5409r ORDINANCE NO. 5409 AN ORDINANCE OF THE CITY OF ANAHEIM DELETING CHAPTER 4.02 OF TITLE 4, AMENDING VARIOUS CHAPTERS OF TITLE 18, AND ADDING SECTIONS 18.02.055 AND 18.12.085 TO CHAPTERS 18.02 AND 18.12 OF TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO SPECIAL EVENT PERMITS AND SIGNS, FLAGS, BANNERS AND FIXED BALLOONS. THE CITY COUNCIL OF THE CITY OF ANAHEIM HEREBY ORDAINS AS FOLLOWS: SECTION 1. That Chapter 4.02 of Title 4 of the Anaheim Municipal Code be, and the same is hereby, deleted in its entirety. SECTION 2. That Section 18.01.200 of Chapter 18.01 of Title 18 of the Anaheim Municipal Code be, and same is hereby, amended to revise the definition of "Special Event" to read as follows: "Special Event. A special event is any event, promotion, or sale sponsored by a business, shopping center or organization which is held outside the confines of the building, whether or not a business license is required, and which may include (or be limited to) the display of temporary signs, flags, banners, fixed balloons, rides, games, booths or similar amusement devices, whether or not a fee or admission is charged for such event." SECTION 3. That new Section 18.02.055 be, and the same is hereby, added to Chapter 18.02 of Title 18 of the Anaheim Municipal Code to read as follows: 1118.02.055 SPECIAL EVENT PERMIT - GENERAL. .010 Permit Required. No person, business, or organization shall conduct a special event as defined in Section 18.01.200 without having first applied for and obtained a permit to do so as provided in this Section. il i i .020 Application for Permit. Application for a permit to conduct a special event shall be filed with the Planning Department not less than fourteen (14) days prior to the opening date of any such event involving rides, games, booths, or similar amusement devices. Such application shall state: The name of the sponsoring business or organization; the number and types of rides, games, shows, displays and other individual concessions comprising the event; the address of the business or organization requesting the event; the exact location of the event; a description of the event; the disclosure of any new construction or alterations caused by the event; and such other information as shall be required by the Planning Department. Application for a permit involving only the display of any temporary signs, flags, banners, fixed balloons, or outdoor sales promotion shall be filed with the Planning Department at any time prior to said display. .030 Issuance or Denial of Permit. If the Planning Director determines that all applicable provisions of the law and of the Anaheim Municipal Code, including the provisions of this Section, are, or will be complied with, and that the granting of the permit will not be detrimental to the public health or safety, then a permit shall be issued; otherwise, the application shall be denied. .040 Permit Fee. For each and every permit issued pursuant to this Section, there shall be paid to the Planning Department a permit fee in an amount as established by City Council resolution; provided, however, that charitable, non-profit organizations shall be exempt from payment of the fee. .050 Location. Special events shall be permitted (a) in any commercial zone; (b) in the RS -A-43,000 zone, provided the property is adjacent to an arterial highway as indicated on the Circulation Element of the General Plan; (c) in any zone in conjunction with any use for which a conditional use permit has been issued 6 i authorizing a use which is permitted as a matter of right in any commercial zone; and (d) at public or private elementary, junior or senior high schools, churches or other religious institutions located in any zone, in compliance with Section 18.02.055.0613; provided, however, that a Special Event Permit has been issued therefor by the Planning Department subject to all limitations of Sections 18.02.055 'Special Event Permits -General' and 18.05.070 'Temporary Signs, Flags, Banners and Balloons -General' of this Code. .060 Regulations for Conduct of Special Event. The following regulations shall govern the operation of any special event for which a permit has been issued by the Planning Department, and violation of any such regulation shall be grounds for immediate revocation of such permit: .0601 No structure or amusement device or any fixed balloon shall exceed 50 feet in height as measured from finished grade. .0602 No wild or ferocious animals shall be displayed. .0603 If use of a parking area is intended, a site plan shall be submitted to the City Traffic and Transportation Manager to determine that any use of the parking area serving the principal land use is not reduced below the parking reasonably required for such principal land use. The site plan shall indicate the