5366ORDINANCE NO. 5366 AN ORDINANCE OF THE CITY OF ANAHEIM AMENDING SECTIONS 18.05.080, 18.21.064, 18.31.064, 18.32.064, 18.34.064, 18.21.067, 18.31.067, 18.32.067 AND 18.34.067, OF CHAPTERS 18.05, 18.21, 18.31, 18.32 AND 18.34 OF TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO SIGNAGE IN RESIDENTIAL ZONES. THE CITY COUNCIL OF THE CITY OF ANAHEIM HEREBY ORDAINS AS FOLLOWS: SECTION 1. That Section 18.05.080 of Chapter 18.05 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended to read as follows: "18.05.080 SIGNS PERMITTED IN RESIDENTIAL ZONES -GENERAL. "Except as otherwise provided in this chapter, no sign shall be erected, installed or maintained in any residential or agricultural zone except as permitted herein. ".010 Nameplate. One (1) lighted or unlighted nameplate of a maximum of two (2) square feet in area attached to and parallel with the exterior wall of the building, identifying the occupant of the premises. ".020 'For Sale,' For Rent' or 'For Lease' Signs. One unlighted sign of a maximum of ten (10) square feet in area, offering the premises for sale, rent or lease, or for inspection by the public. When frontage on more than one street exists, one such sign may be permitted on each such additional street frontage. Such signage may be placed on the building below the roof level or, if freestanding, shall not exceed six (6) feet in height as measured from the ground upon which the sign is placed, and not closer than seven (7) feet to any public right-of-way. 11.030 Identification Signs for Multiple - Family Zones and the RS -A-43,000 Zone. One (1) lighted or unlighted sign of a maximum of twenty (20) square feet in area, identifying any on-site use(s) permitted in the zone in which the property is located. When frontage on more than one street exists, one such sign may be permitted on each additional street frontage. Such signage may be placed on the building below the L roof level or, if freestanding, shall be monument type not exceeding four (4) feet in height as measured from the ground upon which the sign is constructed, and not closer than seven (7) feet to any public right-of-way. The maximum number of signs per street frontage may be increased to two (2), provided such signs are incorporated into entry monument walls placed on either side of a main driveway entrance." SECTION 2. That Subsection 18.21.064.100 is hereby added to Section 18.21.064 of Chapter 18.21 of Title 18 of the Anaheim Municipal Code to read as follows: 11.100 Signs in compliance with Section 18.21.067, 'Sign Regulations - Advertising and Identification. " SECTION 3. That Subsection 18.31.064.090 is hereby added to Section 18.31.064 of Chapter 18.31 of Title 18 of the Anaheim Municipal Code to read as follows: 11.090 Signs in compliance with Section 18.31.067, 'Sign Regulations - Advertising and Identification."' SECTION 4. That Subsection 18.32.064.090 is hereby added to Section 18.32.064 of Chapter 18.32 of Title 18 of the Anaheim Municipal Code to read as follows: 11.090 Signs in compliance with Section 18.32.067, 'Sign Regulations - Advertising and Identification."' SECTION 5. That Subsection 18.34.064.090 is hereby added to Section 18.34.064 of Chapter 18.34 of Title 18 of the Anaheim Municipal Code to read as follows: 11.090 Signs in compliance with Section 18.34.067, 'Sign Regulations - Advertising and Identification."' 2 SECTION 6. That Section 18.21.067 of Chapter 18.21 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended to read as follows: 1118.21.067 SIGN REGULATIONS- ADVERTISING AND IDENTIFICATION "The following signs as defined in Chapter 18.05, 'Outdoor Advertising - Signs and Billboards,' shall be permitted in this zone subject to the limitations and conditions prescribed therein: ".010 Nameplates, as provided in Section 18.05.080.010; 11.020 'For Sale,' 'For Rent' or 'For Lease' Signs, as provided in Section 18.05.080.020; 11.030 Identification Signs, as provided in Section 18.05.080.030; ".040 Temporary Flags and Banners, as provided in Section 18.05.085; ".050 Special Signs Required or Permitted by Law, including, but not limited to public utility signs, political campaign signs and guide signs not designed to be viewed from public streets. All such signs shall comply with the provisions of Section 18.05.060, 'Regulation of Special Types of Signs. 