AN ORDINANCE OF THE CITY OF ANAHEIM AMENDING
SECTION 1.12.070 OF CHAPTER 1.12 OF TITLE 1
OF THE ANAHEIM MUNICIPAL CODE PERTAINING TO
DISPOSITION OF UNCLAIMED PROPERTY.
FOLLOWS: THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS
SECTION 1.
That Section 1.12.070 of Chapter 1.12 of Title 1 of the
follows:
Anaheim Municipal Code be, and it is hereby, amended to read as
"1.12.070 DISPOSITION OF UNCLAIMED PROPERTY
All unclaimed property in the
Possession of the Police Department shall be handled
and disposed of in the following manner and sequence:
.010 Such unclaimed property shall be held
for a period of at least three (3) months.
.020 Unclaimed money, currency, stocks,
bonds or other negotiable instruments shall be
deposited in the General Fund.
.030 Upon a determination by the Finance
Director or designee that such property is needed
for public use, such property shall be transferred
to the Finance Department to be retained for public
use. Upon transfer to the Finance Department such
property shall not be redeemable by the owner or any
other person.
.040 Unclaimed bicycles and toys may be
delivered to the Probation and Welfare Departments
of the County of Orange or to any charitable or
non-profit organization which (1) conducts or
operates a program or activity intended to prevent
juvenile delinquency, and (2) is exempt from state
or federal income taxes.
.050 Unclaimed property of little or no
value may be disposed of as junk.
.060 Any remaining unclaimed property may
be transferred to the Department of General Services
of the State of California.
.070 In the event any person appears and
reclaims property, prior to the transfer of the
property from the Police Department, and pays the
City's expenses in caring for and preserving the
property, such person shall be entitled to the
return of the property."
SECTION 2. SAVINGS CLAUSE
Neither the adoption of this ordinance nor the repeal
hereby of any other ordinance of this City shall in any manner
affect the prosecution for violations of ordinances, which
violations were committed prior to the effective date hereof, nor
be construed as a waiver of any license or penalty or the penal
provisions applicable to any violation thereof. The provisions of
this ordinance, insofar as they are substantially the same as
ordinance provisions previously adopted by the City relating to the
same subject matter, shall be construed as restatements and
continuations, and not as new enactments.
SECTION 3. CERTIFICATION
The City Clerk shall certify to the passage of this
ordinance and shall cause the same to be printed once within
fifteen (15) days after its adoption in the Anaheim Bulletin, a
newspaper of general circulation, published and circulated in said
City, and thirty (30) days from and after its final passage, it
shall take effect and be in full force.
THE FOREGOING ORDINANCE is approved and adopted by the
City Council of the City of Anaheim this 29th day of December, 1987.
