5030ORDINANCE NO. 5030 AN ORDINANCE OF THE CITY OF ANAHEIM AMENDING THE ZONING MAP REFERRED TO IN THE TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES FIND THAT: WHEREAS, the Planning Commission did adopt its Resolution No. PC88-237 determining that a change or changes in the zone or zones hereinafter mentioned and described should be made as hereinafter set forth after a duly noticed hearing; and WHEREAS, certain conditions and requirements were made as conditions precedent to the making of a change of a change or changes of said zone or zones, which conditions have been complied with. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: SECTION 1. That the Zoning Map referred to in the Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended by rezoning and reclassifying that certain property situated in the City of Anaheim, County of Orange, State of California, described as follows, to wit: LOT 19A, OF TRACT 255, IN THE CITY OF ANAHEIM, AS PER MAP RECORDED IN BOOK 14, PAGES 25 OF MISCELLANEOUS MAPS, IN THE OFFICE OF COUNTY RECORDER OF ORANGE COUNTY. LOT 18 OF TRACT NO. 255, EAST ANAHEIM SUBDIVISION, CITY OF ANAHEIM, COUNTY OF ORANGE, STATE OF CALIFORNIA, AS PER MAP RECORDED IN BOOK 14, PAGE 25 OF MISCELLANEOUS MAPS, RECORDS OF SAID ORANGE COUNTY. PARCEL 1: LOT 19 OF TRACT NO. 255, IN THE EAST ANAHEIM SUBDIVISION IN THE CITY OF ANAHEIM, COUNTY OF ORANGE, STATE OF CALIFORNIA, AS PER MAP RECORDED IN BOOK 14, PAGE 25, MISCELLANEOUS MAPS, IN THE OFFICE OF THE COUNTY RECORDER OF SAID COUNTY. into the "RM -3000" Residential, Multiple -Family ZONE, subject to the following conditions: RECLASS 88-89-10 1. That a modified cul-de-sac shall be provided at the terminus of Cypress Street as required by the City Engineer. That security in the form of a bond, certificate of deposit, letter of credit, or cash, in an amount and form satisfactory to the City of Anaheim, shall be posted with the City to guarantee the satisfactory completion of said improvements. Said security shall be posted with the City prior to introduction of an ordinance rezoning subject property, to guarantee the installation of the above -required improvements prior to occupancy. 2. That a bond or other security acceptable to the City of Anaheim shall be posted to guarantee that an 8 -foot high block wall shall be constructed and maintained along the adjacent single-family residential lines, unless written approval is obtained from affected property owners for less than an 8 -foot height. Said bond is to guarantee construction of subject wall prior to issuance of a building permit. 3. That provisions for maintenance of the 8 -foot high or lower (6 -foot minimum) block wall discussed in Condition No. 3, herein, along the north, east, south, and west property lines shall be included in the conditions, covenants, and restrictions which will be required in connection with approval of the tentative tract map for subject condominium proposal. SECTION 2. The City Zoning Map shall be, and the same is hereby, amended and the property above-described shall be excluded from the zone in which it is now situated and incorporated in and made a part of the zone or zones as above set forth, and said City Zoning Map, as amended, is hereby adopted and the Planning Department is hereby directed to prepare a sectional zoning map to be added to the City Zoning Map showing the changes hereby approved and adopted. SECTION 3.
