At 3:32 P.M., due to lack of a quorum, the May 19, 2015 workshop on the Affordable Health
Care Act was cancelled and the City Council meeting adjourned to 4:00 P.M.
The regular adjourned meeting of May 19, 2015 was then called to order at 4:08 P.M. in the
chambers of Anaheim City Hall located at 200 S. Anaheim Boulevard. The meeting notice,
agenda and related materials were duly posted on May 15, 2015.

unanimously appointed.

PRESENTATIONS: Recognizing the 2014 Mills Act Recipients
Sandra Sagert, representing Anaheim Beautiful, explained there were four historic districts in
the city (Anaheim Colony, 5 -Points, Palm District and Hoskins) with almost 1,500 properties
designated as contributors to the districts or as citywide historical resources. To encourage
preservation, the City Council adopted a local Mills Act and under this program owners of
historic properties throughout the city could restore their historic structures in exchange for
potential property tax reduction. For 2014, 23 historic homes and their property owners were
formally recognized by council.
Recognizing Anaheim Lions Club Youth of the Year finalists and winners
Rod Wallace remarked he had chaired the Youth of the Year Award selection project since its
inception in 1981, an effort that recognized youth community service commitment by awarding
$500 scholarships to two runner-ups and $1,000 to the Youth of the Year finalist. Elaina Trujillo
and Alexis Cardenas were presented as the first and second runners-up and Christopher
Limbaugh as the Lions Club Youth of the Year.
Recognizing May 17 — 23, 2015, as National Public Works Week
Ronald Calkins, Director of APWA Region VIII, remarked that each year the top ten Public
Works leaders were selected from across the USA and Canada to recognize individuals who
personified excellence in serving the public interest. He acknowledged Anaheim's Natalie
Meeks as one of those ten leaders for her vision, advocacy and accomplishments as Anaheim's
Public Works Director.
ACCEPTANCE OF OTHER RECOGNITIONS (To be presented at a later date):
Proclaiming May 2015, as Lupus Awareness Month
Dana Waldrup, Lupus Foundation of America, expressed appreciation to the city for making the
community aware of this disease affecting 1.5 million nationwide. She emphasized that for the
last 50 years only one drug has been approved for the treatment of Lupus and fundraising
efforts for research is vital for this foundation.
Proclaiming May 18 — 24, 2015, as National Prevention Week
Rhonda Foley, OC Substance Abuse Prevention Network, remarked OCSAPN had been in
existence since 1979, a completely volunteer effort addressing issues that placed youth,
families and communities at risk. By collaborating with other agencies and combining strengths,
OCSAPN was able to be more effective in addressing issues.

Proclaiming May 2015, as Military Appreciation Month
Lieutenant Colonel Nathan Range, Deputy Base Commander of the Joint Forces Training Base,
spoke of the importance of moral support and the grateful appreciation of citizens toward
military personnel and families. He remarked that over the last 12-15 years, California Army
Guard soldiers and airmen had been deployed overseas, young men and women from Anaheim
and other neighboring communities that should be recognized for their roles in today's military.
Proclaiming May 22, 2015, as Harvey Milk Day
Tony Ortuno, LBGT Orange County, thanked Anaheim for issuing this proclamation, as it
recognized Anaheim as a safe space for LBGT members to live and thrive. Laura Kantor,
Director of Policy Advocacy and Stephanie Van Dyke, Youth Program Coordinator offered their
comments of support as well.
Proclaiming June 15 — 21, 2015, as Men's Health Week
Proclaiming June 2015, as National Great Outdoors Month
Kevin Sims, Oak Canyon Nature Center, called attention to Anaheim's 55 parks, as part of June
being Great Outdoors Month. He emphasized residents could take advantage of variety of
features in park locations — playgrounds, athletic fields, tennis courts, open play areas, picnic
shelters and Anaheim's first dog park. In addition, the Oak Canyon Nature Center in Anaheim
Hills offered a 58 acre natural park with three adjoining canyons with four miles of hiking trails
and native wildlife. He encouraged the community to make the most of these facilities in June.
Proclaiming May 25, 2015, as Memorial Day
Gary Mason, VFW, introduced Paul Dyce, Commander of the American Legion, Lou Jordan,
Quartermaster and Adjutant and his son, Todd Mason, Son of the American Legion. He
accepted the proclamation honoring our nation's fallen and encouraged the community to attend
the May 25th memorial event at the Anaheim Cemetery recognizing and honoring all veterans.
ADDITIONS/DELETIONS TO THE AGENDA: Agenda Item No. 40 was a public hearing
related to the acquisition of property regarding Brookhurst Street Widening project and required
a 2/3 vote of all members of Council; therefore, staff requested it be continued to the June 2,
2015 meeting when all Council Members were present.
PUBLIC COMMENTS (all agenda items, except public hearing): Prior to receipt of public
comments, a brief decorum statement was provided by Assistant City Clerk, Theresa Bass.
Carol Latham thanked staff and the Council for their support of the WAND annual barbecue,
remarking she had coordinated this event for the past five years and appreciated the city's
continued support for the west Anaheim community. She also announced the "Open Book
Author" series scheduled at the Muzeo this Thursday.
William Fitzgerald, Anaheim HOME, offered a correction to remarks he had made at the
previous council meeting and also voiced his strong opposition to the Mills Act Recipients as
well as the Mills Act legislation.

