RES-2014-143 RESOLUTION NO. 2014- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM ADOPTING THE NEGATIVE DECLARATION FOR THE WELL NO. 59 PROJECT AND DETERMINING ITS ADEQUACY TO SERVE AS THE REQUIRED ENVIRONMENTAL DOCUMENTATION PURSUANT TO THE CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA). WHEREAS, the City of Anaheim (the "Anaheim") proposes to replace an existing inactive Well No. 36 with Well No. 59 in approximately the same location (the "Project"); and WHEREAS, the Project consists of the following: replacement of an inactive water production well with a new high production water well, Well No. 59, that will have a horsepower of 350-400 hp, a pumping capacity of 2,000-3,000 gallons per minute, and an approximate depth of 1,400 feet; and WHEREAS, Project also includes tree removal and construction of a new block wall building for storage of two hypochlorite tanks, a room for electrical and controls equipment, and a spare room (sized to fit an ammonia tank, if needed in the future); and WHEREAS, Anaheim is the lead agency for the preparation and consideration of environmental documents for the Project, as defined in the CEQA and the State of California Guidelines for the Implementation of the California Environmental Quality Act; and WHEREAS, an initial study was prepared for the Project pursuant to the CEQA dated May 28, 2014 ("Initial Study") and it was determined that a negative declaration should be prepared;and WHEREAS, a draft negative declaration was prepared, and was circulated for a 30-day public/responsible agency review on June 3, 2014, in compliance with the requirements of CEQA; and WHEREAS, no comments were received during the review period; a complete copy of the negative declaration is attached to the staff report accompanying this resolution ("Negative Declaration") for the Anaheim City Council's consideration. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim as follows: 1. The foregoing recitals are true and correct. 2. The Anaheim City Council has read and considered the Negative Declaration and finds on the basis of the whole record before it that there is no substantial evidence the proposed Project will have a significant effect on the environment. 3. That the Negative Declaration reflects the Anaheim City Council's independent judgment and analysis. 4. That the Negative Declaration was prepared and considered in accordance with the requirements of the CEQA. 5. The Anaheim City Council finds that the Negative Declaration is adequate to serve as the required CEQA environmental documentation for the Project, and adopts the Negative Declaration for the Project. 6. The Anaheim Public Utilities Deparhnent, Environmental Services Division is the custodian of the records of the proceedings on which this decision is based. The records are located at 201 S.
