1848ORDINANCE NO. 1848 AN ORDINANCE OF THE CITY OF ANAHEIM AMENDING TITLE 3, CHAPTER 3.44 OF THE ANAHEIM MUNICIPAL CODE BY ADDING THERETO A NEW SECTION TO BE NUMBERED 3.44.030. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES FIND THAT: Finance Dir. License Acctg. Off. WHEREAS, it is in the best interests of the City of Anaheim to establish, and the City does so propose to establish, a convention hall auditorium to facilitate the advancement of cultural, commercial and industrial activities within the City; and WHEREAS, said convention hall auditorium facilities shall be primarily made available for use of visitors to the City of Anaheim; and WHEREAS, the City Council has determined that the burden from operations should be upon the commercial activity deriving its revenues primarily from temporary visitors to the City of Anaheim; and WHEREAS, it is proposed by the City Council of the City of Anaheim that the revenues obtained by said license fees hereinafter set forth shall be applied to the establishment and maintenance of the said convention hall auditorium; and WHEREAS, it is proposed that the provisions of this ordinance may be amended with the passage of time to meet only those financial requirements of the established purpose herein stated; and WHEREAS, it is proposed that the provisions of this ordinance may be amended to alter the amount of revenue herein derived as the need for such revenue may change through the development and maintenance of said convention hall auditorium; and WHEREAS, it is anticipated that the benefits derived by the individual visitor to the City of Anaheim from the establishment and operation of said convention hall auditorium shall far outweigh the burden placed by this ordinance upon said visitor; and WHEREAS, it is anticipated that increased visitor 10 traffic to the City of Anaheim shall result from the establish- ment of a convention hall auditorium; and WHEREAS, the benefits from said increase in traffic to the motel and hotel owners shall far outweigh the burden placed upon them by this ordinance; and WHEREAS, this ordinance shall provide and be adminis- tered in such a manner as to place its financial burden upon those who shall directly benefit from its purpose for assistance to only such extent as future needs demand. -1- NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: SECTION 1. That Title 3, Chapter 3 -441 -of the Anaheim Municipal Code be, and the same is hereby, amended by adding Section 3.44.030 to read as follows: "SECTION 3.44.030 -- MOTELS, HOTELS. "Every person conducting, managing, or carrying on the business of a motel or hotel shall pay a business license tax of --four per cent (4%) of the gross rental receipts from such hotel or motel operation. Such -business license tax shall be paid monthly. It shall be permissible to display such-tax.as a separate item in con- nection with the rental of hotel and motel accommodations and to -collect such tax as a separate item in the billing and collection for accommodations. "A motel, for the purposes of this section, is defined as: Any business which is identified or advertised as a motel, or, A group of attached or detached buildings containing individual sleeping or living units, used or intended, wholly or in part, for the accommodation of transients. "A hotel, for the purposes of this section, is defined as: Any business which is identified or advertised as a hotel, or, A building in which there are six or more guest rooms, used or intended, wholly or in part, for the accommodation of transients." SECTION 2. The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be printed once within fifteen (15) days after its adoption, in the Anaheim Bulletin, a newspaper of general circulation, printed, published and circulated in said City, and thirty (30) days from and after its final passage it shall take effect and be in full force.
