AN ORDINANCE OF THE CITY OF ANAHEIM ADDING NEW
SECTION 1.04.150 TO CHAPTER 1.04, AND AMENDING
SECTION 1.04.160 OF CHAPTER 1.04 OF TITLE 1,
AND AMENDING THE DEFINITIONS OF "PLANNING
DEPARTMENT" AND "PLANNING DIRECTOR" AS SET
FORTH IN SECTION 18.01.170 OF CHAPTER 18.01 OF
TITLE 18 OF THE ANAHEIM MUNICIPAL CODE
RELATING TO OFFICERS AND DEPARTMENTS.
THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN
AS FOLLOWS:
SECTION 1.
That new Section 1.04.150 be, and the same is
hereby, added to Chapter 1.04 of Title 1 of the Anaheim
Municipal Code, to read as follows:
"1.04.150 PLANNING DEPARTMENT --OFFICES OF
PLANNING DIRECTOR AND CHIEF
BUILDING INSPECTOR.
.010 The Planning Department shall
be under the supervision of the Planning
Director, which office is hereby created. The
Planning Director shall perform the functions
and duties of the Planning Director as set
forth in this Code unless such functions and
duties, or any of them, are delegated by the
Planning Director to a duly authorized
designee. Any reference in this Code to the
"Director of Community Development and
Planning" shall be deemed to mean the Planning
Director unless the content clearly indicates
to the contrary.
.020 The Building Division under the
supervision of the Planning Director shall be
headed by the Chief Building Inspector, which
office is hereby created. It shall be the
duty of the Chief Building Inspector, under
the supervision of the Planning Director, to
perform all duties required of the Chief
Building Inspector under the ordinances of the
City. The Chief Building Inspector shall be
deemed to be the Building Official of the City
of Anaheim and said Chief Building Inspector
is hereby authorized and directed to perform
the functions and duties of the Building
Official as prescribed in this Code or in any
code adopted by reference by any provision of
this Code. The Chief Building Inspector shall
have, and is hereby authorized to use, the
title of Building Official of the City of
Anaheim."
SECTION 2.
That Section 1.04.160 of Chapter 1.04 of Title 1 of
the Anaheim Municipal Code be, and the same is hereby,
amended to read as follows:
"1.04.160 COMMUNITY DEVELOPMENT DEPARTMENT
The Community Development Department
shall be under the supervision of a Director
of Community Development which office is
hereby created. The Director of Community
Development shall have direct responsibility
for the administration and technical
operations of the Community Development
Department and the acquisition, maintenance,
demolition and repair of City -owned properties
purchased with Community Development Block
Grant Funds."
SECTION 3.
That the definitions of "Planning Department" and
"Planning Director" as set forth in Section 18.01.170 of
Chapter 18.01 of Title 18 of the Anaheim Municipal Code be,
and the same are hereby, amended to read as follows:
"'Planning Department.' The Planning Department of
the City of Ana eim.
"'Planning Director.' The Planning Director of the
City of Anaheim."
SECTION 4. SAVINGS CLAUSE
Neither the adoption of this ordinance nor the repeal
hereby of any other ordinance of this City shall in any manner
affect the prosecution for violations of ordinances, which
violations were committed prior to the effective date hereof, nor
be construed as a waiver of any license or penalty or the penal
provisions applicable to any violation thereof. The provisions of
this ordinance, insofar as they are substantially the same as
ordinance provisions previously adopted by the City relating to the
same subject matter, shall be construed as restatements and
continuations, and not as new enactments.
THE FOREGOING ORDINANCE is approved and adopted by the
City Council of the City of Anaheim this 12th day of January, 1988.
