5503ORDINANCE NO. 5503 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AMENDING ORDINANCE NOS. 5377 AND 5378 RELATING TO THE DISNEYLAND RESORT SPECIFIC PLAN NO. 92-1 (CHAPTER 18.78 OF THE ANAHEIM MUNICIPAL CODE; AMENDMENT NO. 2). WHEREAS, pursuant to the procedures set forth in Chapter 18.93 of the Anaheim Municipal Code, the City Council of the City of Anaheim adopted Ordinance No. 5377 amending the zoning map to reclassify certain real property described therein into The Disneyland Resort Specific Plan No. 92-1 Zone subject to certain conditions as specified therein, and Ordinance No. 5378 relating to establishment of zoning and development standards for Specific Plan 92-1 by the addition of Chapter 18.78 to said Code; and WHEREAS, pursuant to Chapter 18.93, the Disney Development Company submitted a request dated December 27, 1993, that the Planning Commission initiate Amendment No. 1 to Specific Plan No. 92-1; and WHEREAS, on April 12, 1994, the City Council amended Specific Plan No. 92-1 by approving Resolution No. 94R-41 (amending Resolution Nos. 93R-146 and Resolution No. 93R-147) and adopting Ordinance No. 5420 (amending Ordinance Nos 5377 and 5378) to (i) add a fifth planning district named District A (Development Area 5) consisting of approximately 9 acres located at the southeast corner of Freedman Way and Harbor Boulevard; and (ii) add Section 18.78.095 "Land Use and Site Development Standards -District All to Chapter 18.78 "Specific Plan No. 92-1" of the Anaheim Municipal Code ("Amendment No. 111). WHEREAS, pursuant to Chapter 18.93 of the Anaheim Municipal Code, Melodyland Christian Center, Inc. filed a petition to amend Specific Plan No. 92-1 to include property located at 400 West Freedman Way (the "Property") in District A of the Disneyland Resort Specific Plan, thereby eliminating parking and transportation facilities as primary uses for the subject property; and WHEREAS, the Property consists of approximately 9.86 acres with a frontage of approximately 630 feet on the south side of Freedman Way, a maximum depth of approximately 900 feet, and located approximately 260 feet west of the centerline of Clementine street, more particularly described in Attachment A to this ordinance, which is incorporated herein; and WHEREAS, Amendment No. 2 to Specific Plan No. 92-1 does consider the following: 1 1. Redesignation of the Property from the Parking District (Development Area 3a) of The Disneyland Resort Specific Plan to District A (Development Area 5), and removal of District A acreage from the C-R Overlay and the East Parking Area Option, thereby removing parking and transportation facilities as a permitted use in the subject property. District A allows development of permitted and conditionally permitted uses allowed in Specific Plan 92-2 "Anaheim Resort" (which supersedes the C-R Zone) as set forth in Chapter 18.48 of the Anaheim Municipal Code, as it currently exists or may be amended or superseded in the future, which revisions would be consistent with existing provisions for the C-R Overlay of the Disneyland Resort; 2. Revisions to text and exhibits in The Disneyland Resort Specific Plan document, to Chapter 18.78 "Specific Plan No. 92-1," and to the Conditions of Approval to reflect the addition of the subject property to District A and revisions to the Specific Plan associated therewith; and WHEREAS, the City Council desires to amend Ordinance No. 5377 by amending Specific Plan No. 92-1 adopted therein and revising certain conditions of approval; and WHEREAS, the City Council also desires to amend the zoning and development standards established by Ordinance No. 5378 contained in Chapter 18.78 of the Anaheim Municipal Code applicable to The Disneyland Resort Specific Plan No. 92-1. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: 1. That Ordinance No. 5377, be, and the same is hereby, amended as follows: A. The Disneyland Resort Specific Plan document (adopted by Ordinance No. 5377 and amended by Ordinance No. 5420) is amended as shown in Attachment B "Summary of Proposed Changes to the Disneyland Resort Specific Plan No. 92-1, Amendment No. 2," attached hereto and incorporated herein; B. The conditions of approval to The Disneyland Resort Specific Plan No. 92-1 are amended as follows: (1) Amend Condition No. 27 to read: "That no development shall occur unless such development is substantially in accordance with the Disneyland Resort Specific Plan No. 92-1, Amendment No. 2, document on file with the Planning Department and marked Exhibit A, Amendment No. 2." (2) Amend Condition No. 70 to read: "That development within District A shall be in compliance with the Conditions of Approval set forth in Ordinance No. 5377, as amended and the mitigation measures set forth in the adopted Mitigation Monitoring Program No. 0067, as it may be amended from time to time." (3) Delete Condition Nos. 65, 66 and 68 in their entirety. 2. That Ordinance No. 5378 be, and the same is hereby, amended to revise the zoning and development standards in Chapter 18.78 of the Anaheim Municipal Code as follows: SECTION 1. That subsection .010 of Section 18.78.010 of Chapter 18.78 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended to read as follows: 1118.78.010 PURPOSE AND INTENT. .010 Purpose. The regulations set forth in this Chapter have been established to provide for orderly development of, and upon adoption of an ordinance reclassifying said property to SP 92-1 (the'Zone'), shall be applicable to that certain property (hereinafter referred to as the 'Specific Plan' area) marked 'Exhibit A' and on file in the Office of the City Clerk approved by the City Council on June 29, 1993 and amended on April 12, 1994 (Amendment No. 1) and _June 20th , 1995 (Amendment No. 2), or as the same may be hereinafter amended in accordance with the Specific Plan amendment procedures set forth in Chapter 18.93 'Specific Plans. SECTION 2. That subsection .020 of Section 18.78.010 of Chapter 18.78 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended to read as follows: "18.78.020 GENERAL PROVISIONS. .020 Disneyland Resort Design Plan. The site development standards set forth in Sections 18.78.050 through 18.78.110 of this Chapter have been adopted to operate in conjunction with the Design Plan for the Disneyland Report Specific Plan 3 identified in Section 5.0 of the Specific Plan document (hereinafter referred to in this Chapter as the 'Design Plan') approved by the City Council on June 29, 1993 and amended on April 12, 1994 ( Amendment No. 1) and June 20th , 1995 (Amendment No. 2), or as the same may be hereinafter amended in accordance with the'Specific Plan amendment procedures set forth in Chapter 18.93 'Specific Plans.' Said Disneyland Report Design Plan is incorporated herein by this reference as if fully set forth in this Chapter. All development otherwise permitted by this chapter shall comply with any applicable provisions of the Design Plan." The Plan proposes 4,600 rooms in four hotels, in- cluding 1,000 rooms remaining in the existing Disneyland Hotel which will undergo extensive renovation. In addition, as previously indicated in the description of the Theme Park District, any of the 1000 rooms not constructed in the Theme Park District may instead be constructed in the Ho- tel District, bringing the maximum permitted number of ho- tel rooms within the Hotel District to 5,600 rooms. Further, the plan provides for up to 300,000 square feet of support retail/ restaurant and 200,000 square feet of meeting space within this District. Parking for the hotels will be provided in parking facilities along the western and northern edges of the District. The primary visitor access to the Hotel District will come from West Street/Disneyland Drive. Secondary access will be provided from Cerritos Avenue via West Street/ Disneyland Drive. All grading and subdivision plans shall comply with all applicable regu- lations and be reviewed and processed in ac- cordance with the procedures contained in Title 17 "LAND DEVELOPMENT AND RE- SOURCES" of the Anaheim Municipal Code. All construction shall comply with the provi- sions of the Uniform Building Code, as adopted by the City of Anaheim, and applica- ble sections of Title 15 "BUILDING AND HOUSING" of the Anaheim Municipal Code. Construction within any District may com- mence only after the Planning Director finds that the construction proposal is in substan- tial compliance with these regulations, ap- plicable policies and guidelines of The Disneyland Resort Specific Plan. With the exception of exemptions provided in Section 18.78.040.0201(d), the