5074FOLLOWS: ORDINANCE NO. 5074 AN ORDINANCE OF THE CITY OF ANAHEIM AMENDING VARIOUS SECTIONS AND SUBSECTIONS OF CHAPTER 18.06 OF TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO VEHICLE PARKING AND LOADING REQUIREMENTS THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS SECTION 1. That subsection .020 of Section 18.06.020 of Chapter 18.06 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended to read as follows: ".020 Parking Structures. All parking facilities shall— esigne , improved and maintained in compliance with the provisions of Standard Plan No. 137 entitled 'Commercial Drive Approach,' Standard Plan No. 402 entitled 'Parking Structure Standard Detail,' Standard Plan Nos. 601 and 602 entitled 'Minimum Off -Street Parking Dimension,' and Standard Plan No. 604 entitled 'Parking Structure Design -Clear Span.'" SECTION 2. That subsection .010 of Section 18.06.030 of Chapter 18.06 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended to read as follows: 11.010 Adjacent to Residential Zones. A solid fence or wall sixfeet in height s a e provided adjacent to any nonresidential parking area that abuts any residentially zoned lot. Within the front portion of such parkin area, said fence or wall shall be reduced to thirty-six 36) inches in height to a depth equal to the required front yard depth of the adjoining residential property with the exception of Line of Sight Triangle, (see note 2), as shown on Standard Plan No. 137 entitled 'Commercial Drive Approach."' SECTION 3. That subsection .020 of Section 18.06.040 of Chapter 18.06 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended to read as follows: ".020 Minimum Dimensions of Parking Spaces. All parking spaces shall e esigne , improved an maintained in compliance with Standard Plan No. 436 entitled 'Handicapped Parking Standard,' Standard Plan Nos. 601 and 602 entitled 'Minimum Off -Street Parking Dimension,' and Standard Plan No. 604 entitled 'Parking Structure Design -Clear Span."' SECTION 4. That subsections .030, .031, .032 and .033 of Section 18.06.040 of Chapter 18.06 of Title 18 of the Anaheim Municipal Code be, and the same are hereby, repealed. SECTION S. That subsection .0124 of Section 18.06.050 of Chapter 18.06 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, repealed. SECTION 6. That subsection .0126 of Section 18.06.050 of Chapter 18.06 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended to read as follows: ".0126 Parking areas shall be screened by means of plant landscaping or architectural devices from adjacent streets and properties and from living or recreational -leisure areas to a height of 36 inches with the exception of 'Line of Sight Triangle' (see note 2), as shown on Standard Plan No. 137 entitled 'Commercial Drive Approach."' SECTION 7. That subsection .0131 of Section 18.06.050 of Chapter 18.06 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended to read as follows: "Retirement Dwelling: .0131 Senior citizens' apartment project: not less than four-fifths (0.8) of a parking space for each bachelor unit and one bedroom unit, and not less than one and three-fifths (1.6) parking spaces for each two bedroom unit. All parking spaces shall be located so as to minimize walking distances from the living area to the parking facility. Parking spaces may be covered or open and shall be unassigned and equally available to all residents, guests or employees." SECTION 8. That subsection .0212 of Section 18.06.050 of Chapter 18.06 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended to read as follows: ".0212 Professional and General Business Offices and Research and Development: Four (4.0) spaces per 1000 square feet of GFA for buildings of three stories or less; three (3.0) spaces per 1000 square feet of GFA for buildings of more than three stories." 103189 2 SECTION 9. That subsection .022 of Section 18.06.050 of Chapter 18.06 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended to read as follows: ".022 Retail Stores and Service Businesses - General: Five and one-half (5.5) spaces per 1000 square feet of GFA for the first 100,000 square feet of GFA; four and one-half (4.5) spaces per 1000 square feet of GFA over 100,000 square feet. SECTION 10. That subsections .0232 and .0233 of Section 18.06.050 of Chapter 18.06 of Title 18 of the Anaheim Municipal Code be, and the same are hereby, amended to read as follows: 11.0232 Restaurants - Enclosed with or without bar or entertainment facilities and not integrated in a planned development complex such as a shopping center, industrial complex, etc.: Fifteen (15.0) spaces per 1000 square feet of GFA. .0233 Restaurants - Walk up, Drive-in, Drive-through, Fast Food: Sixteen (16.0) spaces per 1000 square feet of GFA." SECTION 11. That new subsections .0234 and .0235 be, and the same are hereby added to Section 18.06.050 of Chapter 18.06 of