5031ORDINANCE NO. 5031 AN ORDINANCE OF THE CITY OF ANAHEIM AMENDING SUBSECTION .070 OF SECTION 18.70.060 OF CHAPTER 18.70 OF TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING (SP87-1). WHEREAS, pursuant to the procedures set forth in Chapter 18.93 of the Anaheim Municipal Code, the City Council of the City of Anaheim has heretofore adopted its Resolution No. 87R-253 approving Specific Plan No. 87-1 and the zoning and development standards relating thereto; and WHEREAS, the City Council has heretofore adopted Ordinance No. 4860 adding Chapter 18.70 to the Anaheim Municipal Code establishing zoning and development standards for the SP87-1 Zone; and WHEREAS, the City Council has heretofore adopted its Resolution No. 89R-184 amending Resolution No. 87R-253 and making certain findings in conjunction therewith pursuant to Chapter 18.93 of the Anaheim Municipal Code; and WHEREAS, the City Council desires to amend Section 18.70.060 of the Anaheim Municipal Code in the manner hereinafter set forth. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: SECTION 1. That subsection .070 of Section 18.70.060 of Chapter 18.70 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended by adding new paragraph (b) thereto, to read as follows: "(b) Required Parking Spaces. All covered parking spaces shall be located within 100 feet of, and be readily accessible to, the dwelling unit to be served; provided, however, that 350 of the required covered spaces may be located between 101 to 150 feet from the dwelling unit served, and 16% of the required covered spaces may be located between 151 to 220 feet from the dwelling unit served; and further provided that only one covered parking space per unit shall exceed the 100 -foot distance, and that any covered parking space exceeding said 100 -foot distance shall be located in a carport. Required open spaces shall be located within 200 feet of the unit served." AMDG SBSCTN .070 SP87-1 SECTION 2. SAVINGS CLAUSE Neither the adoption of this ordinance nor the repeal of any other ordinance of this City shall in any manner affect the prosecution for violations of ordinances, which violations were committed prior to the effective date hereof, nor be construed as a waiver of any license or penalty or the penal provisions applicable to any violation thereof. The provisions of this ordinance, insofar as they are substantially the same as ordinance provisions previously adopted by the City relating to the same subject matter, shall be construed as restatements and continuations, and not as new enactments. SECTION 3. SEVERABILITY The City Council of the City of Anaheim hereby declares that should any section, paragraph, sentence or word of this ordinance of the Code, hereby adopted, be declared for any reason to be invalid, it is the intent of the Council that it would have passed all other portions of this ordinance independent of the elimination herefrom of any such portion as may be declared invalid.
