ORDINANCE NO. 5562
AN ORDINANCE OF THE CITY OF ANAHEIM AMENDING
VARIOUS SECTIONS OF TITLE 18 OF THE ANAHEIM
MUNICIPAL CODE RELATING TO ZONING (LARGE
FAMILY DAY CARE HOMES).
THE CITY COUNCIL OF THE CITY OF ANAHEIM HEREBY ORDAINS
AS FOLLOWS:
SECTION 1.
That Section 18.04.140 of Chapter 18.04 of Title 18 of
the Anaheim Municipal Code be, and the same is hereby, amended to
read as follows:
1118.04.140 LARGE FAMILY DAY CARE HOME CRITERIA AND STANDARDS
No Large Family Day Care Home shall be located, operated or
maintained by any person or entity within the City of Anaheim
except in compliance with all of the following provisions:
.010 Such use shall be conducted within a single-
family dwelling located in a residential zone of the
City.
.020 Such use shall comply with all state
licensing requirements for Large Family Day Care Homes.
.030 Such use shall comply with standards adopted
by the State Fire Marshal pursuant to the California
Health and Safety Code relating to Large Family Day
Care Homes.
.040 Such use and dwelling unit shall comply with
all site development standards for the residential zone
in which it is located. No signs or advertising
identifying the day care use shall be permitted.
.050 Such use shall be located not closer than 600
feet from any other Large Family Day Care Home, Child
Day Care Center, Preschool or Nursery as measured at
the closest points of the parcels whereon said uses are
conducted.
.060 A Site Plan satisfactory to the City Traffic
and Transportation Manager shall be submitted
specifying the vehicle loading and unloading area for
the children and any required parking spaces which will
be maintained for the use.
.070 The City Traffic and Transportation Manager
shall review and approve the Site Plan if the Site Plan
conforms to the following requirements:

.0701 One (1) off-street parking space shall
be provided for each employee or worker who does
not live on the premises. Off-street parking
spaces provided for the dwelling unit, other than
spaces within a garage, may be counted toward
satisfaction of this requirement.
.0702 If the use is located on a parcel
abutting, or having access upon an arterial
highway as designated on the Circulation Element
of the Anaheim General Plan, an on-site vehicle
loading and unloading area for children shall be
provided which (i) provides vehicular access to
and from the child care site without stacking of
vehicles onto the public street or sidewalk; and
(ii) provides circular or turn -around drives on-
site so vehicles do not back up onto the public
street.
.0703 If the proposed location is not on a
parcel abutting or having access upon an arterial
highway, at least one (1) on -street or off-street
loading space shall be provided. Any off-street
loading space so provided shall conform to the
requirements of Chapter 18.06 of this Code. Any
on -street loading space so provided shall be
designated and maintained as such by such means as
approved in the Site Plan.
.0704 The Site Plan shall clearly identify
pedestrian routes to and from the drop-off and
pick-up areas, including sidewalks and directional
signage
.080 The applicant shall obtain a City business
license for a Large Family Day Care Home, shall provide
a copy of the State of California Day Care License to
the City Planning Department and shall register said
home with the Planning Department on forms approved for
such purpose by the City of Anaheim Planning
Commission."
SECTION 2.
That subsection .036 of Section 18.21.030 of Chapter
18.21 of Title 18 of the Anaheim Municipal Code be, and the same
is hereby, amended to read as follows:
11.036 Large Family Day Care Homes as defined
in Section 18.01.070, subject to the criteria and
standards in Section 18.04.140 of this Code."