issuance of building permits may only occur after Final Site Plan approval has been obtained from the City of Anaheim, subject to the procedures set forth in 18.78.040.020 entitled "FINAL SITE PLAN APPROVAL" of this Chapter. .040 District Boundaries. The Specif- ic Plan area is divided into five land use Dis- tricts (the 'Districts'): Theme Park District, Parking District, Hotel District, Future Ex- pansion District and District A. The Specific Revised Amendment #I Page 346 - 45 Plan area and District boundaries are identi- fied on Exhibit 3.3b entitled 'Development Plan' of the Specific Plan document. The project area legal description is provided in Section 9.0 of the Specific Plan document. Modifications to the configuration and size of the District boundaries may result from technical refinements and site conditions in the subdivision and/or Final Site Plan pro- cess, and may be modified in accordance with the procedures set forth in Section 18.78.040.020 entitled "FINAL SITE PLAN APPROVAL" of this Chapter, without amend- ment to the Specific Plan. Precise District boundaries shall be established, as hereinaf- ter provided, by the submittal, review and approval of subdivision maps in conjunction with the subdivision process as set forth in Chapter 17.08, "SUBDIVISIONS," and Title 18, "ZONING," of the Anaheim Municipal Code and / or "FINAL SITE PLANS" in accor- dance with Section 18.78.046.020 entitled "FINAL SITE PLAN APPROVAL" of this Chap- ter. Specific Plan Amendments (INSERT NEW TEXT) Th ection describes amendments to The Disneyland Resort Specific Plan subsequent to the adoption of The Disneyland Resort Specific Plan No. 92-1 on June 29, 1993. 1807.1 Amendment No. 1: For wall signs the recommended sign illumination is reverse pan channel letters and symbols with halo illumination. This type of sign gives more of an upscale appearance to an establishment while still conveying the message to passers by. For the day time read, the individual pieces of the graph- ic can be painted in colors appropriate to the corporate identity or to the architectural design of the facility. At night, a consistent color for the halo illumination of the sign Tetters will provide visibility of the building or business identity. Amendment No. 1 to The Disneyland Resort Specific Plan relates only to the Parking District, East Parking Area of the Specific Plan. Specific Plan No. 92-1 and the related Zoning and Development Standards (Section 7.0), as adopted by the City of Anaheim on June 29, 1993, allowed two possible configurations for the public parking facility in the East Parking Area. Amendment No. 1 eliminates one of the op- tional configurations (referred to as Option 1 in Specific Plan No. 92-1) for the public parking facility in the East Parking Area while leaving the other configurations (re- ferred to as Option 2 in Specific Plan No. 92-1) intact. To effectuate this change, Amendment No. 1 creates a new district, District A, which, encompasses approximately 9 acres of the property originally within the East Parking Area. Said Amendment includes the removal of District A acreage from the C-R Overlay and the Parking District. Ameridment No. 1 eliminates Parking and Transportation Facilities as primary permitted uses for the newly created District A and eliminates the related provisions for accessory commercial uses within parking facilities within [of Amendment No. 2: Amendment both District A and the Parking District. To effectuate this change, Amendment No. 2 creates a new parking configuration for possible structured parking facilities within the East Parking Area. -46- Revised Amendment #I Page 411 The Disneyland Resort Specific Plan Section 10.0: General Pian Amendment 10.1 Introduction As mentioned earlier in the document, General Plan Amendment No. 331 to amend the City of Anaheim General Plan Land Use and Circulation Elements has been adopted in connection with The Disneyland Resort Specific Plan project. This section describes each of the amendments. Ac- cording to California Government Code Section 65450 no specific plan may be adopted unless the proposed plan is consistent with the general plan. Therefore the amend- ments proposed in this section have been adopted by the City prior to adoption of The Disneyland Resort Specific Plan.
