RES-2014-123 RESOLUTION NO. 2414- 123 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM DETERMINING THAT PERMITTING ELIGIBLE CUSTOMER-GENERATORS TO AGGREGATE THEIR LOAD FROM MULTIPLE METERS WILL RESULT IN AN INCREASE TO EXPECTED REVENUE OBLIGATIONS OF CUSTOMERS THAT ARE NOT ELIGIBLE CUSTOMER- GENERATORS. WHEREAS, Senate Bill 594 (2012), effective January 1, 2013, amended California Public Utilities Code section 2827 to allow a customer with multiple meters to elect to aggregate the load of the meters located on the property where the renewable electrical generation facility is located and on all property adjacent or contiguous to the property on which the renewable electrical generation facility is located, if those properties are solely owned, leased, or rented by the eligible customer-generator ("aggregate net metering"); and WHEREAS, the law also provides that a local publicly owned electric utility shall only allow aggregate net metering if the local publicly owned electric utility's ratemaking authority makes a determination that permitting eligible customer-generators to aggregate their load from multiple meters will not result in an i�crease in the expected revenue obligations of customers that are not eligible customer-generators; and WHEREAS, the law further provides that in making this determination, the ratemaking authority shall also determine if there are any public purpose or other non- commodity charges that the eligible customer-generator would pay pursuant to the net metering program of the local publicly owned electric utility as it exists prior to aggregation, that the eligible customer-generator would not pay if permitted to aggregate the electrical load of multiple meters; and WHEREAS, this determination must occur within 180 calendar days of the first request made by a customer to aggregate their load; and WHEREAS, the City of Anaheim ("Anaheim") received its first request by a customer to aggregate their load for net metering on February 25, 2014, which started the 180- day clock, with the deadline for the City Council determination by August 25, 2014; and WHEREAS, Public Utilities Code section 2827 defines "eligible customer- generators" as specified customers that use a renewable electrical energy facility located on the customer's premises to offset part or all of the customer's own electrical requirements: and WHEREAS, the staff report and information accompanying this resolution demonstrate that permitting eligible customer-generators to aggregate their load from multiple meters will result in an increase in the expected revenue obligations of customers that are not eligible customer-generators. NO�7J, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim as follows: 1. The findings set forth above are hereby adopted by the Anaheim City Council. 2. Based on the foregoing, the Anaheim City Council, pursuant to Senate Bill 594 (2012), hereby makes a determination that permitting eligible customer-generators to aggregate their load from multiple meters will result in an increase in the expected revenue obligations of customers that are not eligible customer-generators.