SECTION 3.
That subsection .036 of Section 18.22.030 of Chapter
18.22 of Title 18 of the Anaheim Municipal Code be, and the same
is hereby, amended to read as follows:
".036 Large Family Day Care Homes as defined
in Section 18.01.070, subject to the criteria and
standards in Section 18.04.140 of this Code."
SECTION 4.
That subsection .036 of Section 18.23.030 of Chapter
18.23 of Title 18 of the Anaheim Municipal Code be, and the same
is hereby, amended to read as follows:
11.036 Large Family Day Care Homes as defined
in Section 18.01.070, subject to the criteria and
standards in Section 18.04.140 of this Code."
SECTION 5.
That subsection .036 of Section 18.24.030 of Chapter
18.24 of Title 18 of the Anaheim Municipal Code be, and the same
is hereby, amended to read as follows:
11.036 Large Family Day Care Homes as defined
in Section 18.01.070, subject to the criteria and
standards in Section 18.04.140 of this Code."
SECTION 6.
That subsection .026 of Section 18.25.030 of Chapter
18.25 of Title 18 of the Anaheim Municipal Code be, and the same
is hereby, amended to read as follows:
11.026 Large Family Day Care Homes as defined
in Section 18.01.070, subject to the criteria and
standards in Section 18.04.140 of this Code."
SECTION 7.
That subsection .036 of Section 18.26.030 of Chapter
18.26 of Title 18 of the Anaheim Municipal Code be, and the same
is hereby, amended to read as follows:
".036 Large Family Day Care Homes as defined
in Section 18.01.070, subject to the criteria and
standards in Section 18.04.140 of this Code."

SECTION 8.
That subsection .026 of Section 18.27.030 of Chapter
18.27 of Title 18 of the Anaheim Municipal Code be, and the same
is hereby, amended to read as follows:
11.026 Large Family Day Care Homes as defined
in Section 18.01.070, subject to the criteria and
standards in Section 18.04.140 of this Code."
SECTION 9.
That subsection .026 of Section 18.31.030 of Chapter
18.31 of Title 18 of, the Anaheim Municipal Code be, and the same
is hereby, amended to read as follows:
11.026 Large Family Day Care Homes as defined
in Section 18.01.070, subject to the criteria and
standards in Section 18.04.140 of this Code."
SECTION 10.
That subsection .026 of Section 18.32.030 of Chapter
18.32 of Title 18 of the Anaheim Municipal Code be, and the same
is hereby, amended to read as follows:
".026 Large Family Day Care Homes as defined
in Section 18.01.070, subject to the criteria and
standards in Section 18.04.140 of this Code."
SECTION 11.
That subsection .026 of Section 18.34.030 of Chapter
18.34 of Title 18 of the Anaheim Municipal Code be, and the same
is hereby, amended to read as follows:
11.026 Large Family Day Care Homes as defined
in section 18.01.070, subject to the criteria and
standards in section 18.04.140 of this Code."
SECTION 12.
That Section 18.35.030 of Chapter 18.35 of Title 18 of
the Anaheim Municipal Code be, and the same is hereby, amended to
read as follows:
1118.35.030 PERMITTED ACCESSORY USES AND STRUCTURES.
Accessory buildings, structures, and uses
permitted in this zone shall be the same as those
specified in Section 18.31.030 of this Code, except

that Large Family Day Care Homes shall not be
permitted."
SECTION 13. SEVERABILITY
The City Council of the City of Anaheim hereby declares
that should any section, paragraph, sentence or word of this
ordinance of the Code, hereby adopted, be declared for any reason
to be invalid, it is the intent of the Council that it would have
passed all other portions of this ordinance independent of the
elimination herefrom of any such portion as may be declared
invalid.
SECTION 14. SAVINGS CLAUSE
Neither the adoption of this ordinance nor the repeal
of any other ordinance of this City shall in any manner affect
the prosecution for violations of ordinances, which violations
were committed prior to the effective date hereof, nor be
construed as a waiver of any license or penalty or the penal
provisions applicable to any violation thereof. The provisions
of this ordinance, insofar as they are substantially the same as
ordinance provisions previously adopted by the City relating to
the same subject matter, shall be construed as restatements and
continuations, and not as new enactments.
SECTION 15. PENALTY
It shall be unlawful for any person, firm or
corporation to violate any provision or to fail to comply with
any of the requirements of this ordinance. Any person, firm or
corporation violating any provision of this ordinance or failing
to comply with any of its requirements shall be deemed guilty of
a misdemeanor and upon conviction thereof shall be punished by a
fine not exceeding One Thousand Dollars ($1,000.00) or by
imprisonment not exceeding six (6) months, or by both such fine
and imprisonment. Each such person, firm or corporation shall be
deemed guilty of a separate offense for each day during any
portion of which any violation of any of the provisions of this
ordinance is committed, continued or permitted by such person,
firm or corporation, and shall be punishable therefor as provided
for in this ordinance.

THE FOREGOING ORDINANCE is approved and adopted by the
City Council of the City of Anaheim this 7th day of May ,
1996.