R. Joshua Collins urged the City Council to create safe sleeping places as soon as possible for
the homeless, adding that waiting for the construction of a homeless shelter was not the
answer.
Lou Noble spoke of an assault that recently occurred by those that preyed on the homeless
stressing the need for safe zones. Ms. Murray remarked she appreciated Mr. Noble was
working with CityNet on this issue adding that Council was committed to serving the homeless
in Anaheim.
John Dunton remarked the California Crisis Intervention Group was recently created to provide
support and assistance when emergencies or community crisis occurred. He encouraged
members of the community to volunteer and participate in serving the families of those in
distress.
Mark Lopez, on behalf of the Sister City Commission, presented Council with an update on the
organization and the events it sponsored. A student exchange was scheduled from July 24'" to
August 2"d, facilitating interaction between Mito, Japan students and Anaheim residents to foster
community and international friendships. The Sister City Commission was seeking families
interested in hosting some of those students.
Dan DeMeyere, resident, requested staff reconsider relocating the bus stop at Crestwood/
Brookhurst Street, which in his opinion was an unsafe location. He suggested placing a 10 inch
pad of concrete behind the existing bus stop pad which would move the bus stop 20 feet back
from its current location and solve that safety concern.
Ron Bengochea, resident, requested staff's assistance in providing his input on districting maps
as his computer skills were not up to the task to do it on line. Regarding the permit parking
items on the agenda, he requested Council ensure there was available parking at La Palma
Park for the community who participated in various events occurring on that site.
Victoria Michaels, resident, urged the Council to be respectful of each other while a Council
Member held the floor during discussions. Ms. Murray responded the Council worked
respectfully together and if there was a dialogue between members at the dais on occasion, it
was done for the purpose of advancing policies.
Mark Daniels, resident, suggested Glover Stadium or Handel Stadium on the Western High
School campus be used for homeless outreach activities until a shelter was constructed and
operating.

CITY MANAGER'S UPDATE: Paul Emery, Interim City Manager, announced the upcoming
Advisory Committee on Electoral Districts meeting scheduled for May 27, 2015 at 6:30 in the
Council Chambers. Opportunities for public comment and input would be provided.
CONSENT CALENDAR: At 6:08 P.M., Council Member Vanderbilt removed Agenda Item Nos.
15, 22, 23 and 24 for further discussion. Council Member Brandman then moved to waive
reading in full of all ordinance and resolutions and to adopt the balance of the consent calendar
as presented, in accordance with reports, certifications and recommendations furnished each
Council Member as listed on the consent calendar, seconded by Council Member Vanderbilt.

month lease and maintenance of 92 golf vehicles for the Anaheim Hills Golf Course and
a 48 -month lease and maintenance of 75 golf vehicles for the Dad Miller Golf Course,
AGR -8878 and approve the required lease documents with Agricredit Acceptance, LLC, for the
leases of the golf carts, in accordance with Bid #8410.
P124 16. Approve the Quitclaim and Termination of Permit for Pedestrian Tunnel with La
Palma/Miller Phase I, LLC and authorize the City Clerk to cause the document to be

17. Approve and authorize the City Manager to execute an agreement with MIG, in an
amount not to exceed $247,120, for the planning, schematic design, preparation of

18. Approve and authorize the Public Utilities General Manager, or designee, to execute
and take the necessary actions to implement and administer the Anaheim Water
AGR -7642A Recycling Demonstration Facility Operations and Maintenance Agreement, and related
documents and renewal option(s), with Integrated Performance Consultants, Inc., in the
amount of $226,236 plus a fifteen percent contingency for emergency and extra
services, for contract operations and maintenance services for the Water Recycling
Demonstration Facility for a one-year period with four optional one-year renewal periods

AGR -8883 19. Approve a Subgrant Agreement with Community Action Partnership of Orange County
for the improvements to Edison Park, authorize the Community Services Director, or his
designee, to act as the agent of the City on all matters concerning this grant program

