5037FOLLOWS: ORDINANCE NO. 5037 AN ORDINANCE OF THE CITY OF ANAHEIM AMENDING VARIOUS SECTIONS OF VARIOUS CHAPTERS OF TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS SECTION 1. That Section 18.21.062 of Chapter 18.21 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended in its entirety to read as follows: "18.21.062 STRUCTURAL HEIGHT AND AREA LIMITATIONS. .010 Maximum Structural Height. The maximum height of any one -family dwelling, accessory living uarters or garage shall not exceed two stories or thirty ?30) feet, whichever is less, except as permitted pursuant to Section 18.04.030 of this Code. .020 Height Exceptions. .0201 The maximum height of any building other than those specified in subsection .010 above, including any structure incidental to uses permitted in this chapter, shall not exceed the equivalent of one-half the distance of said building or structure from the boundary of any residential zone; provided, however, no such building or structure shall exceed the maximum height specified in subsection .010 above. .0202 Notwithstanding subsection .010 above, any dwelling or structure located in the Scenic Corridor Overlay (SC) Zone shall not exceed twenty-five (25) feet except as otherwise set forth in Section 18.84.042 of this Code. .030 Minimum Floor Area Per Dwellin The minimum livable floor area of any one- ami y dwelling shall be not less than twelve hundred twenty-five (1225) square feet exclusive of any garage area." SECTION 2. That Section 18.22.062 of Chapter 18.62 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended in its entirety to read as follows: "18.22.062 STRUCTURAL HEIGHT AND AREA LIMITATIONS. .010 Maximum Structural Hei ht. The maximum height of any one -family welling or other structure shall not exceed twenty-five (25) feet. .020 Height Exceptions. .0201 Notwithstanding subsection .010 above, any dwelling or structure located in the Scenic Corridor Overlay (SC) Zone shall comply with Section 18.84.042 of this Code. .030 Minimum Floor Area Per Dwelling. The minimum livable floor area of any one -family dwelling shall be not less than twelve hundred twenty-five (1225) square feet exclusive of any garage area." SECTION 3. That Section 18.23.062 of Chapter 18.23 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended in its entirety to read as follows: "18.23.062 STRUCTURAL HEIGHT AND AREA LIMITATIONS. .010 Maximum Structural Height. SECTION 4. That Section 18.24.062 of Chapter 18.24 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended in its entirety to read as follows: "18.24.062 STRUCTURAL HEIGHT AND AREA LIMITATIONS. .010 Maximum Structural Height. The maximum height of any one -family dwelling or other structure shall not exceed twenty-five (25) feet. 051789 2 .020 Height Exceptions. Notwithstanding subsection .010 above, the following additional height limitations shall apply: .0201 Any dwelling or other structure located in the Scenic Corridor Overlay (SC) Zone shall comply with Section 18.84.042 of this Code. .0202 Pursuant to the conditions of approval of Tract No. 8418 and 8647, a one (1) story height overlay zone is hereby established and imposed upon those certain lots abutting the area known as 'Peralta Hills' and located on the north side of Valley Gate Drive, the east side of Sleepy Meadow Lane north of Forest Glen Road, and the north side of Forest Glen Road and Old Bucket Lane between Sleepy Meadow Lane and Nohl Ranch Road, and further described as Lot Nos. 24 through 46, inclusive, of Tract No. 8647 and Lot Nos. 65 through 79, inclusive, of Tract No. 8418. Notwithstanding any other provision of this Code, the maximum structural height on said lots shall not exceed one-story or twenty-five (25) feet, whichever is less, except as permitted pursuant to Section 18.84.042 of this Code. The term "one-story" as used in this subsection shall mean a single habitable floor and shall not permit any loft, mezzanine, balcony or similar habitable floor or area above such single habitable floor. .030 Minimum Floor Area Per Dwelling. The minimum livable floor area of any one -family dwelling shall be not less than twelve hundred twenty-five (1225) square feet exclusive of any garage area. .040 Maximum Lot Coverage. Coverage of a lot by all structures shall not exceed forty percent (400) of the lot area; provided, however, that swimming pools and semi -enclosed patio structures shall not be considered as structures in ascertaining coverage." SECTION 