5431ORDINANCE NO. 5431 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AMENDING ORDINANCE NOS. 4860 AND 4861 RELATING TO SPECIFIC PLAN 87-1 TO AMEND SUBSECTION 18.70.060.050 OF THE ANAHEIM MUNICIPAL CODE AND AMEND DEVELOPMENT AREA 7 (THE HIGHLANDS AT ANAHEIM HILLS) WHEREAS, the City Council of the City of Anaheim has heretofore adopted Ordinance No. 4860 pursuant to Chapter 18.93 of the Anaheim Municipal Code relating to establishment of zoning and development standards by addition of Chapter 18.70 to said Code; and, WHEREAS, the City Council has further duly adopted Ordinance No. 4861, as amended from time to time, relating to the Specific Plan 87-1 Zone subject to certain conditions as specified therein; and, WHEREAS, the City Council desires to (1) amend the zoning and development standards for Development Area 7 and (2) amend Development Area 7 to permit a maximum four hundred fourteen (414) unit condominium complex instead of three hundred ninety one (391) apartments as previously approved; and, WHEREAS, the City Council has complied with the procedures set forth in Chapter 18.93. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: SECTION 1. That subsection .050 of Section 18.70.060 of Chapter 18.70 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended in its entirety to read as follows: 11.050 Development Area 7. Area to be developed with attached one -family condominium dwellings. All, standards of the RM-2400(SC) Zone (Chapter 18.32) shall apply except as provided below: (a) Maximum Structural Height. (i) Within fifty (50) feet from a development area designated for single-family residences: one (1) story. (ii) Between fifty one (51) and one hundred fifty (150) feet from a development area designated for single-family residences: one (1) to three (3) stories and not to exceed thirty five (35) feet as measured from the ground A floor to the highest portion of the structure; provided, however, that prior to issuance of building permits, line -of -sight drawings shall be submitted to the Planning Commission for review and approval showing that any two (2) and/or three (3) story units will not have an adverse impact on nearby existing or approved single-family residences. (iii) More than one hundred fifty (150) feet from a development area designated for single-family residences: maximum three (3) stories not to exceed thirty five (35) feet as measured from the ground floor to the highest portion of the structure. (b) Minimum Distances Between Buildings. The minimum distance between facing building walls with no main entrances in either wall shall be ten (10) feet; provided, however, that any such walls containing window(s) to habitable room(s) shall maintain privacy. (c) Tandem Parking Spaces. Tandem parking spaces, not to exceed twenty five percent (25%) of the required number of covered parking spaces, may be located on opposite sides of a driveway if approved by the City Traffic and Transportation Manager and based on the determination that safe vehicle turning movements can be made." SECTION 2. That Ordinance No. 4861 be, and the same is hereby, amended to direct the Planning Department to revise Development Area 7 of the sectional zoning map for Specific Plan 87-1 to indicate a maximum four hundred fourteen (414) unit residential condominium complex, as shown on attached Exhibit 14, the Development Plan Map of Specific Plan No. 87-1, which is incorporated herein.
