2002-098RESOLUTION NO. 2002R-98 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT A CHANGE OF ZONE SHOULD NOT BE GRANTED IN A CERTAIN AREA OF THE CITY HEREINAFTER DESCRIBED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Proceedings No. 2002-00067 to consider an amendment to Title 18 of the Anaheim Municipal Code relating to zoning, and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described and, at said hearing, did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty (40) days following said hearing, the Planning Commission did duly adopt a resolution containing a report of its findings, a summary of the evidence presented at said hearing and approved the proposed amendment; and WHEREAS, thereafter, within the time prescribed by law, an interested party or the City Council, on its own motion, caused the review of said Planning Commission action; and WHEREAS, at the time and place fixed for said public hearing, the City Council did hold and conduct such public hearing and did give all persons interested therein an opportunity to be heard, and did receive evidence and reports, and did consider the same; and WHEREAS, the City Council does find and determine that the property and area proposed to be changed from the zone or zones in which it is now situated to a different zone, as hereinafter set forth, is more suitable for the zone or zones in which it is now incorporated and that a change of zone should not be granted for the following reasons: The City Council has determined that the proposed reclassification of zoning for this property could have a significant effect upon the environment and, therefore, disapproved a Negative Declaration for such project pursuant to provisions of the California Environmental Quality Act and the State Guidelines promulgated therefor; o The proposed reclassification would result in an overconcentration of apartment units in an area of the City already oversaturated with rental housing units; The West Anaheim area of the City is in need of a balanced variety of housing opportunities which goal would not be advanced by additional apartment units in the vicinity of the property; The proposed reclassification would result in additional burdens upon the schools in an already overcrowded school district; The proposed reclassification would result in an overburdening of the public streets with additional automobiles in an area already overconcentrated with automobiles competing for limited available on-street parking spaces; and The proposed reclassifications to Medium Density Residential zoning on a parcel approximately one-half acre in area would result in density too high for the property and the surrounding vicinity. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that all of the property and area situated in the City of Anaheim, County of Orange, State of California, described as follows: THAT PORTION OF THE SOUTH HALF OF THE SOUTHEAST QUARTER OF THE SOUTHWEST QUARTER OF SECTION 13, TOWNSHIP 4 SOUTH, RANGE 11 WEST, IN THE RANCHO LOS COYOTES, IN THE CITY OF ANAHEIM, COUNTY OF ORANGE, STATE OF CALIFORNIA, AS SHOWN ON A MAP RECORDED IN BOOK 51, PAGE 11 OF MISCELLANEOUS MAPS, RECORDS OF ORANGE COUNTY, CALIFORNIA, DESCRIBED AS FOLLOWS: BEGINNING AT THE SOUTHWEST CORNER OF THE EAST 5 ACRES OF SAID SOUTH HALF; THENCE ALONG THE SOUTH LINE OF SAID SOUTHWEST QUARTER OF SECTION 13, SOUTH 89° 59' 15" WEST 110.00 FEET TO THE SOUTHEAST CORNER OF THAT CERTAIN LAND DESCRIBED IN DEED TO WILLIAM H. BRINING RECORDED MAY 31, 1956 IN BOOK 3530, PAGE 20, OF OFFICIAL RECORDS OF SAID ORANGE COUNTY; THENCE NORTHERLY ALONG THE EASTERLY LINE OF SAID LAST MENTIONED LAND 279.86 FEET TO THE SOUTHERLY LINE OF TRACT NO. 2228 AS SHOWN ON A MAP RECORDED IN BOOK 69, PAGES 34 THROUGH 37 OF MISCELLANEOUS MAPS, RECORDS OF SAID ORANGE COUNTY, -2- THENCE EASTERLY ALONG SAID LAST MENTIONED SOUTHERLY LINE AND THE SOUTHERLY LINE OF THAT CERTAIN LAND DESCRIBED IN DEED TO VANDRUFF HOMES, INC., RECORDED MAY 5, 1955 IN BOOK 3056, PAGE 47 OF SAID OFFICIAL RECORDS, A DISTANCE OF 110.00 FEET TO THE WESTERLY LINE OF SAID EAST 5 ACRES; THENCE SOUTHERLY ALONG SAID LAST MENTIONED LINE TO THE POINT OF BEGINNING, shall remain in the "RS-A-43,000" RESIDENTIAL/AGRICULTURAL ZONE and not be reclassified into the "RM-1200" RESIDENTIAL, MULTIPLE- FAMILY ZONE. THE FOREGOING RESOLUTION is approved and adopted by the City Council of the City of Anaheim this 7th day of May, 2002.
