A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM ESTABLISHING FEES TO BE CHARGED FOR
CERTAIN SERVICES PROVIDED BY THE PROSECUTION
DIVISION OF THE CITY ATTORNEY'S OFFICE
WHEREAS, Section 1.01.380 of the Anaheim Municipal Code and the provisions of
state law authorize the City Council to establish fees and rates of charges for the reimbursement
of costs and expenses to the City of Anaheim City Attorney's Office pertaining to discovery
production costs in criminal prosecutions: and
WHEREAS, the Legislature of the State of California Government Code Sections
70627(a), and 68150(h) provide for the recovery of all or a portion of the actual costs associated
with reproduction requests; and
WHEREAS, Section 1.01.380 of the Anaheim Municipal Code provides for the
reimbursement of reasonable fees and costs incurred by the Prosecution Division as permitted
under Penal Code § 1203.4(d); and
WHEREAS, the costs and fees to be recovered do not exceed the reasonable costs to the
City of the services and products; and
WHEREAS, said fees and rates as hereinafter set forth have been considered at a duly
noticed public hearing as required by law.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim
that the fees for service described in this Resolution provided by the City Attorney's Office are
hereby established in accordance with the amounts set forth on Exhibit "A" attached hereto and
incorporated by reference herein.
BE IT FURTHER RESOLVED that the effective date of the fees established herein shall
be effective immediately upon adoption.
THE FOREGOING RESOLUTION is approved and adopted by the City Council of the
City of Anaheim this 16th day of June -5 2015, by the following roll call vote:
AYES: Mayor Tait and Council Members Kring, Murray, Brandman,
and Vanderbilt
