RES-2014-162 RESOLUTION NO. 2014- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM RATIFYING THE SUBMISSION OF AN APPLICATION ON BEHALF OF THE CITY OF ANAHEIM TO THE STATE OF CALIFORNIA DEPARTMENT OF WATER RESOURCES FOR GRANT FUNDS UNDER ITS 2008 i1RBAN DROUGHT ASSISTANCE GRANT PROGRAM, AUTHORIZING THE PUBLIC UTILITIES GENERAL MANAGER OR DESIGNEE TO ACCEPT SUCH GRANT FUNDS AS MAY BE AWARDED, APPROVING AGREEMENT 4600008290 AND AUTHORIZING THE PUBLIC UTILITIES GENERAL MANAGER OR DESIGNEE TO EXECUTE THE AGREEMENT AND TAKE SUCH ACTIONS AS ARE NECESSARY 1N FURTHERANCE OF THE AGREEMENT, AMENDING THE PUBLIC UTILITIES DEPARTMENT BUDGET FOR FISCAL YEAR 2014/2015, AND DETERMINING THAT THESE ACTIONS ARE EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) PURSUANT TO GUIDELINE SECTION 15304(b). WHEREAS, the State of California, the Resources Agency, Department of Water Resources ("DWR") requested proposals for its 2008 Urban Drought Assistance Grant under Proposition 50, the Water Security, Clean Drinking Water, Coastal and Beach Protection Act of 2002 ("Grant Program"); and WHEREAS, the City of Anaheim ("Anaheim" or "City") desires to enhance its Artificial Turf and California Friendly Landscaping rebate program ("Rebate Program") to further promote the conservation of water; and WHEREAS, the City submitted an application to the DWR to receive grant funding under the Grant Program on or about July 21, 2008 in the amount of $247,869.00 to obtain funding for the Rebate Program and not long afterwards this application was accepted by the DWR; and WHEREAS, the City is familiar with the terms, conditions, and limitations of the Grant Program which is set forth in DWR Grant Agreement 4600008290 ("Grant Agreement"); and WHEREAS, the City is willing and able to conform to each of the terms, conditions, and limitations imposed upon the City by the Grant Program; and WHEREAS, the City remains supportive of the ongoing efforts to apply for and accept such allocation of funds through the DWR as may be awarded to the City. 1 _ _ ._ __ __ _ _ NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim as follows: l. The Anaheim City Council hereby determines that the actions which the City Council approves under this Resolution are exempt from CEQA pursuant to State CEQA Guidelines section 15304(b) because these actions involve the replacement of conventional turf with water efficient landscaping. Anaheim staff is hereby directed to file with the County Clerk a Notice of Exemption within three (3) business days of the adoption of this Resolution. 2. The Public Utilities General Manager, or designee, is and was authorized to submit an application to the DWR, on behalf of the City, for the Grant in the amount of up to TWO HLTNDRED THOUSAND AND FORTY-SEVEN THOUSAND DOLLARS AND EIGHT HUNDRED AND SIXTY-NINE DOLLARS ($247,869.00) and such additional amounts as may be awarded ("Grant Amount") to fund the Rebate Program. 3. The Public Utilities General Manager, or designee, is authorized to accept the Grant Amount for and on behalf of the City. 4. The Anaheim City Council approves the Grant Agreement in substantially the form attached to the staff report accompanying this Resolution and authorizes the Public Utilities General Manager, or designee, to execute the Grant Agreement and to take such actions as are necessary in furtherance of the Grant Agreement, including the executions of certificates and/or assurances, reports, plans, payment requests, extensions, amendments or other documents. 5. The Public Utilities Department annual budget for Fiscal Year 2014/2015 is hereby amended by increasing the appropriations and authorized expenditures in such amount equal to the amount of Grant Amount.
