RES-2014-207 RESOLUTION NO. 2014-207 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AMENDING THE ANAHEIM REGIONAL TRANSPORTATION INTERMODAL CENTER (ARTIC) COORDINATED SIGN PROGRAM (MISCELLANEOUS PERMIT NO. 2012- 00558A). (DEV2010-00043B) � WHEREAS, on June 5, 2012, the Anaheim City Council (hereinafter "City Council") did adopt Ordinance No. 6247 amending Section 18.14.130 of Chapter 18.14 of Title 18 of the Anaheim Municipal Code relating to signs in conjunction with a transit facility, to permit such signs, including off-site advertising, subject to the approval of the Planning Director; and, WHEREAS, on September 18, 2012 the Planning Director did approve Miscellaneous Permit No. 2012-00558, permitting a Coordinated Sign Progam (hereinafter "ARTIC Coordinated Sign Program"} for the Anaheim Regional Transportation Intermodal Center ("ARTIC") located at 2626 East Katella Avenue in the City of Anaheim, County of Orange, State of California, as generally depicted on Exhibit "A" attached hereto and incorporated herein by this reference (the "Subject Property"); and, WHEREAS, the ARTIC Coordinated Sign Progam includes a variety of signs, including monument signs adjacent to the ARTIC site entrances on Katella Avenue and Douglass Road, wall si�ns above the building entrances, bus shelter and train platform signs, which include outdoor advertising panels, and other directional and informational signs; and, WHEREAS, the Planning Director did receive a City-initiated request to amend the ARTIC Coordinated Sign Program to replace the approved monument signs with larger digital monument signs that include off-site advertising and to add a double-sided freeway- oriented digital billboard to the ARTIC Coordinated Sign Progam, as more particularly shown in Exhibit "B" hereto; and, WHEREAS, the Planning Director, pursuant to Anaheim Municipal Code Section 18.60.080 (Planning Director Reviews) of Chapter 18.60 of Title 18 of the Anaheim Municipal Code, did refer said request to the Planning Commission, in that she determined it was in the general public interest to make such a referral; and, WHEREAS, the Planning Commission did hold a public hearing at the Civic Center in the City of Anaheim on November 3, 2014, at 5:00 p.m., notice of said public hearing having been duly given as required by law and in accordance with the provisions of Chapter 18.60 of the Anaheim Municipal Code, to hear and consider evidence for and against said amendment to the ARTIC Coordinated Sign Program and to investigate and make findings and recommendations in connection therewith; and, -1- WHEREAS, the Planning Commission, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, did by motion, deny said request; and, WHEREAS, on November 6, 2014 the Anaheim Public Works Director did appeal the Planning Commission's decision; and, WHEREAS, the City Council did set the matter for a public hearing on November 25, 2014, notice of said public hearing having been duly given as required by law and in accordance with the provisions of Chapter 18.60 of the Anaheim Municipal Code, to hear and consider evidence for and against said amendment to the ARTIC Coordinated Sign Program and to investigate and make findings and recommendations in connection therewith; and, WHEREAS, at the time and place fixed for said public hearing, the City Council did hold and conduct such public hearing and did give all persons interested therein an opportunity to be heard, and did receive evidence and reports, and did consider the action of the Planning Commission; and, WHEREAS, the City Council has reviewed said amendment to the ARTIC Coordinated 5ign Program, and does hereby find and determine that previously-certified Final Environmental Impact Report No. 343, together with the previously-approved Addendum prepared in connection with the ARTIC proj ect, are adequate to serve as the required environmental documentation for said amendment to the ARTIC Coordinated Sign Program and satisfy all the requirements of the California Environmental Quality Act; and that no further environmental documentation need be prepared for said amendment to the ARTIC Coordinated Sign Program; and, WHEREAS, the City Council desires to eliminate from the proposed amendment to the ARTIC Coordinated Sign Program the double-sided freeway-oriented digital billboard and to replace the digital sign faces on the two proposed monument signs with static, non-digital displays limited to the advertisement of on-site activities and/or tenants; and WHEREAS, after careful consideration of all additional evidence and reports offered at said public hearing before the City Council, the City Council does hereby find and determine, with respect to said amendment to the ARTIC Coordinated Sign Program that, with the exception of the double-sided freeway-oriented digital billboard and the digital sign faces on the two proposed monument signs, all of the conditions and criteria set forth in the Anaheim Municipal Code are present. Specifically, this City Council finds and determines as follows: 1. The signs are permitted by Anaheim Municipal Code Section 18.14.130 (Signs). � 2. The signs will be part of a coordinated sign program. -2- 3. The signs will complement the architecture of the ARTIC transit facility and provide a unifying element along the streetscape. 4. The size, scale and style of the signs will be internally consistent and consistent with the scale of the transit facility and the surrounding land uses. WHEREAS, the City Council determines that the evidence in the record constitutes substantial evidence to support the actions taken and the findings made in this Resolution, that the facts stated in this Resolution are supported by substantial evidence in the record, including testimony received at the pubIic hearing, the staff presentations, the staff report and all materials in the project files. There is no substantial evidence, nor are there other facts, that detract from the findings made in this Resolution. The City Council expressly declares that it considered all evidence presented and reached these findings after due consideration of all evidence presented to it. NOW, THEREFORE, BE IT RESOLVED by the City Council, for the reasons hereinabove specified, that Miscellaneous Permit No. 2012-00558A to amend the ARTIC Coordinated Sign Program as shown in Exhibit "B", excluding the double-sided freeway- oriented digital billboard and including the replacement of the digital sign faces on the two proposed monument signs with static, non-digital displays limited to the advertisement of on-site activities and/or tenants, be, and the same is hereby, approved.
