A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM VACATING PUBLIC SERVICE EASEMENT
GF.NERALLY LOCATED AT 701 EAST CYPRESS STREET
PURSUANT TO CALIFORNIA STREETS AND HIGHWAY
CODE SECTION 8330, ET SEQ. - SUMMARY VACATION.

WI-IEREAS, an applicant has requested the vacation of an easement for sewer, water.
gas and pole lines located at 701 East Cypress, in the City of Anaheim, County of Orange, State oi�
California, as more particularly described below ("Public Service Easement"), in conjunction with
the Tentative Tract Map No. 17811 and Conditional Use Permit No. 2014-05753, in order to develop
38 single family homes known as "Cypress Street Homes;" and
W�IEREAS, easements for public utilities to serve the subject property will be
acquired in accord�nce with future development requirements; and
WI-IEREAS, the City of Anaheim acquired the Public Service Easement for public
purposes; and
W�-[EREAS, the Public Service Easement is not necessary for present or prospective
public purposes; a�1d
WHEREAS, the Public Service Easement to be vacated is considered excess right-of -
way and there are no other public facilities located within the Public Service Easement.
NQW, THEREFORE, BE IT RESOLVED that the City Council of the City ow�
Anaheim does herF,by order the vacation of the easement for sewer, water, gas and pole lines generai
located at 701 East Cypress Street, as reserved unto the City of Anaheim by resolution recorded
August 22, 1924 in Book 23, Page 310, Official Records of Orange County, California.
BE IT FURTHER RESOLVED that the City Council of the City of Anaheim hereby
makes this vacation pursuant to the requirements of the California Streets and Highways Code,
Division 9, Part 3, Chapter 4.
BE �T FURTHER RESOLVED that the vacation authorized by this Resolution shall
not be effective uniil a certified copy of this Resolution is recorded in the Office of the Recorder of
the County of Ora;ige, California.
BE IT FURTHER RESOLVED that the City Clerk be, and is hereby, authorized and
directed to cause a-certified copy of this Resolution to be recorded in the Office of the Recorder of
the County of Orange, California.

BE IT FURTHER RESOLVED that from and after the date the certified copy of this
Resolution is reco:ded in the Office of the Recorder of the County of Orange, the vacation shall be
complete and the Public Service Easement vacated shall no longer constitute public service
easement.
THE FOREGOING RESOLUTION is approved and adopted by the City Council of
the City of Anaheim this 17th day of March , 2015, by the following roll call vote:
