RES-2014-061 RESOLUTION NO. 2014 - 061 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM ADJUSTING RATES OF COMPENSATION AND ESTABLISHING PAY POLICIES FOR CLASSIFICATIONS DESIGNATED AS CONFIDENTIAL AND RESCINDING RESOLUTION NO. 2006 -104 AND AMENDMENTS THERETO WHEREAS, the Human Resources Director has recommenced in a staff report dated April 22, 2014, that the rates for classifications designated as Confidential be amended and that the prior resolution setting those rates, Resolution No. 2006 -104, be rescinded; and WHEREAS, the City Council finds that adjusting rates of compensation for Confidential job classifications is in the best interest of the City of Anaheim. NOW, THEREFORE BE IT RESOLVED BY THE City Council of the City of Anaheim as follows: Section 1. That, classifications designated as Confidential are hereby amended further by deleting the following classifications: Classification Council Administrative Assistant Planning Commission Support Supervisor Senior Word Processing Operator Word Processing Operator - Confidential Section 4. Effective the pay period beginning on April 25, 2014, for officers and employees of the City of Anaheim who are now employed or will in the future be employed in any of the classifications listed in Section 1 of this Resolution, the City shall not report the seven percent (7 %) PERS employee contribution paid by ANAHEIM to CaIPERS as compensation earned in accordance with Government Code Section 20636(c)(4). Effective the pay period beginning on March 27, 2015, officers and employees of the City of Anaheim who are now employed or will in the future be employed in any of the classifications listed in Section 1 of this Resolution shall contribute eight percent (8 %) of the employee contribution rate for retirement benefits. Effective the pay period beginning on April 25, 2014, for officers and employees of the City of Anaheim who are now employed or will in the future be employed in any of the classifications listed in Section 1 of this Resolution, the employee contribution to the employer contribution rate shall be capped at four percent (4 %). Should CaIPERS modify its reporting for contribution rates, employees shall contribute a total of twelve percent (12 %) - four percent (4 %) plus eight percent (8 %). Pursuant to the California Public Employees' Pension Reform Act of 2013, new employees employed in any of the classifications listed in Section 1 of this Resolution, hired on or after January 1, 2013, shall be enrolled in the Public Employees' Retirement defined benefit plan of two percent at 62 (2% @ 62), with a final compensation measurement period of the average of three (3) consecutive years and the employee paying at least fifty percent (50 %) of normal costs, rounded to the nearest of one percent (1%). Section 5. Effective the pay period beginning on April 25, 2014, officers and employees of the City of Anaheim who are now employed or will in the future be employed in any of the classifications listed in Section 1 of this Resolution, who are required to speak in Spanish or other languages (including sign language), as well as English, as part of the regular duties of their position will be compensated at the rate of sixty dollars ($60) per pay period, in addition to their regular pay, except while they are on Short Term Disability leave or Leave Without Pay for over forty (40) hours in a pay period. Effective the pay period beginning on December 19, 2014, officers and employees of the City of Anaheim who are now employed or will in the future be employed in any of the classifications listed in Section 1 of this Resolution, who are required to speak in Spanish or other languages (including sign language), as well as English, as part of their regular duties of their position will be compensated at the rate of seventy dollars ($70) per pay period, in addition to their regular pay, except while they are on Short Term Disability leave or Leave Without Pay for over forty (40) hours in a pay period. Effective the pay period beginning on April 25, 2014, officers and employees of the City of Anaheim who are now employed or will in the future be employed in any of the classifications listed in Section 1 of this Resolution, who are required to speak, read and /or write in Spanish or other languages (including sign language), as well as English, as part of the regular duties of their position will be compensated at the rate of eighty dollars ($80) per pay period, in addition to their regular pay, except while they are on Short Term Disability leave or Leave Without Pay for over forty (40) hours in a pay period. Effective the pay period beginning on December 19, 2014, officers and employees of the City of Anaheim who are now employed or will in the future be employed in any of the classifications listed in Section 1 of this Resolution, who are required to speak, read and /or write in Spanish or other languages (including sign language), as well as English, as part of their regular duties of their position will be compensated at the rate of ninety dollars ($90) per pay period, in addition to their regular pay, except while they are on Short Term Disability leave or Leave Without Pay for over forty (40) hours of that pay period,. Section 6. Employees hired to work on a part-time basis in any of the classifications listed in Section 1 of this Resolution will be compensated at the hourly rate of pay established for the full -time classifications and shall make the same pension contributions as established for the full -time classifications. Section 7. The provisions of this Resolution shall supersede Resolution No. 2006 -104 and amendments thereto, which Resolution is hereby rescinded. The provisions of this Resolution shall supersede and take precedence over any inconsistent provisions in Rules 6.6, 23.6.1.1, and 23.6.1.1(ii)(iii)(iv) of the Personnel Rules covering Management, Confidential, and Non - Represented Part -Time Employees, for officers and employees of the City of Anaheim who are now employed or will in the future be employed in any of the classifications listed in Section 1 of this Resolution.