area proposed for the special event, including any area for installation or storage of all equipment. An approved site plan shall be submitted to the Planning Department. .0604 Prior to erection of any structures, including tents and structures for amusement devices and rides, approval must be obtained from various City departments and divisions including, but not limited to, the Building Division, the Fire Department, and the Electrical Engineering Division. All applicable regulations shall be complied with. Certificates of safety 3 i must be furnished to the Building Division for all rides, and no rides, amusement devices or concessions shall be put into operation until inspected and cleared by the Building Division, Fire Department and the Electrical Engineering Division. .0605 Temporary living quarters to provide security for the special event, such as trailers, vans, or motorhomes may be permitted on the premises solely at the discretion of the Planning Director, and shall be subject to inspection and approval of the Building Division, Fire Department, and the Electrical Engineering Division to assure compliance with requirements of all related codes. .0606 The conduct of any outdoor special event (other than the display of temporary signs, flags, banners and fixed balloons) shall be confined to the hours when the business establishment or shopping center is normally open for business, and in no event shall the special event be operated before 7:00 A.M. or after 10:00 P.M. .0607 Unless otherwise expressly permitted by this Code, no permit shall be issued for a period in excess of nine (9) consecutive calendar days, except for permits issued in conjunction with seasonal Pumpkin Patches and Christmas Tree Lots, which shall be permitted for the duration of the approved temporary business license. .0608 No business establishment, church, or other religious institution, school, or shopping center shall be issued more than four (4) special event permits during any calendar year. .0609 Nothing contained in this Section shall be construed to prohibit the display of the flag of the United States, State of California or its political subdivisions, or any flag or banner of any bona fide religious or fraternal organization; provided, however, that no more than three such flags or banners shall be displayed at the same time at any single location within the City. 4 .0610 Nothing contained in this Section shall be construed to prohibit the traditional holiday decorations for the period from Thanksgiving Day through January 5th of the following year, provided said decorations comply with all applicable City Fire Codes. .0611 Metallic balloons, household linens utilized as banners, and roof -mounted banners are prohibited. .0612 Live or amplified music shall comply with Anaheim Municipal Code Section 6.70 (Sound Pressure Levels). .0613 Special Event permits issued for banners at public or private elementary, junior or senior high schools, churches or other religious institutions located in non- commercial zones shall be subject to the following additional provisions: (a) one banner on each street frontage, up to a maximum of two banners, shall be permitted; and (b) maximum banner size shall not exceed twenty-four (24) square feet in area and six (6) feet in any one dimension. .0614 No Special Event Permit shall be issued to any person failing to obtain and present any land use permit required for the conduct of such business or activity by Title 18 of this Code, or who has failed to obtain and present any other regulatory permit or otherwise comply with any other provision of this Code having to do with the regulation of any trade, business or occupation. .0615 The City may revoke any Special Event Permit inadvertently issued in violation of this Section without liability to the City. .070 Violations. Violation of any of the provisions of this Section, or any subsection hereof, shall constitute a misdemeanor and shall be punishable as set forth in Section 1.01.370 of the Anaheim Municipal Code. 5 i .080 Zoning Administrator Review. .0801 The Zoning Administrator of the City of Anaheim shall have the power to review any action taken by the Planning Department in denying any application for a permit and shall have the power to revoke a permit granted by the Planning Department if the Zoning Administrator finds and determines such action is in the public interest, safety or general welfare. .0802 The Zoning Administrator shall also have the power to modify or waive any regulation contained in this section with regard to any specific application, if the Zoning Administrator finds and determines such modification or waiver would serve the public interest, safety or general welfare or that extraordinary circumstances are present. When the