5. That Section 18.26.062 of Chapter 18.26 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended in its entirety to read as follows: "18.26.062 STRUCTURAL HEIGHT AND AREA LIMITATIONS. .010 The maximum height of any one -family dwelling or other structure shall not exceed two and one-half (2 1/2) stories or thirty-five (35) feet, whichever is less, except as permitted pursuant to Section 18.04.030 of this Code. 051789 .020 Height Exceptions. Notwithstanding subsection .010 above, the following additional height limitations shall apply: .0201 Any dwelling or other structure located in the Scenic Corridor Overlay (SC) Zone shall comply with Section 18.84.042 of this Code. .0202 Public or semi-public buildings, schools, hospitals or institutions may be erected to a height not to exceed four (4) stories or forty-five (45) feet, whichever is less, provided all required yards are increased at least one (1) additional foot for each four (4) feet in height such buildings exceed thirty-five (35) feet. .030 Maximum Lot Coverage. Coverage of a lot by all structures sH—all not exceed forty percent (400) of the lot area; provided that swimming pools and semi -enclosed patio structures shall not be considered as structures in ascertaining coverage. .031 Additions to existing dwellings may occupy not more than thirty-five (35%) percent of the required rear yard, provided any such additions shall comply with the setback regulations of this chapter and provided other comparable outdoor living area (exclusive of the required front yard, parking or driveway areas) is available elsewhere on the lot. .040 Minimum Floor Area Per Dwelling. The minimum livable floor area of any one -family dwelling shall be not less than twelve hundred twenty-five (1225) square feet exclusive of any garage area." SECTION 6. That Section 18.27.062 of Chapter 18.27 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended in its entirety to read as follows: "18.27.062 STRUCTURAL HEIGHT AND AREA LIMITATIONS. .010 Maximum Structural Hei ht. The maximum height of any one -family dwelling or other structure shall not exceed two (2) stories or thirty (30) feet, whichever is less, except as permitted pursuant to Section 18.04.030 of this Code. .020 Height Exceptions. .0201 Notwithstanding subsection .010 above, any dwelling or other structure located in the Scenic Corridor Overlay (SC) Zone shall comply with Section 18.84.042 of this Code. 051789 4 .030 Coverage and Open Space Requirements. The maximum coverage by all residential and accessory buildings shall be thirty-five percent (350) of the lot area for dwelling units with three (3) bedrooms or less and with two parking spaces in a garage. .031 The open space requirements shall be increased eight hundred fifty (850) square feet for each additional bedroom. (All rooms other than a living room, dining room, or family room, kitchen, bathrooms and closets shall be considered bedrooms.) Maximum coverage shall remain thirty-five percent (35%) of the lot area. .032 Swimming pools and semi -enclosed patio structures shall not be considered as structures in ascertaining coverage. .040 Minimum Floor Area per Dwelling. The minimum livable floor area of any one -family dwelling shall be not less than twelve hundred twenty-five (1225) square feet exclusive of any garage area." SECTION 7. That Section 18.84.042 of Chapter 18.84 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended in its entirety to read as follows: "18.84.042 SITE DEVELOPMENT STANDARDS. Notwithstanding any site development standards of the underlying zone in which the property is located to the contrary, including but not limited to the provisions by Section 18.04.030 of this Code, the following limitations shall apply: .010 Maximum Structural Height. The maximum height of any dwelling or other structure shall not exceed twenty-five (25) feet except as set forth in subsection .020 below. .020 Height Exceptions. .0201 Chimneys erected and maintained as an integrated feature of a dwelling may exceed the applicable height limitations of this section. .0202 Nonhabitable architectural embellishments (except chimneys) otherwise permitted in the underlying zone (including, but not necessarily limited to, cupolas, spires, turrets, towers and horizontal roof ridgelines provided any such ridgeline 051789 5 does not exceed ten (10) feet in length nor ten percent (10%) of the combined total length of all horizontal roof ridgelines on the