WAIVER OF READING - ORDINANCES AND RESOLUTIONS: Councilwoman Kaywood moved to waive the reading in full of all ordinances and resolutions of the Agenda, after reading of the title thereof by the City Clerk, and that consent to waiver is hereby given by all Council Members, unless after reading of the title, specific request is made by a Council Member for the reading of such ordinances or resolutions in regular order. Councilman Bay seconded the motion. One Vacancy. MOTION CARRIED. MOTION: Councilman Bay moved to approve the application for Public Dance Permit submitted by New Generation Productions to hold a dance at the Anaheim Convention Center on Sunday, May 24, 1987 from 8:00 p.m. to 1:00 a.m. in accordance with the recommendations of the Chief of Police. Councilman Pickler seconded the motion. One Vacancy. MOTION CARRIED. City Manager Talley explained that relative to such dance permits, staff is in the process of revising the procedure in order to prevent such occurrences in the future. An additional dance permit is in process .right at this moment which he will bring to the Council before the end of the meeting today. Mayor Bay agreed that something had to be done and perhaps in the future this type of dance permit could be delegated to an administrative decision. He asked that it be looked at from that angle. 105: APPOINTMENT TO THE COMMUNITY SERVICES BOARD: Appointment to fill unscheduled vacancy on the Community Services Board (Anthony) for the term expiring June 30, 1987. This matter was continued from the meeting of May 12, 1987, to this date. Mayor Bay stated that at the last meeting a nomination was made and the appointment then continued to this meeting. CITY PLANNING COMMISSION ITEMS: The following actions taken by the City Planning Commission at their meeting held April 27, 1987, pertaining to the following applications were submitted for City Council information. 1. VARIANCE NO. 3644: Submitted by John R. Townsend, to construct a Circle "K" Convenience Market on property located on the east side of Western Avenue, on the south side of Ball Road. The applicant withdrew his application. 2. CONDITIONAL USE PERMIT NO. 2029 (READV.): Submitted by Allan Lobel-Canex Investments, (Sunwest Motors), to delete and/or modify certain conditions of approval of Conditional Use Permit No. 2029, Planning Commission Resolution No. PC86-264, to permit an automobile sales agency on CG zoned property located at 619-631 North Anaheim Boulevard. The City Planning Commission, pursuant to Resolution No. PC87-97, granted Conditional Use Permit No. 2029 (Ready.) to expire April 27, 1992, and previously approved a negative declaration status. 2. The City Planning Commission, pursuant to Resolution No. PC87-99, granted Conditional Use Permit No. 2909 and ratified the Planning Director's categorical exemption determination, (Class 1). 4. RECLASSIFICATION NO. 84-85-30 AND CONDITIONAL USE PERMIT NO. 2676--EXTENSIONS OF TIME: Submitted by Ron Muccino, requesting extensions of time for Reclassification No. 84-85-30 and Conditional Use Permit No. 2676, a proposed change in zone from ILM-1200 to CL, to permit a used automobile sales agency an lot on property located at 1107 North Swan Street. The Planning Commission approved an extension of time to Reclassification No. 84-85-20 and Conditional Use Permit No. 2676, to expire April 15, 1988. 5. The City Planning Commission, pursuant to Resolution No. PC87-96, denied Variance No. 3642 (Ready.) and granted a negative declaration status (Ready.) The Planning Commission's decision was appealed by the applicant and, therefore, a public hearing would be scheduled at a later date. 7. CONDITIONAL USE PERMIT NO. 2906: Submitted by Mildred B. and T. E. Yellis, Arco Service Station), to permit a convenience market with gasoline sales and off-sale beer and wine on CL zoned property located at 530 No. Brookhurst Street. The City Planning Commission, pursuant to Resolution No. PC87-98, denied Conditional Use Permit No. 2906, and ratified the Planning Director's categorical exemption determination, (Class 1). The Planning Commission's decision was appealed by the applicant and, therefore, a public hearing would be scheduled at a later date. End of Planning Commission Informational Items. 