AN ORDINANCE OF THE CITY OF ANAHEIM REPEALING
ORDINANCE NO. 5025 AND APPROVING THE CANCEL-
LATION OF DEVELOPMENT AGREEMENT NO. 88-05
WHEREAS, the City Council did, on May 2, 1989, adopt
Ordinance No. 5025, which ordinance did approve Development
Agreement No. 88-05 with California Drive -In Theatres, Inc.; and
WHEREAS, said development agreement contemplated the
development of property for office purposes; and,
WHEREAS, the need for office development has
substantially diminished; and,
WHEREAS, California Drive -In Theatres, Inc., has
requested cancellation of Development Agreement No. 88-05 and has
executed an agreement to cancel said Development Agreement and
offered consideration to the City of Anaheim for the cancellation.
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM
DOES ORDAIN AS FOLLOWS:
SECTION 1. That Ordinance No. 5025 be, and the same is
hereby, repealed.
SECTION 2. That the cancellation of Development Agree-
ment No. 88-05 with California Drive -In Threatres, Inc., be and it
is hereby approved, subject to the terms of the agreement to cancel
said Development Agreement.
THE FOREGOING ORDINANCE is approved and adopted by the
City Council of the City of Anaheim this 20th day of September,
1994.