Zoning Administrator has acted upon any application for a Special Event Permit, all of the regulations set forth in this section shall apply unless some regulation set forth therein is expressly waived or modified and, in such event, the regulations shall apply as specified by the Zoning Administrator. .0803 Any action of the Zoning Administrator shall be taken in a public meeting, but no notice of public hearing shall be necessary before such action. The action of the Zoning Administrator shall be subject to the appeal procedures as set forth in Code Section 18.12.085." SECTION 4. That Section 18.05.070 of Chapter 18.05 of Title 18 of the Anaheim Municipal Code be, and same is hereby, amended to read as follows in its entirety: 1118.05.070 TEMPORARY SIGNS, FLAGS BANNERS AND BALLOONS -GENERAL. .010 Location. The temporary display of signs, flags, banners and/or fixed balloons, for commercial or advertising purposes, shall be permitted (a) in any commercial zone; (b) in the RS -A-43,000 zone, provided the property is adjacent to an arterial highway as indicated on the k Circulation Element of the General Plan; (c) in any zone in conjunction with any use for which a conditional use permit has been issued authorizing a use which is permitted as a matter of right in any commercial zone; and (d) at public or private elementary, junior high or senior high schools, churches or other religious institutions, located in any zone, in compliance with Section 18.02.055.0613; provided, however, that temporary signs, flags, banners and fixed balloons shall be displayed only after a Special Event Permit has been issued therefor by the Planning Department subject to all limitations of this Section and Section 18.02.055 'Special Event Permits - General' of this Code. .020 Public Construction Project. The Planning Director shall have the authority to issue a Special Event Permit for a commercial retail business in any zone where the applicant for such permit can demonstrate that a public road or utility construction project has had the effect of blocking visibility to permanent signage identifying the business and/or vehicular access to said business. Approval of the permit shall be subject to the following provisions: (a) the permit shall be limited to one (1) banner, not to exceed twenty-four (24) square feet in size; (b) the banner shall advertise only the name of the business and, if the public project has blocked vehicular access, directions for access to the business; and (c) the banner shall be removed upon removal of barriers blocking visibility and/or vehicular access. SECTION 5. That Section 18.05.074 of Chapter 18.05 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, deleted in its entirety. SECTION 6. That subsections .070 through .090 of Section 18.05.085 of Chapter 18.05 of Title 18 of the Anaheim Municipal Code be, and the same are hereby deleted in their entirety. 7 I SECTION 7. That Section 18.05.085 of Chapter 18.05 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended to read, in its entirety, as follows: 1118.05.085 TEMPORARY FLAGS AND BANNERS IN RESIDENTIAL ZONES. The temporary display of flags and banners shall be permitted in all residential zones; provided, however, a Special Events Permit for such flags and banners shall first have been issued by the Planning Department, subject to all limitations of Section 18.02.055 'Special Event Permits - General' and further subject to the following: .010 Location. The display of temporary flags and banners shall be limited to advertising for the sale of residential units in new subdivisions, new apartments and new condominium projects and all flags and banners shall be located within the physical boundaries of said subdivision or project and not placed in or over the public right-of-way. .020 Maximum Number Permitted. No more than two (2) flags or banners, or combination thereof, shall be permitted for each display model unit in any new residential subdivision, new apartment or new condominium project; provided, however, that not more than ten (10) total flags or banners, or combination thereof, shall be permitted or displayed for any such project or development. .030 Maximum Display Area. No flag or banner shall be in excess of twenty-four (24) square feet in area nor exceed six (6) feet in any one dimension. .040 Maximum Height. All flags and banners shall be mounted on ground -mounted poles not exceeding twenty (20) feet in height or, if attached to a building, shall not exceed the height of the highest portion of that building. Said flags and banners, however, shall not be placed on the roof. .060 Time Limit. All permits issued pursuant to this subsection shall 8 i terminate six (6) months after the date of issuance. A total of four (4) permits may be granted to advertise