Title 18 of the Anaheim Municipal Code to read as follows: 11.0234 Take out Restaurants - No seating inside or outside: Five and one-half (5.5) spaces per 1000 square feet of GFA. ".0235 Bars and Cocktail Lounges: Seventeen (17.0) spaces per 1000 square feet of GFA." SECTION 12. That subsection .0241 of Section 18.06.050 of Chapter 18.06 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended to read as follows: 11.0241 Hotel/Motel Facilities: For the purpose of this paragraph, no distinction is made between motel and hotel facilities. The following minimum number of parking spaces shall be provided: Four-fifths (0.8) of a space perguest room without kitchenettes; one and three-fifths (1.6) spaces per guest room with kitchenettes, plus 103189 3 a fourteen (14) spaces per 1,000 square feet of GFA of eating/drinking areas plus ten (10.0) spaces per 1,000 square feet of banquet/meeting room areas, plus the following employee spaces: One quarter (0.25) space per each employee working in guest room areas; four and three-fifths (4.6) employee spaces per 1,000 square feet of GFA for eating/drinking areas, one (1.0) employee space per 1,000 square feet of GFA for retail areas; two and one-half (2.S) employee spaces per 1,000 square feet of GFA for banquet/meeting rooms." SECTION 13. That subsections .0257, .0258 and .0259 of Section 18.06.050 of Chapter 18.06 of Title 18 of the Anaheim Municipal Code be, and the same are hereby, amended to read as follows: 11.0257 Racquetball Facilities: Five (5.0) spaces per court. .0258 Tennis Facilities: Five (5) spaces per court. .0259 Theaters: Live Performance: Four -tenths (0.4) space per seat plus eight -tenths (0.8) space per employee, including performers. Single Screen Motion Picture Theater: Six -tenths (0.6) space per seat plus five (S) employee spaces. Multi -Screen Motion Picture Theater: Three -tenths (0.3) space per seat plus six (6) employee spaces." SECTION 14. That subsection .0264 of Section 18.06.050 of Chapter 18.06 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended to read as follows: 11.0264 Auditoriums (other than school auditoriums), Convention Halls, Clubs, Lodges, and Other Places of General Assembly: One (1) space per each forty (40) square feet of seating or viewing area in the main assembly area, or one (1) space per each five (5) fixed seats, whichever results in the greater number of parking spaces, plus one (1) space per each employee." SECTION 15. That subsection .0266 of Section 18.06.050 of Chapter 18.06 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended to read as follows: 103189 4 A ".0266 Churches, Synagogues and Other Places of Religious Worship: Three -tenths space per fixed seat in the sanctuary and fourteen (14) spaces per 1000 square feet of GFA in places of instruction or main assembly without fixed seats." SECTION 16. That subsection .031 of Section 18.06.050 of Chapter 18.06 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended to read as follows: ".031 General Industrial and Warehousing Uses: Two and one-fourth (2.25) spaces per 1000 square feet of GFA plus one (1) truck loading space for each 25,000 square feet of GFA." SECTION 17. That subsection .010 of Section 18.06.060 of Chapter 18.06 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended to read as follows: 11.010 Required Number and Size of Loading Spaces. Every commercial or industrial site including t ose located contiguous to a public alley shall be provided with at least (1) off-street or off -alley loading space conforming to Standard Plan No. 605 entitled 'Truck Dock Standard,' per each twenty-five thousand (25,000) square feet of GFA or fraction thereof excluding residences located on such site." SECTION 18. SEVERABILITY The City Council of the City of Anaheim hereby declares that should any section, paragraph, sentence or word of this ordinance of the Code, hereby adopted, be declared for any reason to be invalid, it is the intent of the Council that it would have passed all other portions of this ordinance independent of the elimination herefrom of any such portion as may be declared invalid. SECTION 19. SAVINGS CLAUSE Neither the adoption of this ordinance nor the repeal of any other ordinance of this City shall in any manner affect the prosecution for violations of ordinances, which violations were committed prior to the effective date hereof, nor be construed as a waiver of any license or penalty or the penal provisions applicable to any violation thereof. The provisions of this ordinance, insofar as they are substantially the same as ordinance provisions previously adopted by the City relating to the same subject matter, shall be construed as restatements and continuations, and not as new enactments. 103189 5 THE FOREGOING ORDINANCE is approved and adopted by the City Council of the City of Anaheim this 14th day of November, 1989.
