the environment; and WHEREAS, at said public hearing, the Planning Commission did duly adopt Resolution No. PC2014 -010, containing a report of its findings, a summary of the evidence presented at said hearing, and recommending that General Plan Amendment No. 2013 -00489 be approved and adopted by the City Council; and WHEREAS, upon receipt of said Resolution No. PC2014 -010, a summary of evidence, a report of findings and recommendations of the Anaheim City Planning Commission, the City Council did set the 4th day of February, 2014, as the time, and the City Council Chamber in the Civic Center as the place for a public hearing on proposed General Plan Amendment No. 2013 -00489 and did give notice thereof in the manner and as provided by law; and WHEREAS, the City Council did duly hold and conduct such public hearing and did give all persons interested therein an opportunity to be heard, and did receive evidence and reports and did consider the findings and recommendations of the Planning Commission; and WHEREAS, the City Council has considered the findings made by HCD and does hereby find and determine that the adoption of the 2014 -2021 Housing Element, setting forth the housing goals, policies and programs that the City intends to implement through the year 2021, should be approved based upon the following findings: 1. That proposed General Plan Amendment No. 2013 -00489 substantially complies with the requirements of State law; and 2. That proposed General Plan Amendment No. 2013 -00489 maintains the internal consistency of the General Plan, as the proposed modifications to the General Plan are consistent with General Plan goals related to housing and will serve the City's growing population with future in -fill residential development; and 3. That proposed General Plan Amendment No. 2013 -00489 would not be detrimental to the public interest, health, safety, convenience, or welfare of the City in that the proposed amendment would provide housing policy, in compliance with State law, to meet the housing needs for all economic segments of the community for the 2014 -2021 planning period; and 4. That proposed General Plan Amendment No. 2013 -00489 would not amend the General Plan Land Use Map; and, therefore, does not alter the balance of land uses as currently identified in the General Plan. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that General Plan Amendment No. 2013 -00489 amending the Housing Element, as set forth in the document titled "City of Anaheim Housing Element 2014- 2021 ", a copy of which is on file in the Planning Department of the City of Anaheim and incorporated herein by this reference, is hereby approved and adopted. BE IT FURTHER RESOLVED that the Planning Director is hereby authorized and directed to submit a copy of the City of Anaheim Housing Element 2014 -2021 to HCD promptly following adoption of this Resolution. BE IT FURTHER RESOLVED that, in accordance with the requirement of Section 65589.7 of State law, the Planning Director is hereby authorized and directed to immediately deliver the City of Anaheim Housing Element 2014 -2021 to all public agencies or private entities that provide water and sewer services for municipal and industrial uses, including residential, within the City of Anaheim.