structure, whichever is less) may exceed the applicable height limitations of this section provided: a. The maximum height of any such embellishment shall not exceed thirty (30) feet; and b. The combined total horizontal area of all such embellishments exceeding the twenty-five (25) foot height limitation shall not exceed ten percent (10%) of the total roof area. .0203 Pursuant to the conditions of approval of Tract No. 8418 and 8647, a one (1) story height overlay zone is hereby established and imposed upon those certain lots abutting the area known as 'Peralta Hills' and located on the north side of Valley Gate Drive, the east side of Sleepy Meadow Lane north of Forest Glen Road, and the north side of Forest Glen Road and Old Bucket Lane between Sleepy Meadow Lane and Nohl Ranch Road, and further described as Lot Nos. 24 through 46, inclusive, of Tract No. 8647 and Lot Nos. 65 through 79, inclusive, of Tract No. 8418. Notwithstanding any other provision of this Code, the maximum structural height on said lots shall not exceed one-story or twenty-five (25) feet, whichever is less, except as otherwise permitted in this subsection .020. The term 'one-story' as used in this subsection shall mean a single habitable floor and shall not permit any loft, mezzanine, balcony or similar habitable floor or area above such single habitable floor. .0204 The maximum height of any building in the area known as 'Hidden Canyon,' defined as the area south of Avenida de Santiago in the City of Anaheim, shall be thirty-five (35) feet except as otherwise permitted in this subsection .020. .030 Roof -mounted equipment including exterior mounted and ground mounted radio and television antennas shall not be permitted, except solar collector panels and related equipment shall be permitted to the extent required by state or federal law. SECTION 8. That the term "Building, Height" and definition thereof set forth in Section 18.01.030 of Chapter 18.01 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, repealed. SECTION 9. That the new term "Maximum Structural Height" and definition thereof be, and the same is hereby, added to Section 18.01.090 of Chapter 18.01 of Title 18 of the Anaheim Municipal Code, to be inserted therein in proper alphabetical sequence and to read as follows: "'Height, Maximum Structural.' The vertical measurement from the highest point o t e structure (exclusive of any projections which this Code expressly authorizes above the maximum height) to the finished floor level of the lowest floor directly below such point (other than a basement the ceiling of which is located entirely at or below the finished grade of the land); provided, however, if: (i) the lowest finished floor directly below such point is more than two (2) feet above the finished grade of the lot or building pad at any point abutting the foundation of the building, or (ii) there is no floor directly below such point, or (iii) the structure is not a building, then the maximum height shall be the vertical dimension from the highest point of the structure (exclusive of any projections which this Code authorizes above the maximum structural height) to the finished grade level of the land directly below such point." SECTION 10. That subsection .028 of Section 18.04.030 of Chapter 18.04 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended to read as follows: ".028 Permitted Projections Above Roof Lines. Structures for the housing of elevators, st— a ways, tanks, ventilating fans, or similar equipment required to operate and maintain the buildings, and fire or parapet walls, skylights, towers, roof signs, flagpoles, chimneys, smokestacks, wireless masts or similar projections may be erected above the height limits herein prescribed to the extent such projections are permitted uses in the zone in which located; provided, however, no projection, structure or any space above the height limits otherwise herein prescribed shall be allowed for the purpose of providing habitable floor space." 053189 7 SECTION 11. The provisions of this ordinance shall not apply to the development of any property ("development") occurring pursuant to the terms of a development agreement approved by the City by an ordinance adopted prior to the adoption of this ordinance to the extent the provisions of this ordinance are inconsistent with, or differ from, the zoning regulations and ordinances otherwise applicable to such development in the absence of this ordinance.