new residential tracts and new condominium complexes and a total of one (1) permit may be granted to advertise new apartment complexes unless an extension thereof is granted by the Zoning Administrator upon a showing of extraordinary circumstances applicable to said project, as authorized by Code subsections 18.02.055.0801 and .0802. All flags and banners shall be removed from the premises once all for -sale units have been sold, regardless of the time remaining on the permit." SECTION 8. That new Section 18.12.085 be, and the same is hereby, added to Chapter 18.12 of Title 18 of the Anaheim Municipal Code to read as follows: 1118.12.085 SPECIAL EVENT PERMIT - REVIEW .010 The Zoning Administrator, without public hearing and subject to the provisions of subsection 18.02.055.080 of this Code, may review any action taken by the Planning Department on an application for a Special Event Permit. .020 Petitions for review of an action taken on an application for a Special Event Permit shall be accompanied by the payment of a fee in an amount as set forth by resolution of the City Council for the purpose of defraying costs incidental to the petition. .030 The Zoning Administrator shall render a decision on the petition for review within fifteen (15) days following receipt by the Planning Department of a complete application for review. .040 Upon rendering a decision with respect to a petition for review of a special event permit decision, the Zoning Administrator shall notify the applicant and the City Clerk of such decision. .050 The decision of the Zoning Administrator shall be final in ten (10) E i days, unless appealed to the City Council by the applicant or any aggrieved person, or unless a request to review said decision is made by two (2) or more members of the City Council within such time period. .060 Appeals shall be made by filing a letter of appeal with the City Clerk accompanied by payment of an appeal fee in such amount as specified by resolution of the City Council. No appeal fee shall be required where two (2) or more members of the City Council request a review of a decision of the Zoning Administrator. Any member of the City Council may request a review of a decision of the Zoning Administrator concerning a special event permit by notifying the City Clerk of such a request." SECTION 9. That subsection .050 of Section 18.21.040 of Chapter 18.21 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended to read as follows: 11.050 Special Events and Temporary Signs, Flags, Banners and Balloons. The temporary use of premises for special events as defined in Section 18.01.200, shall be subject to compliance with the provisions of Sections 18.02.055 'Special Event Permits - General', 18.05.070 'Temporary Signs, Flags, Banners and Balloons - General' and 18.05.085 'Temporary Flags and Banners in Residential Zones' of this Code." SECTION 10. That subsection .040 of Section 18.21.067 of Chapter 18.21 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, deleted in its entirety. SECTION 11. That new subsection .030 of Section 18.22.040 be, and the same is hereby, added to Chapter 18.22 of Title 18 of the Anaheim Municipal Code to read as follows: 11.030 Special Events and Temporary Signs, Flags, Banners and Balloons. The temporary use of premises for special events as defined in Section 18.01.200, shall be 10 i subject to compliance with the provisions of Sections 18.02.055 'Special Event Permits - General', 18.05.070 'Temporary Signs, Flags, Banners and Balloons - General' and 18.05.085 'Temporary Flags and Banners in Residential Zones' of this Code." SECTION 12. That subsection .030 of Section 18.22.067 of Chapter 18.22 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended to read as follows: 11.030 Temporary 'For Sale', 'For Rent' or 'For Lease' Signs, in compliance with Section 18.05.080.020 'for sale, for rent or for lease signs.111 SECTION 13. That subsection .050 of Section 18.22.067 of Chapter 18.22 of Title 18 of the Anaheim Municipal Code be, and same is hereby, deleted in its entirety. SECTION 14. That new subsection .030 of Section 18.23.040 be, and the same is hereby, added to Chapter 18.23 of Title 18 of the Anaheim Municipal Code to read as follows: 11.030 Special Events and Temporary Signs, Flags, Banners and Balloons. The temporary use of premises for special events as defined in Section 18.01.200, shall be subject to compliance with the provisions of Sections 18.02.055 'Special Event Permits - General', 18.05.070 'Temporary Signs, Flags, Banners and Balloons - General' and 18.05.085 'Temporary Flags and Banners in Residential Zones' of this Code." SECTION 15. That subsection .030 of Section 18.23.067 of Chapter 18.23 of Title 18 of the Anaheim Municipal Code be, and the same is hereby amended to read as follows: 11.030 Temporary 'For Sale', 'For Rent' or 'For Lease' Signs, in compliance with subsection 18.05.080.020 'For Sale, For Rent or For Lease Signs."' 