INVOCATION: The Reverend Louis Rohrs, Trinity United Methodist Church, gave the Invocation. FLAG SALUTE: Councilwoman Miriam Kaywood led the assembly in the Pledge of Allegiance to the Flag. 119: PROCLAMATIONS: The following proclamations were issued by Mayor Roth and authorized by the City Council to be presented at a later date: National Home Health Care Week in Anaheim, November 28 to December 4, 1982. Agronomy Week in Anaheim, November 28 to December 3, 1982. 119: PROCLAMATION: The following proclamation was issued by Mayor Roth, authorized by the City Council and presented to Mr. Lynn Thomsen, accepting on behalf of the Rotary Club: National Family Week in Anaheim, November 21-27, 1982. Mr. Thomsen introduced the Rotary Club's Essay Contest Winner, Phillip Notariapni and presented him with a $50 gift certificate for the Anaheim Plaza Shopping Center for his essay entitled "What My Family Means To Me." 119: PRESENTATION - INTERNATIONAL MUSIC OLYMPICS PLAQUE: Mr. Thomas Liegler, Convention Center/Stadium/Golf General Manager, introduced Joanne Stanton, Cappy Brown and Mrs. Harriet English, and explained that they had recently been recognized for their efforts given to the Music Olympics Program for 1982 and for the one to be held at the Anaheim Stadium and Convention Center on May 5, 1983. The group presented a plaque to the Anaheim City Council, recognizing their support of the International Music.Olympics, which will be placed in a suitable location within the Anaheim Civic Center. MINUTES: Councilwoman Kaywood moved to approve the minutes of the regular meetings held October 5 and October 12, 1982. Councilman Bay seconded the motion. MOTION CARRIED. 1011 City Hall, Anaheim, California - COUNCIL MINUTES - November 23, 1982~ 10:00 A.M. WAIVER OF READING - ORDINANCES AND RESOLUTIONS: Councilman Bay moved to waive the reading in full of all ordinances and resolutions of the Agenda, after reading of the title thereof by the City Clerk, and that consent to waiver is hereby given by all Council Members, unless after reading of the title, specific request is made by a Council Member for the reading of such ordinances or resolutions in regular order. Councilman Pickler seconded the motion. MOTION CARRIED. FINANCIAL DEMANDS AGAINST THE CITY in the amount of ~2,369,363.87, in accordance with the 1982-83 Budget, were approved. CITY MANAGER/DEPAR/MENTAL CONSENT CALENDAR: On motion by Councilwoman Kaywood, seconded by Councilman Roth, the following items were approved in accordance with the reports, certifications and recommendations furnished each Council Member and as listed on the Consent Calendar; Councilwoman Kaywood offered Resolution Nos. 82R-560 through 82R-564, both inclusive, for adoption. Refer to Resolution Book. 1. 118: The following claims were filed against the City and action taken as recommended. A. Claims denied and referred to Risk Management: 1. Claim submitted by Dorothy Agee for personal injuries purportedly sustained due to a trip-and-fall accident at Anaheim Stadium, on or about July 11, 1982. 2. Claim submitted by Mick Thomas Jones for personal property damages purportedly sustained when claimant's skateboard was run over by a City-owned truck at John Marshall Park, on or about September 16, 1982. 3. Claim submitted by Ronald Eugene Schmautz for indemnity for monetary payments resulting from a suit for personal injuries purportedly sustained due to recklessness, carelessness and negligence on the part of the City on Basilone Road near the San Onofre Nuclear Generating plant, on or about April 23, 1982. 4. Amended claim submitted by Ohio Farmers Insurance Group, John J. Toner, Insured, for personal property damages and loss at 1633 and 1639 Ball Road, purportedly sustained due to negligence on the part of the City in connection with the April 21, 1982 fire. B. Claim submitted by Lawton C. Thomson for personal injury damages purportedly sustained due to conspiracy of Anaheim Police Officers to discredit, defame, dishonor, intimidate and cause grievous mental anguish and distress, on or about July 30 and August 2, 1982. 2. The Mayor declared Resolution Nos. 82R-560 through 82R-564, both inclusive, duly passed and adopted. 