417 City Hall, Anaheim~ California - COUNCIL MINUTES - May 19~ 1987~ 1:30 P.M. 179/142: PROPOSED CODE AMENDMENT: To consider an Ordinance amending Chapters 17.28 and 18.90 of the Code, pertaining to flood hazard reduction and floodplain overlay zones, necessary to comply with mandated "Revisions to National Flood Insurance Program Floodplain Management Criteria." MOTION: Councilman Bay moved to approve the request by staff that there be an indefinite continuation of the proposed Code Amendment to allow input by the Federal Emergency Management Agency and the State Department of Water Resources. Councilwoman Kaywood seconded the motion. One Vacancy. MOTION CARRIED. 179/142: ORDINANCE NO. 4832 - DEFINING KITCHENETTE: To amend Section 18.01.120 and 18.06.050.0241 of the Code, to define "kitchenette" when pertaining to motel rooms. Councilwoman Kaywood offered Ordinance No. 4832 for first reading. ORDINANCE NO. 4832: AN ORDINANCE OF TH~ CITY COUNCIL OF THE CITY OF ANAHEIM AMENDING SECTION 18.01.120 AND 18.06.050.0241 OF THE ANAHEIM MUNICIPAL CODE DEFINING "KITCHENETTE" WHEN PERTAINING TO MOTEL ROOMS. 179: REVIEW OF ZONING ADMINISTRATOR'S DECISIONS - VARIANCE NO. 3655: Submitted by Rehio H. and Sherrie Spray, to construct a two-story, 31-foot high, single family residence on RS-HS-43,000(SC) zoned property located at 1195 South Hidden Canyon Road, with Code waiver of maximum building height. Anmika Santalahti, Zoning Administrator, approved Variance No. 3655 and ratified the Director's categorical exemption determination, Class 5. It was indicated on the agenda that the 15-day appeal period for the subject Variance expires May 22, 1987 at 5:00 p.m. City Attorney, Jack White stated that since the agenda was prepared it has come to his attention that the 15-day appeal period will not expire on May 22, 1987. The written notice which triggers the 15-day period was not sent on May 7, 1987 but was subsequently prepared for mailing. While there is no problem having the item on the agenda, he wanted to point out that the appeal period will be a subsequent date other than the 22nd day of May. (Amending Title 18, Reclass. 69-70-58(5), ML, La Palma Avenue and White Star Avenue) 114/119: "WALT DISNEY DAY": Councilman Pickler stated he received a letter from the mother of a 10-year old who recommended that perhaps Anaheim should have a "Walt Disney Day". He felt the suggestion warranted some consideration by the City. 108/114: APPLICATION FOR PUBLIC DANCE PERMIT - YAHUALICA: Councilman Bay moved that the City Council make a finding that the need to act on the subject item arose after the agenda was posted on Friday, May 15, 1987, thereby waiving the 72-hour posting requirement of the Brown Act. Councilman Pickler seconded the motion. MOTION CARRIED. MOTION: Councilman Bay moved to approve the application for a Public Dance Permit submitted by Yahualica to hold a dance at the Anaheim Convention Center, Saturday, May 23, 1987 from 6:00 p.m. to 1:00 a.m. in accordance with recommendations of the Chief of Police. (3:05 p.m.) 176: PUBLIC HEARING -ABANDONMENT NO. 87-3A: In accordance with application filed by the Anaheim Redevelopment Agency, public hearing was held on proposed 419 237: City Hall~ Anaheim~ California - COUNCIL MINUTES - May 19~ 1987; 1:30 P.M. abandonment of a portion of Center Street, formerly Old Lincoln Avenue, west of Philadelphia Street, pursuant to Resolution No. 87R-150 duly published in the Anaheim Bulletin and notices thereof posted in accordance with law. Report of the City Engineer dated April 14, 1987 was submitted recommending approval of said abandonment. Mayor Bay asked if anyone wished to address the Council; there being no response, he closed the public hearing. ENVIRONMENTAL IMPACT REPORT - CATEGORICAL EXEMPTION: The City Engineer determined that the proposed activity falls within the definition of Section 3.01, Class 5, of the City of Anaheim guidelines to the requirements for an Environmental Impact Report and is, therefore, categorically exempt from the requirement to file an EIR.