11 [7 SECTION 16. That subsection .050 of the Section 18.23.067 of Chapter 18.23 of Title 18 of the Anaheim Municipal Code be, and the same is hereby deleted in its entirety. SECTION 17. That new subsection .030 of Section 18.24.040 be, and the same is hereby, added to Chapter 18.24 of Title 18 of the Anaheim Municipal Code to read as follows: 11.030 Special Events and Temporary Signs, Flags, Banners and Balloons. The temporary use of premises for special events as defined in Section 18.01.200, shall be subject to compliance with the provisions of Sections 18.02.055 'Special Event Permits - General', 18.05.070 'Temporary Signs, Flags, Banners and Balloons - General' and 18.05.085 'Temporary Flags and Banners in Residential Zones' of this Code." SECTION 18. That subsection .030 of Section 18.24.067 of Chapter 18.24 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended to read as follows: 11.030 Temporary 'for sale', 'for' rent or 'for lease' signs, in compliance with Section 18.05.080.020 'For Sale, For Rent or For Lease Signs." SECTION 19. That subsection .050 of Section 18.24.067 of Chapter 18.24 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, deleted in its entirety. SECTION 20. That new subsection .030 of Section 18.25.040 be, and the same is hereby, added to Chapter 18.25 of Title 18 of the Anaheim Municipal Code to read as follows: 11.030 Special Events and Temporary Signs, Flags, Banners and Balloons. The temporary use of premises for special events as defined in Section 18.01.200, shall be subject to compliance with the provisions of Sections 18.02.055 'Special Event Permits - 12 I General', 18.05.070 'Temporary Banners and Balloons - General' 'Temporary Flags and Banners in Zones' of this Code." SECTION 21. Signs, Flags, and 18.05.085 Residential That subsection .030 of Section 18.25.067 of Chapter 18.25 of Title 18 of the Anaheim Municipal Code be, and the same is hereby amended, to read as follows: 11.030 Temporary 'For Sale', 'For Rent' or 'For Lease' Signs, in compliance with Section 18.05.080.020 'For Sale, For Rent or For Lease Signs."' SECTION 22. That new subsection .030 of Section 18.26.040 be, and the same is hereby, added to Chapter 18.26 of Title 18 of the Anaheim Municipal Code to read as follows: 11.030 Special Events and Temporary Signs, Flags, Banners and Balloons. The temporary use of premises for special events as defined in Section 18.01.200, shall be subject to compliance with the provisions of Sections 18.02.055 'Special Event Permits - General', 18.05.070 'Temporary Signs, Flags, Banners and Balloons - General' and 18.05.085 'Temporary Flags and Banners in Residential Zones' of this Code." SECTION 23. That subsection .030 of Section 18.26.067 of Chapter 18.26 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended to read as follows: 11.030 Temporary 'For Sale', 'For Rent' or 'For Lease' Signs, in compliance with Section 18.05.080.020 'For Sale, For Rent or For Lease Signs."' SECTION 24. That new subsection .030 of Section 18.27.040 be, and the same is hereby, added to Chapter 18.27 of Title 18 of the Anaheim Municipal Code to read as follows: 13 11.030 Special Events and Temporary Signs, Flags, Banners and Balloons. The temporary use of premises for special events as defined in Section 18.01.200, shall be subject to compliance with the provisions of Sections 18.02.055 'Special Event Permits - General', 18.05.070 'Temporary Signs, Flags, Banners and Balloons - General' and 18.05.085 'Temporary Flags and Banners in Residential Zones' of this Code." SECTION 25. That subsection .020 of Section 18.27.067 of Chapter 18.27 of Title 18 of the Anaheim Municipal Code be, and the same as hereby, amended to read as follows: 11.020 Temporary 'For Sale', 'For Rent' or 'For Lease' Signs, in compliance with Section 18.05.080.020 'For Sale, For Rent or For Lease Signs."' SECTION 26. That new subsection .030 of Section 18.31.040 be, and the same is hereby, added to Chapter 18.31 of Title 18 of the Anaheim Municipal Code to read as follows: 11.030 Special Events and Temporary Signs, Flags, Banners and Balloons. The temporary use of premises for special events as defined in Section 18.01.200, shall be subject to compliance with the provisions of Sections 18.02.055 'Special Event Permits - General', 18.05.070 'Temporary Signs, Flags, Banners and Balloons - General' and 18.05.085 'Temporary Flags and Banners in Residential Zones' of this Code." SECTION 27. That subsection .020 of Section 18.31.067 of Chapter 18.31 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended to read as follows: 11.020 Temporary 'For Sale', 'For Rent' or 'For Lease' Signs, in compliance with Section 18.05.080.020 'For Sale, For Rent or For Lease Signs."' 