RES-2014-039RESOLUTION NO.2014 -039 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM ADOPTING A SCHEDULE OF CIVIL FINES FOR THE ISSUANCE OF CIVIL CITATIONS UNDER AND PURSUANT TO CHAPTER 15.70 (PRESERVATION OF RENTAL HOUSING PROPERTIES) OF TITLE 15 OF THE ANAHEIM MUNICIPAL CODE. WHEREAS, pursuant to Chapter 1.20 (Civil Citations) of the Anaheim Municipal Code (the "Code "), it is the policy of the City Council of the City of Anaheim (the "City Council ") to establish by resolution the amount of the fines for violating particular provisions of the Code, which may include escalating fine amounts for repeat violations occurring within specified periods of time; and WHEREAS, concurrently with the adoption of this Resolution, the City Council has introduced at a regular meeting of its members an Ordinance of the City of Anaheim adding Chapter 15.70 to Title 15 of the Anaheim Municipal Code relating to the Preservation of Rental Housing Properties in the City Of Anaheim (herein referred to as the "Ordinance "); and WHEREAS, the Ordinance includes provisions for the enforcement of violations thereof, including the issuance of civil citations and the administration of civil fines and procedures for the imposition, enforcement, collection, and administrative review of civil fines as set forth in Chapter 1.20 (Civil Citations) of the Code; and WHEREAS, in accordance with the authorization to establish the amount of fines, as set forth in Chapter 1.20 (Civil Citations) of the Code, the City Council desires, by this resolution, to adopt and establish the amount of fines to be imposed pursuant to the Ordinance. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the amount of fines to be charged persons under and pursuant to the Ordinance shall be in the amounts set forth in the attached Exhibit A , which is attached hereto and incorporated by reference herein. BE IT FURTHER RESOLVED that the effective date of this Resolution shall be thirty (30) days after the adoption of the Ordinance. A citation may charge a violation for one or more days on which a violation exists, and for violation of one or more Code provisions."
