ORDINANCE NO. 5356
AN ORDINANCE OF THE CITY OF ANAHEIM
AMENDING AND DELETING CERTAIN
SUBSECTIONS IN VARIOUS SECTIONS OF
CHAPTERS 18.41, 18.44, 18.45 AND
18.46 OF TITLE 18 OF THE ANAHEIM
MUNICIPAL CODE RELATING TO
COMMERCIAL USE OF RESIDENTIAL
STRUCTURES.
THE CITY COUNCIL OF THE CITY OF ANAHEIM HEREBY ORDAINS
AS FOLLOWS:
SECTION 1.
That Subsection .030 of Section 18.41.015 of Chapter
18.41 of Title 18 of the Anaheim Municipal Code be, and the same
is hereby, deleted in its entirety.
SECTION 2.
That new Section 18.41.035 be, and the same is hereby,
added to Chapter 18.41 of Title 18 of the Anaheim Municipal Code
to read as follows:
"18.41.035 COMMERCIAL USE OF RESIDENTIAL
STRUCTURES -LIMITATIONS
Notwithstanding any other
provisions of this Chapter, the following
additional provisions shall apply to any
commercial use in any structure originally
designed or intended for residential
-- purposes:
.010 Structural Requirements. All
structures shall comply with all provisions
of Title 15 "Building and Housing Code" of
the Anaheim Municipal Code.
.020 Vehicle Parking. All parking
shall be provided to the rear of the
residential structure.
.030 Setback and Landscaping. The
required front setback of the residential
structure shall be maintained and landscaped
in accordance with the landscaping provisions
of this Chapter."

SECTION 3.
That Subsection .130 of Section 18.41.050 of Chapter
18.41 of Title 18 of the Anaheim Municipal Code be, and the same
is hereby, amended to read as follows:
11.130 Commercial uses of residential
structures, provided such uses are listed as
permitted or conditionally permitted within
this zone and subject to the requirements of
Section 18.41.035."
SECTION 4.
That Subsections .131 through and including .133 of
Section 18.41.050 of Chapter 18.41 of Title 18 of the Anaheim
Municipal Code be, and the same are hereby, deleted in their
entirety.
SECTION 5.
That Subsection .120 of Section 18.44.020 of Chapter
18.44 of Title 18 of the Anaheim Municipal Code be, and the same
is hereby, deleted in its entirety.
SECTION 6.
That Subsections .010 through and including .018 and
Subsections .021 and .022 of Section 18.44.035 of Chapter 18.44
of Title 18 of the Anaheim Municipal Code be, and the same are
hereby, deleted in their entirety.
SECTION 7.
That Subsection .020 of Section 18.44.035 of Chapter
18.44 of Title 18 of the Anaheim Municipal Code be, and the same
is hereby, amended to read as follows:
".020 Structural Requirements. All
structures shall comply with all provisions
of Title 15 "Building and Housing Code" of
the Anaheim Municipal Code.
SECTION 8.
That new Subsection .087 be, and the same is hereby
added to Section 18.44.050 of Chapter 18.44 Title 18 of the
Anaheim Municipal Code to read as follows:
11.087 Bed and Breakfast Inns subject to the
requirements of Section 18.04.130 of this
Code."

SECTION 9.
That Subsection .140 of Section 18.44.050 of Chapter
18.44 of Title 18 of the Anaheim Municipal Code be, and the same
is hereby, amended to read as follows:
11.140 Commercial uses of residential
structures, provided such uses are listed as
permitted or conditionally permitted within
this zone and subject to the requirements of
Section 18.44.035 of this Code."
SECTION 10.
That Subsection .130 of Section 18.45.020 of Chapter
18.45 of Title 18 of the Anaheim Municipal Code be, and the same
is hereby, deleted in their entirety.
SECTION 11.
That Section 18.45.035 (including all subsections
thereto) of Chapter 18.45 of Title 18 of the Anaheim Municipal
Code be, and the same is hereby deleted in its entirety.
SECTION 12.
That Subsection .140 of Section 18.45.050 of Chapter
18.45 of Title 18 of the Anaheim Municipal Code be, and the same
is hereby, deleted in its entirety.
SECTION 13.
That Section 18.46.035 (including all subsections
thereto) of Chapter 18.46 of Title 18 of the Anaheim Municipal
Code be, and the same is hereby, deleted in its entirety.
SECTION 14. SEVERABILITY
The City Council of the City of Anaheim hereby declares
that should any section, paragraph, sentence or word of this
ordinance of the Code, hereby adopted, be declared for any reason
to be invalid, it is the intent of the Council that it would have
passed all other portions of this ordinance independent of the
elimination herefrom of any such portion as may be declared
invalid.
SECTION 15. SAVINGS CLAUSE
Neither the adoption of this ordinance nor the repeal
of any other ordinance of this City shall in any manner affect
the prosecution for violations of ordinances, which violations
were committed prior to the effective date hereof, nor be

construed as a waiver of any license or penalty or the penal
provisions applicable to any violation thereof. The provisions
of this ordinance, insofar as they are substantially the same as
ordinance provisions previously adopted by the City relating to
the same subject matter, shall be construed as restatements and
continuations, and not as new enactments.