1014 City Hall, Anaheim, California - COUNCIL MINUTES - November 23, 1982, 10:00 A.M. 123/135: GOLF PRO - ANAHEIM HILLS GOLF COURSE: Mr. Thomas Liegler, Convention Center/Stadium/Golf General Manager, introduced the new golf pro, Don Poff, to the Council Members. 105: CC~fl~UNITY SERVICES BOARD VACANCY: Councilwoman Kaywood noted that the Council had received a letter of application from Mr. Glenn Irving for the current vacancy on the Community Services Board and suggested that they take action this date to fill the vacancy. Following brief discussion, the Council directed that this appointment, and the vacancy on the Project Area Committee, be scheduled on next week's agenda, and further directed that copies of all letters of interest received since the last appointments were made, be furnished to each Council Member. CITY PLANNING CCMMISSION ITMMS: The following actions taken by the City Planning Commission at their meeting held November 1, 1982, pertaining to the following applications were submitted for City Council information. 1. CONDITIONAL USE PEI~IT NO. 2387: Submitted by Emkay Development Company, Inc., to permit a commercial office building on ML zoned property located at the southwest corner of Pacifico Avenue and Santa Cruz Street, with a Code waiver of minimum landscaped setback. Request for Conditional Use Permit No. 2387 was withdrawn by the petitioner, and the Planning Commission granted a negative declaration status. 2. VARIANCE NO. 3296: Submitted by George Birnbaum, et al, to construct an addition to an existing commercial building on CL zoned property located on the west side of Euclid Street between Medical Center Drive and Romneya Drive with a Code waiver of minimum landscaped setback. The City Planning Commission, pursuant to Resolution No. PC82-201, granted Variance No. 3296, and ratified the Planning Director's categorical exemption determination. 3. CONDITIONAL USE PERMIT NO 2391: Submitted by Esperanza Villas, to permit a 21-lot, 97-unit affordable condominium conversion on EM-1200 zoned property located on the north side of Orangethorpe Avenue between Kellogg Drive and F0st Lane, with the following Code waivers: (a) minimum 10t area per unit, (b) maximum site coverage and (c) minimum number and type of parking spaces. The City Planning Commission, pursuant to Resolution No. PC82-202, granted Conditional Use Permit No. 2391, and ratified the Planning Director's categorical exemption determination. 4. VARIANCE NO. 3302: Submitted by Michael Goland, to expand a self-storage facility onML zoned property located at 1050 North Armando Street, with a Code waiver of minimum number of parking spaces. The City Planning Commission, pursuant to Resolution No. PC82-203, granted Variance No. 3302, and granted a negative declaration status. 1015 City Hall, Anaheim, California - COUNCIL MINUTES - November 23, 1982, 10:00 A.M. 5. VARIANCE NO. 3303: Submitted by Joseph and Ellen Donnelly, to construct a 6-foot high block wall and room addition on RS-7200 zoned property located at 815 North Modena Street, with the following Code waivers: (a) maximum wall height and (b) minimum rear yard setback. The City Planning Commission, pursuant to Resolution No. PC82-204, granted Variance No. 3303, and ratified the Planning Director's categorical exemption determination. 6. RECLASSIFICATION NO. 80-81-18 AND CONDITIONAL USE PEI~IT NO. 2144--EXTENSIONS OF TIME: Submitted by Dan L. Rowland, requesting extensions of time to Reclassification No. 80-81-18 and Conditional Use Permit No. 2144, proposed CL zoning to permit a performing arts theater with on-sale beer and wine on property located at the northwest corner of Broadway and Philadelphia Street. The City Planning Commission approved extensions of time to Reclassification No. 80-81-18 and Conditional Use Permit No. 2144, to expire November 17, 1983. 7. RECLASSIFICATION NO. 80-81-11 AND CONDITIONAL USE PERMIT NO. 2108--CLARIFICATION OF USES: Submitted by Eric Nash requesting permission to operate a deli-sandwich shop with off-sale of beer and wine in addition to the gift shop use on proposed CL zoned property located at 627 South Harbor Boulevard under Reclassification No. 80-81-11 and Conditional Use Permit No. 2108, to permit commercial use of a residential structure with a Code waiver of minimum number of parking spaces. No action was taken by the Planning Commission. 