14 A SECTION 28. That subsection .040 of Section 18.31.067 of Chapter 18.31 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, deleted in its entirety. SECTION 29. That new subsection .030 of Section 18.32.040 be, and the same is hereby, added to Chapter 18.32 of Title 18 of the Anaheim Municipal Code to read as follows: 11.030 Special Events and Temporary Signs, Flags, Banners and Balloons. The temporary use of premises for special events as defined in Section 18.01.200, shall be subject to compliance with the provisions of Sections 18.02.055 'Special Event Permits - General', 18.05.070 'Temporary Signs, Flags, Banners and Balloons - General' and 18.05.085 'Temporary Flags and Banners in Residential Zones' of this Code." SECTION 30. That subsection .020 of Section 18.32.067 of Chapter 18.32 of Title 18 of the Anaheim Municipal Code be, and the same is hereby amended to read as follows: 11.020 Temporary 'For Sale', 'For Rent' or 'For Lease' Signs, in compliance with Section 18.05.080.020 'For Sale, For Rent or For Lease Signs."' SECTION 31. That subsection .040 of Section 18.32.067 of Chapter 18.32 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, deleted in its entirety. SECTION 32. That new subsection .030 of Section 18.34.040 be, and the same is hereby, added to Chapter 18.34 of Title 18 of the Anaheim Municipal Code to read as follows: 11.030 Special Events and Temporary Signs, Flags, Banners and Balloons. The temporary use of premises for special events as defined in Section 18.01.200, shall be subject to compliance with the provisions of Sections 18.02.055 'Special Event Permits - 15 A General', 18.05.070 'Temporary Banners and Balloons - General' 'Temporary Flags and Banners in Zones' of this Code." SECTION 33. Signs, Flags, and 18.05.085 Residential That subsection .020 of Section 18.34.067 of Chapter 18.34 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended to read as follows: 11.020 Temporary 'For Sale', 'For Rent' or 'For Lease' Signs, in compliance with Section 18.05.080.020 'For Sale, For Rent or For Lease Signs."' SECTION 34. That subsection .040 of Section 18.34.067 of Chapter 18.34 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, deleted in its entirety. SECTION 35. That subsection .050 of Section 18.41.040 of Chapter 18.41 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended to read as follows: 11.050 Special Events and Temporary Signs, Flags, Banners and Balloons. The temporary use of premises for special events as defined in Section 18.01.200 shall be subject to compliance with the provisions of Sections 18.02.055 'Special Event Permits - General' and 18.05.070 'Temporary Signs, Flags, Banners and Balloons - General' of this Code." SECTION 36. That subsection .040 of Section 18.41.067 of Chapter 18.41 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, deleted in its entirety. SECTION 37. That subsection .050 of Section 18.42.040 of Chapter 18.42 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended to read as follows: 16 11.050 Special Events and Temporary Signs, Flags, Banners and Balloons. The temporary use of premises for special events as defined in Section 18.01.200 shall be subject to compliance with the provisions of Sections 18.02.055 'Special Event Permits - General' and 18.05.070 'Temporary Signs, Flags, Banners and Balloons - General' of this Code." SECTION 38. That subsection .020 of Section 18.42.067 of Chapter 18.42 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended to read as follows: ".020 Temporary 'For Sale', 'For Rent' or 'For Lease' Signs, in compliance with Section 18.05.080.020 'For Sale, For Rent or For Lease Signs."' SECTION 39. That subsection .050 of Section 18.44.040 of Chapter 18.44 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended to read as follows: 11.050 Special Events and Temporary Signs, Flags, Banners and Balloons. The temporary use of premises for special events as defined in Section 18.01.200 shall be subject to compliance with the provisions of Sections 18.02.055 'Special Event Permits - General' and 18.05.070 'Temporary Signs, Flags, Banners and Balloons - General' of this Code." SECTION 40. That subsection .050 of Section 18.45.040 of Chapter 18.45 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended to read as follows: 11.050 Special Events and Temporary Signs, Flags, Banners and Balloons. The temporary use of premises for special events as defined in Section 18.01.200 shall be subject to compliance with the provisions of Sections 18.02.055 'Special Event Permits - General' and 18.05.070 'Temporary Signs, Flags, Banners and Balloons - General' of this Code." 17 i SECTION 41. That subsection .050 of Section 18.46.040 