RES-2015-122 RESOLUTION NO. 2015-122 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM APPROVING AND DESIGNATING THE USE OF A PORTION OF LA PALMA PARK AND A PORTION OF OLIVE HILLS PARK AS DOG PARKS AND FINDING AND DETERMINING THAT SAID DESIGNATION IS CATEGORICALLY EXEMPT FROM THE REQUIREMENT FOR THE PREPARATION OF ENVIRONMENTAL DOCUMENTS UNDER THE CALIFORNIA ENVIRONMENTAL QUALITY ACT PURSUANT TO SECTION 15303 OF THE STATE CEQA GUIDELINES WHEREAS, pursuant to Ordinance No. 6314 adopted by the City Council (the "City Council") of the City of Anaheim (the "City") on February 3, 2015, the City Council enacted the "Dog Parks Ordinance" for the purpose of governing the use of public parks, or any portion of a public park, or any other City-owned land approved and designated exclusively for exercise and recreation for dogs; and WHEREAS, this City Council desires to approve and designate the following two Dog Parks (collectively, the "Proposed Project") for the exclusive purpose of exercise and recreation by and for dogs in accordance with the regulations and limitations applicable to the use of a Dog Park t�nder and pursuant to the Dog Parks Ordinance: A. The Olive Hills Dog Park, which consists of 1.2 acres (approximate) located on the westernmost portion of Olive Hills Park (Assessor's Parcel No. 361-381-02) bounded generally by Nohl Ranch Elementary School on the north, the Olive Hills Park Tennis Courts on the east, and the Olive Hills Reservoir on the south. The Olive Hills Dog Park is generally depicted on the conceptual landscape plan attached hereto as Exhibit A; and B. The La Palma Dog Park, which consists of 1.3 acres (approximate) located on the easternmost portion of La Palma Park (Assessor's Parcel No. 267-141-01) bounded by La Palma Avenue on the south, Anaheim Boulevard on the east, Glover Stadium on the west, and La Palma Way on the north. The La Palma Dog Park is generally depicted on the conceptual landscape plan attached hereto as Exhibit B. WHEREAS, pursuant to the California Environmental Quality Act {Public Resources Code Section 21000 et seq.; herein referred to as "CEQA") and the State of California Guidelines for Implementation of the California Environmental Quality Act (commencing with Section 15000 of Title 14 of the California Code of Regulations; herein referred to as the "State CEQA Guidelines"), the City is the "lead agency" for the preparation and consideration of environmental documents for the Proposed Project; and WHEREAS, the City Council finds and determines that the Proposed Project is categorically exempt from the requirement for the preparation of environmental documents under CEQA pursuant to Section 15303 of the State CEQA Guidelines because it is within that class of projects (i.e., Class 3- New Construction or Conversion of Small Structures) consisting of the construction and location of limited numbers of new, small facilities or structures, including fencing, benches, drinking fountains and the installation of landscaping in both Dog Parks and the addition of a restroom and additional parking spaces in the Olive Hills Dog Park. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ANAHEIM AS FOLLOWS: Section 1. The City Council hereby finds and determines that the recitals set forth above are true and correct. Section 2. The City Council hereby approves and designates the Olive Hills Dog Park and the La Palma Dog Park as depicted on the conceptual landscape plans attached hereto as Exhibit A and Exhibit B, respectively. Section 3. The precise location of the Olive Hills Dog Park and the La Palma Dog Park will correspond to the improvements actually constructed, provided that such improvements are generally within the area depicted on Exhibit A and Exhibits B, respectively, and not the depicted area itself. Section 4.