170: TENTATIVE TRACTS FRCM THE PLANNING CCMMISSION MEETING OF NOVEMBER 15, 1982: No action was taken on the following Tentative Tracts from the Planning Commission Meeting of November 15, 1982; however, it was noted that the 10-day appeal period would normally expire November 25, 1982, at 5:00 p.m.; however, due to City holidays scheduled, the appeal period will expire November 29, 1982, 5:00 p.m. 8. TENTATIVE TRACT NO. 11766 (CONDITIONAL USE PERMIT NO. 2391): Submitted by Esperanza Villas, to establish a 21-lot, 97-unit affordable condominium subdivision on RM-1200 zoned property located on the north side of Orangethorpe Avenue between Kellogg Drive and Post Lane. The City Planning Commission approved Tentative Tract No. 11766, in conjunction with Conditional Use Permit No. 2391, and granted a negative declaration status. 9. TENTATIVE TRACT NO. 8520, REV. 2 (READV.): Submitted by Texaco, Anaheim Hills, Inc., to re-establish an 18-lot, plus one open-space lot, subdivision on proposed RS-HS-22,000(SC) zoned property located at the southwest and southeast corners of Serrano Avenue and Hidden Canyon Road. 1016 City Hall, Anaheim, California - COUNCIL MINUTES - November 23, 1982, 10:00 A.M. The City Planning Commission approved Tentative Tract No. 8520, Rev. 2, and Environmental Impact Report No. 2il was previously certified by the City Council on March 14, 1978. No action was taken by the City Council on the foregoing items; therefore, the actions of the City Planning Commission became final. 134/179: ESTABLIS~I~ENT OF DATE FOR PUBLIC HEARING ON GENERAL PLAN AMEN~ENT NO. 179, RECLASSIFICATION NO. 82-83-9 AND VARIANCE NO. 3301: Recommendation from the Planning Commission that Reclassification No. 82-83-9, Variance No. 3301, and Negative Declaration, proposed RM-1200 zoning to construct a 274-unit apartment complex on property located south and west of the southwest corner of Lincoln Avenue and Rio Vista Street, be set for public hearing in conjunction with General Plan Amendment No. 179 on December 7, 1982, at 7:00 p~mo, was submitted for Council consideration~ Following brief discussion, during which it was recognized by Councilman Bay that the Community Development Block Grant (CDBG) hearing and the Planning Commission Parking study were already scheduled for that same evening, December 7, 1982, Council Members did not feel they would have sufficient time to receive public input and make decisions on all these matters. It was subsequently determined, by general Council consent, to reschedule the Planning Commission joint meeting on the Parking Study to December 14, 1982, at 2:30 p.m. MOTION: On motion by Councilwoman Kaywood, seconded by Councilman Pickler, the recommendation from the Planning Commission was accepted, and it was determined the public hearing on Reclassification No. 82-83-9, Variance No. 3301, and Negative Declaration therefor would be held in conjunction with GPA No. 179 on December 7, 1982, at 7:00 p.m. MOTION CARRIED. 108/142: AMENI~ENT TO TRANSIENT OCCUPANCY TAX ORDINANCE: Councilman Overholt offered Ordinance No. 4378 for first reading. ORDINANCE NO. 4378: AN ORDINANCE OF THE CITY OF ANAHEIM ADDING NEW SECTION 2.12.045 AND AMENDING SECTION 2.12.070 OF CHAPTER 2.12 OF TITLE 2 OF THE ANAHEIM MUNICIPAL CODE RELATING TO TRANSIENT OCCUPANCY TAX. Councilman Overholt explained that the concepts involved in this amended ordinance are (1) it would require payment of interest on amounts which are delinquent in the amount of 1 1/2 percent per month; (2) it would continue to require payment of a penalty; (3) there is provision within the ordinance for an appeal process of the penalty. MOTION: Councilman Bay moved that Ordinance Noo 4378 be amended to read that a penalty imposed could not be waived except by a four-fifths vote of the Council. Councilwoman Kaywood seconded the motion. Prior to voting on the motion, the Council held a brief discussion during which Members voiced their opinions for and against the four-fifths requirement. 