of Chapter 18.46 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended to read as follows: 11.050 Special Events and Temporary Signs, Flags, Banners and Balloons. The temporary use of premises for special events as defined in Section 18.01.200 shall be subject to compliance with the provisions of Sections 18.02.055 'Special Event Permits - General' and 18.05.070 'Temporary Signs, Flags, Banners and Balloons - General' of this Code." That subsection .020 of Section 18.48.040 of Chapter 18.48 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended to read as follows: 11.020 Special Events and Temporary Signs, Flags, Banners and Balloons. The temporary use of premises for special events as defined in Section 18.01.200, shall be subject to compliance with the provisions of Sections 18.02.055 'Special Event Permits - General' and 18.05.070 'Temporary Signs, Flags, Banners and Balloons - General' of this Code." SECTION 43. That Section 18.48.094 of Chapter 18.48 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, deleted in its entirety. SECTION 44. That subsection .050 of Section 18.61.040 of Chapter 18.61 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended to read as follows: 11.050 Special Events and Temporary Signs, Flags, Banners and Balloons. The temporary use of premises for special events as defined in Section 18.01.200 shall be subject to compliance with the provisions of Sections 18.02.055 'Special Event Permits - General' and 18.05.070 'Temporary Signs, 18 r Flags, Banners and Balloons - General' of this Code." SECTION 45. That subsection .050 of Section 18.63.040 of Chapter 18.63 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended to read as follows: 11.050 Special Events and Temporary Signs, Flags, Banners and Balloons. The temporary use of premises for special events as defined in Section 18.01.200 shall be subject to compliance with the provisions of Sections 18.02.055 'Special Event Permits - General' and 18.05.070 'Temporary Signs, Flags, Banners and Balloons - General' of this Code." SECTION 46. That subsection .010 of Section 18.88.040 of Chapter 18.88 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended to read as follows: 11.010 Special Events and Temporary Signs, Flags, Banners and Balloons. The temporary use of premises for special events as defined in Section 18.01.200 shall be subject to compliance with the provisions of Sections 18.02.055 'Special Event Permits - General' and 18.05.070 'Temporary Signs, Flags, Banners and Balloons - General' of this Code. SECTION 47. That new Section 18.88.065 be, and the same is hereby, added to Chapter 18.88 of Title 18 of the Anaheim Municipal Code to read as follows: "18.88.065 SIGN REGULATIONS - ADVERTISING AND IDENTIFICATION. Any signs or billboards installed or erected in this zone shall comply with the provisions of Chapter 18.05 'Outdoor Advertising - Signs and Billboards'." 19 SECTION 48. SEVERABILITY CLAUSE The City Council of the City of Anaheim hereby declares that should any section, paragraph, sentence or word of this ordinance of the Code, hereby adopted, be declared for any reason to be invalid, it is the intent of the Council that it would have passed all other portions of this ordinance independent of the elimination herefrom of any such portion as may be declared invalid. SECTION 49. SAVINGS CLAUSE Neither the adoption of this ordinance nor the repeal of any other ordinance of this City shall in any manner affect the prosecution for violations of ordinances, which violations were committed prior to the effective date hereof, nor be construed as a waiver of any license or penalty or the penal provisions applicable to any violation thereof. The provisions of this ordinance, insofar as they are substantially the same as ordinance provisions previously adopted by the City relating to the same subject matter, shall be construed as restatements and continuations, and not as new enactments. SECTION 50. PENALTY CLAUSE It shall be unlawful for any person, firm or corporation to violate any provision or to fail to comply with any of the requirements of this ordinance. Any person, firm or corporation violating any provision of this ordinance or failing to comply with any of its requirements shall be deemed guilty of a misdemeanor and upon conviction thereof shall be punished by a fine not exceeding One Thousand Dollars ($1,000.00) or by imprisonment not exceeding six (6) months, or by both such fine and imprisonment. Each such person, firm or corporation shall be deemed guilty of a separate offense for each day during any portion of which any violation of any of the provisions of this ordinance is committed, continued or permitted by such person, firm or corporation, and shall be punishable therefor as provided for in this ordinance.