11.060 Billboards, Including Wall and Roof Billboards, subject to approval of a conditional use permit in compliance with the provisions of Sections 18.05.112 through 18.05.119, provided that no billboard shall be located within a radius of seventy-five (75) feet of any structure used primarily for residential purposes, and further subject to the following limitations and conditions: 11.061 Amortization of Billboards in the RS -A- 43,000 Zone. Any billboard constructed in an RS -A-43,000 zone subsequent to May 1, 1965, under authority of a conditional use permit or legally in existence in any RS -A- 43,000 zone on May 1, 1965, and which otherwise conforms to the zone location provisions of Section 18.05.111, shall have an amortization period applied to it by the Chief Building Official or his/her authorized representative. Such amortization period shall be established from the date said billboard was erected or constructed. The maximum period so established shall in no event exceed ten (10) 3 A years, except that in no case shall any such billboard be required to be removed prior to three ( 3 ) years from May 1, 1965. Such amortization period shall apply to said billboard regardless of subsequent development of structures used primarily for residential purposes within a radius of seventy-five (75) feet of such billboard; provided however, that if no residential structures are developed within the aforementioned radius of seventy-five (75) feet of such billboard at the expiration of the aforementioned and established amortization period, such billboard site may continue, but only until such residential structures may develop within seventy-five (75) feet of the billboard. 11.062 Amortization of Nonconforming Billboards. Any billboard legally in existence in any RS -A-43,000 zone on May 1, 1965, which does not conform to the zone location provisions of Section 18.05. 111 shall be governed as to amortization by Section 18.05.113, 'Nonconforming Billboards."' SECTION 7. That Section 18.31.067 of Chapter 18.31 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended to read as follows: 1118.31.067 SIGN REGULATIONS- ADVERTISING AND IDENTIFICATION "The following signs as defined in Chapter 18. 05, 'Outdoor Advertising - Signs and Billboards,' shall be permitted in this zone subject to the limitations and conditions prescribed therein: 11.010 Nameplates, as provided in Section 18.05.080.010; 11.020 'For Sale,' 'For Rent' or 'For Lease' Signs, as provided in Section 18.05.080.020; 11.030 Identification Signs, as provided in Section 18.05.080.030; ".040 Temporary Flags and Banners, as provided in Section 18.05.085; ".050 Special Signs Required or Permitted by Law, including, but not limited to public utility signs, political campaign signs and guide signs not designed to be viewed from public streets. That Section 18.34.067 of Chapter 18.34 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended to read as follows: 1118.34.067 SIGN REGULATIONS - ADVERTISING AND IDENTIFICATION "The following signs as defined in Chapter 18.05, 'Outdoor Advertising - Signs and Billboards,' shall be permitted in this zone subject to the limitations and conditions prescribed therein: ".010 Nameplates, as provided in Section 18.05.080.010; 11.020 'For Sale,' 'For Rent' or 'For Lease' Signs, as provided in Section 18.05.080.020; 5 A 11.030 Identification Signs, as provided in Section 18.05.080.030; ".040 Temporary Flags and Banners, as provided in Section 18.05.085; 11.050 Special Signs Required or Permitted by Law, including, but not limited to public utility signs, political campaign signs and guide signs not designed to be viewed from public streets. All such signs shall comply with the provisions of Section 18.05.060, 'Regulation of Special Types of Signs." SECTION 10. SEVERABILITY The City Council of the City of Anaheim hereby declares that should any section, paragraph, sentence or word of this ordinance of the Code, hereby adopted, be declared for any reason to be invalid, it is the intent of the Council that it would have passed all other portions of this ordinance independent of the elimination herefrom of any such portion as may be declared invalid. SECTION 11. SAVINGS CLAUSE Neither the adoption of this ordinance nor the repeal of any other ordinance of this City shall in any manner affect the prosecution for violations of ordinances, which violations were committed prior to the effective date hereof, nor be construed as a waiver of any license or penalty or the penal provisions applicable to any violation thereof. The provisions of this ordinance, insofar as they are substantially the same as ordinance provisions previously adopted by the City relating to the same subject matter, shall be construed as restatements and continuations, and not as new enactments.
