97-098RESOLUTION NO. 97R- 98 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AMENDING RESOLUTION NO. 92R -17 WHICH ESTABLISHED PERSONNEL RULES FOR CLASSIFICATIONS DESIGNATED AS MANAGEMENT, CONFIDENTIAL AND UNREPRESENTED PART -TIME WHEREAS, the Human Resources Director has recommended in a staff report dated June 10, 1997, that Resolution No. 92R -17 be amended in the manner hereinafter set forth effective June 27, 1997; and WHEREAS, as a result thereof, the need exists to amend Resolution No. 92R -17 which established Personnel Rules for classifications designated at Management, Confidential and Unrepresented Part-Time; and WHEREAS, the City Council of the City of Anaheim does find that amending Resolution No. 92R -17 is in the best interests of the City of Anaheim. NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Anaheim as follows: I. That, a new Section 4.21 be added to Personnel Rule 4, Appropriate Salary to read as follows, and the remaining Sections renumbered accordingly: "4.21 Part-time employees in job classes designated in the Resolution establishing rates for job classes by a "D" before schedule numbers shall be eligible for consideration for merit pay increases as follows: 4.211 To the "Q" step of the salary schedule after completion of 780 work hours in the "P" step. 4.212 To the "R" step of the salary schedule after completion of 780 work hours in the "Q" step. 4.213 To the "J" step of the salary schedule after completion of 780 work hours in the "R" step. 4.214 To the "A" step of the salary schedule after completion of 780 work hours in the "J" step. 4.215 To the `B" step of the salary schedule after completion of 780 work hours in the "A" step. 4.216 To the "C" step of the salary schedule after completion of 780 work hours in the "B" step. 4.217 To the "D" step of the salary schedule after completion of 780 work hours in the "C" step. 4.218 To the "E" step of the salary schedule after completion of 780 work hours in the "D" step. 2. That, Sections 10.01 and 10.02 of Personnel Rule 10, Suspension, Demotion and Dismissal, be amended to read as follows: "10.01 When, in the judgment of the appropriate Executive Manager, an employee in a Confidential, or non represented part-time classification designated as "Non- Exempt" whose work performance or conduct justifies disciplinary action short of demotion or dismissal, the employee may be suspended without pay or reduced in salary. Upon taking such action, the Executive Manager shall file with the employee and the Human Resources Director a written notification containing a statement of the substantial reasons for the action. No employee shall be suspended for more than thirty (30) calendar days at any one time. F_A1OMEVVKILMl1RVOT2009VK 3. That, a new Section 16.9 be added to Personnel Rule 16, Vacation, to read as follows, and the reaming Sections renumbered accordingly: AND, BE IT FURTHER RESOLVED that, except as amended herein, Resolution No. 94R -150 shall remain in full force and effect. THE FOREGOING RESOLUTION is approved and adopted by the City Council this 17 day of June 1997. ATTEST: 10.02 When, in the judgment of the appropriate Executive Manager an employee in a Confidential or Management classification designated as "Exempt" whose work performance or conduct justifies disciplinary action short of demotion or dismissal, the employee may be suspended without pay for a full work week or more (in full work week increments). In cases of violation of safety rules of major significance, an Exempt employee may be suspended without pay as determined appropriate by the Executive Manager. Upon taking such action, the Executive Manager shall file with the employee and the Human Resources Director a written notification containing a statement of the substantial reasons for the action. No employee shall be suspended for more than four complete work weeks at any one time." "16.9 Any employee in a classification designated as Management shall have the ability to be compensated for accrued vacation hours at any time throughout the year, subject to the following provisions: 16.91 The employee must have used forty (40) hours of vacation during the previous twelve months. BE IT FURTHER RESOLVED that the effective date of this Resolution shall be June 27, 1997.