END OF CONSENT CALENDAR:
AGR -8880 15. Accept the proposals and execute Agreements with Marina Landscape, Inc. and
AGR -8881 ValleyCrest Landscape Maintenance, in the annual amounts of $970,908 and
$1,252,864 respectively, for landscape maintenance services for the City's parks for a
two year period with up to five one-year optional renewals and authorize the Purchasing
Agent to exercise the renewal options, in accordance with Request for Proposal #8456.
Carol Ayuso, Purchasing Agent, explained this item reflected an agreement for park landscape
maintenance services for a two-year term with options to renew for up to five one-year periods
and included parks, sports fields and other designated recreation areas, a total of about 450
acres in size. She noted these would be full-service contracts providing the following: turf
mowing, edging, plant maintenance, refuse and litter removal, fertilization, playground
maintenance, ball field maintenance and preparation of the sports fields, irrigation repairs, pest
and weed control, mulch replacement, and trimming of park trees up to 15 feet in height.
This March, she indicated, the City issued an RFP for these services and in order to mitigate the
risk of having only one contractor covering all parks, it was understood that the contract would
be awarded to two or possibly three contractors. Proposals were received from seven
companies and based on an evaluation team comprised of Community Services/Finance
Department as well as park maintenance staff from two other cities, the decision was to
recommend awarding contracts to ValleyCrest Landscape and Marina Landscape as the most
qualified and best cost alternatives.
Council Member Vanderbilt remarked he had heard concerns about the cleanliness of parks in
general and wondered if there had been any areas within the previous contract that staff
recognized as needing improvement and which had been addressed in the proposed
agreements. Ms. Ayuso responded there were explicit specifications, performance expectations
and methods to get contractors to perform as desired. Larry Pasco, Parks Manager, added
that penalties for non-performance were included in the contract; that stipulation had been
included in the previous contract as well. He added that because of the heavy use of some of
the city's parks, quality control was occasionally out of control of the contractor. Specifically, he
explained, complaints had been received regarding the sports fields, however, he pointed out
the heavy use of those facilities contributed to some of those maintenance complaints. Director
Terry Lowe added that the contractors the City used to this present bid too low and therefore did
not have enough work hours included in their bids to provide the level of service Anaheim had
enjoyed for some time with its own staff. However, he believed ValleyCrest and Marina
Landscape contractors both provided an adequate number of working hours to address this
concern, adding that quality control had been one of his concerns since moving to privatization.
Council Member Brandman moved to approved Item No. 15, seconded by Council Member
Vanderbilt.
Discussion: Council Member Murray remarked Mr. Vanderbilt's concerns had been hers as well
and she hoped there would be some improvements in the type and amount of debris found at
many of the city parks. She suggested that it might be helpful to look at supplementing
contractors with city personnel, even at an increased cost, individuals who would have a

personal connection to the parks. Mr. Lowe advised that staff was currently discussing options
with the Finance Department for such recommendation.

Item Nos. 22, 23 and 24 would be considered collectively. Council Member Vanderbilt
remarked he had concerns about the parking permit process which he had discussed at
previous council meetings and looked forward to staff presenting other options to address
parking issues other than permit parking. He would be supportive of these three items at this
point in time, but looked forward to other solutions that would allow residents to reclaim their
neighbor and not limit parking to all.

REPORT ON CLOSED SESSION ACTIONS:
Michael Houston, City Attorney, reported the City Council authorized the City Attorney to initiate
litigation in relation to Closed Session Item No. 1 (Vote: 3-0; Ayes: Council Members Murray,
Brandman and Vanderbilt; Absent: Mayor Tait and Mayor Pro Tem Kring).
COUNCIL COMMUNICATIONS:
Council Member Vanderbilt spoke to the project on Kraemer Boulevard to address
homelessness and his efforts to engage other north Orange County cities relative to funding,
and having broached the subject with Supervisor Spitzer and elected officials from Brea,
Fullerton and Yorba Linda recently. He hoped that in the coming weeks, those conversations
would continue.
Council Member Brandman announced the 9th Annual Health Fair scheduled for May 29-31 at
the Convention Center offering free medical, dental and vision services, including physical
exams, blood testing, eye exams, and free eyeglasses. He pointed out that free parking would
also be offered at Car Park 4 for health fair attendees. Mr. Brandman encouraged the
community to attend the annual Memorial service on Sunday, Memorial Day, at the Anaheim
Cemetery, a tribute to our nation's fallen.
Council Member Murray spoke of her attendance at the Girls in Engineering Day at Dale Junior
High, hosting over 120 young women interested in the engineering field and finding out how
their interest in STEM could result in a long-term career. She reported the Anaheim Resort
Transit announced expanded service from ARTIC to South Coast Plaza and the Segerstrom
Center and recognized the volunteers and committee for their hard work in raising funding for
the two K-9 Monuments. She thanked the Friends of the Anaheim Police K-9 Association who
made the last $5,000 donation that would allow moving forward with the first installation at the
new La Palma Park Dog Park. Council Member Murray encouraged the community to attend the
annual Memorial service on Sunday, Memorial Day, at the Anaheim Cemetery and wished the

Anaheim Ducks good luck. She also requested this meeting be adjourned in memory of Barbara
Murray, mother of Julie Tait and mother-in-law of Mayor Tom Tait.
