5557I ORDINANCE NO. 5557 AN ORDINANCE OF THE CITY OF ANAHEIM AMENDING VARIOUS SECTIONS OF CHAPTERS 18.41, 18.44, 18.45 AND 18.46 OF TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO RECONSTRUCTION OF SINGLE FAMILY RESIDENCES AND HOME OCCUPATION REGISTRATIONS IN COMMERCIAL ZONES. THE CITY COUNCIL OF THE CITY OF ANAHEIM HEREBY ORDAINS AS FOLLOWS: SECTION 1. That Section 18.41.020 of Chapter 18.41 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended by adding thereto a new subsection .080, which subsection .080 shall read as follows: 11.080 The reconstruction of a single-family residence, existing on the date of adoption of this ordinance, that is damaged or destroyed by earthquake, fire, wind, flood, explosion or other disaster, casualty or Act of God, or of a public enemy, subject to development standards contained within either the RS -7200 or RS -5000 Zone, provided that a complete and proper application for a building permit is filed with the Building Division within two years of the date of the event that caused the damage or destruction." SECTION 2. That Section 18.41.030 of Chapter 18.41 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended by adding thereto a new subsection .015, which subsection .015 shall read as follows: ".015 Home Occupations, as defined in Section 18.01.090, in compliance with all conditions and limitations of Section 18.02.052.040, 'Home Occupations'; provided, such use shall only be permitted in a structure originally intended for and currently used as a single-family or multiple -family residence." SECTION 3. That Section 18.44.020 of Chapter 18.44 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended by adding I thereto a new subsection .305, which subsection .305 shall read as follows: 11.305 The reconstruction of a single-family residence, existing on the date of adoption of this ordinance, that is damaged or destroyed by earthquake, fire, wind, flood, explosion or other disaster, casualty or Act of God, or of a public enemy, subject to development standards contained within either the RS -7200 or RS -5000 Zone, provided that a complete and proper application for a building permit is filed with the Building Division within two years of the date of the event that caused the damage or destruction." That Section 18.45.020 of Chapter 18.45 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended by adding thereto a new subsection .325, which subsection .325 shall read as follows: 11.325 The reconstruction of a single-family residence, existing on the date of adoption of this ordinance, that is damaged or destroyed by earthquake, fire, wind, flood, explosion or other disaster, casualty or Act of God, or of a public enemy, subject to development standards contained within either the RS -7200 or RS -5000 Zone, provided that a complete and proper application for a building permit is filed with the Building Division within two years of the date of the event that caused the damage or destruction." 2 I SECTION 6. That Section 18.46.020 of Chapter 18.46 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended by adding thereto a new subsection .485, which subsection .485 shall read as follows: 11.485 The reconstruction of a single-family residence, existing on the date of adoption of this ordinance, that is damaged or destroyed by earthquake, fire, wind, flood, explosion or other disaster, casualty or Act of God, or of a public enemy, subject to development standards contained within either the RS -7200 or RS -5000 Zone, provided that a complete and proper application for a building permit is filed with the Building Division within two years of the date of the event that caused the damage or destruction." SECTION 8. That Section 18.46.030 of Chapter 18.46 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended by adding thereto a new subsection .045, which subsection .045 shall read as follows: 11.045 Home Occupations, as defined in Section 18.01.090, in compliance with all conditions and limitations of Section 18.02.052.040, 'Home Occupations'; provided, such use shall only be permitted in a structure originally intended for and currently used as a single-family or multiple -family residence." SECTION 9. SEVERABILITY The City Council of the City of Anaheim hereby declares that should any section, paragraph, sentence or word of this 3 A ordinance of the Code, hereby adopted, be declared for any reason to be invalid, it is the intent of the Council that it would have passed all other portions of this ordinance independent of the elimination herefrom of any such portion as may be declared invalid. SECTION 10. SAVINGS CLAUSE Neither the adoption of this ordinance nor the repeal of any other ordinance of this City shall in any manner affect the prosecution for violations of ordinances, which violations were committed prior to the effective date hereof, nor be construed as a waiver of any license or penalty or the penal provisions applicable to any violation thereof. The provisions of this ordinance, insofar as they are substantially the same as ordinance provisions previously adopted by the City relating to the same subject matter, shall be construed as restatements and continuations, and not as new enactments. SECTION 11. PENALTY It shall be unlawful for any person, firm or corporation to violate any provision or to fail to comply with any of the requirements of this ordinance. Any person, firm or corporation violating any provision of this ordinance or failing to comply with any of its requirements shall be deemed guilty of a misdemeanor and upon conviction thereof shall be punished by a fine not exceeding One Thousand Dollars ($1,000.00) or by imprisonment not exceeding six (6) months, or by both such fine and imprisonment. Each such person, firm or corporation shall be deemed guilty of a separate offense for each day during any portion of which any violation of any of the provisions of this ordinance is committed, continued or permitted by such person, firm or corporation, and shall be punishable therefor as provided for in this ordinance.
