ORDINANCE NO. 4884
AN ORDINANCE OF THE CITY OF ANAHEIM ADDING
SECTION 11.04.100 TO CHAPTER 11.04 OF TITLE 11
OF THE ANAHEIM MUNICIPAL CODE RELATING TO
TRESPASSING IN WETLAND HABITATS.
THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS
SECTION 1.
That Chapter 11.04 of Title 11 of the Anaheim Municipal
Code be, and it is hereby, amended by adding thereto Section
11.04.100 to read as follows:
"SECTION 11.04.100 TRESPASSING TO WETLAND HABITATS
.010 It shall be unlawful for any
person to enter into or remain upon any property
designated a wetlands habitat.
.020 This section shall not apply to:
a. any authorized employee or
agent of the City of Anaheim or owner of property
located within the wetlands habitat.
b. any person holding a
permit to enter the wetlands habitat issued by the
Director of the Parks, Recreation and Community Service
Department or a deputy thereof, which permits shall be
issued solely for educational or research purposes.
C. any person who enters a
wetlands habitat upon, and remains upon, a designated
public trail within a wetlands habitat when using the
public trail for its intended purpose."
SECTION 2.
Any person who violates Section 11.04.100 shall be
guilty of a misdemeanor and subject to the provisions of
Section 1.01.370 of the Anaheim Municipal Code.
SECTION 3. SEVERABILITY
The City Council of the City of Anaheim hereby declares
that should any section, paragraph, sentence or word of this
ordinance, hereby adopted, be declared for any reason to be
invalid, it is the intent of the Council that it would have passed
all other portions of this ordinance independent of the elimination
herefrom of any such portion as may be declared invalid.
THE FOREGOING ORDINANCE is approved and adopted by the
City Council of the City of Anaheim this 8th day of December, 1987.