1017 City Hall, Anaheim, California - COUNCIL MINUTES - November 23, 1982, 10:00 A.M. Kaywood, Pickler and Bay Overholt and Roth None Councilman Overholt stated that while he agreed with the purpose for amending the ordinance, he felt that majority rule should be the basic structure. 131/173: STATUS REPORT "NORTH-SOUTH/CENTRAL ORANGE COUNTY CORRIDOR STUDY": Mr. Tom Jenkins of the Orange County Transportation Commission gave a brief slide presentation indicating that the Commission staff has now narrowed their recommendations to three alternatives for final testing as set forth in the Planning Department/Planning Division staff report received November 17, 1982. In response to Councilman Bay's comments regarding the apparent freeway maintenance activity in San Diego or Northern counties, as compared to Orange County, Mr. Jenkins advised that Mr. Heckenroth will be presenting a report on the condition of Orange County freeways at the next CalTrans meeting. He added that they are aware of the serious freeway paving problems on the Santa Ana Freeway. MOTION: At the conclusion of the presentation, on motion by Councilman Pickler, seconded by Councilman Roth, the Anaheim City Council received and filed the status report on the Orange County Transportation Commission's "North-South/Central Orange County Corridor Study" and further, postponed any action on the gap closure of the Route 57 Freeway until results of the final evaluation are received. PUBLIC REQUESTS - CONSENT CALENDAR ITEMS: On motion by Councilman Pickler, seconded by Councilwoman Kaywood, the following actions were authorized in accordance with the reports and recommendations furnished each Council Member and as listed on the Consent Calendar Agenda: 1. RECLASSIFICATION NO. 65-66-63, CONDITIONAL USE PERMIT NO. 1905 AND VARIANCE NO. 3060 - EXTENSIONS OF TIME: Request by Leonard Smith, for extensions of time to Reclassification No. 65-66-63, Conditional Use Permit No. 1905, and Variance No. 3060, proposed CO zoning to permit an auto parking lot with certain Code waivers and to construct a 3-story office building on property located at the southeast corner of Harbor Boulevard and South Street, was submitted and granted, as recommended by the Zoning Division, to expire January 2, 1984. 2. CONDITIONAL USE PERMIT NO. 2110 - EXTENSION OF TIME: Request by Jafferali A. AFTER RECESS: The Mayor called the meeting to order, all Council Members being present. (12:02 p.m.) The Assistant City Manager requested a Closed Session with no action anticipated; the City Attorney requested a Closed Session to discuss litigation with action anticipated. RECESS - CLOSED SESSION: Councilman Roth moved to recess into Closed Session. Councilman Bay seconded the motion. MOTION CARRIED. (12:03 p.m.) AFTER CLOSED SESSION: The Mayor called the meeting to order, all Council Members being present. (1:40 p.m.) 112: CISTERNINO VS. CITY OF ANAHEIM: On motion by Councilman Roth, seconded by Councilman Bay, the City Council authorized the City Attorney and Kinkle, Rodiger and Spriggs to settle Orange County Superior Court Case No. 32-80-27 (Cisternino vs. City of Anaheim) for a sum not to exceed ~6,250. MOTION CARRIED. 123: AGREMMENT FOR LEGAL SERVICES - ROGERS AND WELLS: On motion by Councilman Pickler, seconded by Councilwoman Kaywood, the City Council authorized and approved an agreement between the City of Anaheim and the law firm of Rogers and Wells for legal services associated with an SB-90 claim and authorized the Mayor and City Clerk to execute said agreement. SOUTHERN TRANSPORTATION CO., CITY OF ANAHEIM, ET AL: On motion by Councilman Roth, seconded by Councilman Overholt, the City Attorney and Ruston & Nance were authorized to settle Orange County Superior Court Case No. 32-73-85 (Nancy Talley vs. Southern Transportation Co., City of Anaheim, et al.) for a sum not to exceed ~10,000. MOTION CARRIED. 111/153: CHAMBER OF CCPfMERCE BLUE RIBBON CCMMITTEE REPORT - EXECUTIVE SALARIES: On motion by Councilman Bay, seconded by Councilman Pickler, the Anaheim City Council ordered the Chamber of Commerce Blue Ribbon Committee Report on executive salaries received and filed, and further directed that a letter of appreciation be prepared for members of the Blue Ribbon Committee to be signed by full Council.
