AN ORDINANCE OF OF THE CITY OF ANAHEIM
ADDING AND AMENDING VARIOUS SECTIONS AND
SUBSECTIONS OF VARIOUS CHAPTERS OF TITLE 18
OF THE ANAHEIM MUNICIPAL CODE RELATING TO
PARKING REQUIREMENTS AND DEFINITIONS OF
CONVENIENCE MARKETS.
1; THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS
FOLLOWS
\iiECTION 1.
Tlkt Section 18.01.040 of Chapter 18.01 of Title 18 of the
Anaheim Muni'4 pal Code be, and the same is hereby, amended by the
addition of t4 following definition as a "C" word listed
alphabetically``}n said section, to read as follows:
"'Convenience .1 Take-out, Food Service.' A market
or grocery sto`e having an interior building floor area
of less than 15;000 square feet and which is engaged in
the incidental s6 vice or sale of food prepared on the
premises and whic, by design of the building or its
improvements or physical facilities or service
procedures permits cstomers to receive food or food
service at a window 61�, a counter located inside the
building, but does not'= rovide for or encourage
consumption of food on the premises. For purposes of
this Section, 'food prep .ATed on the premises' shall mean
any food which is cooked,°teated, reheated, assembled or
altered on the site."
SECTION 2.
That a new subsection .022be and the same is hereby,
added to Section 18.06.050 to read a511.,follows:
".0225 Convenience Market, Take-outa Food/Meal Service:
Five and one-half (5.5) spaces per 1'100 square feet of
GFA plus Five (5) additional spaces."_�
SECTION 3. PENALTY
It shall be unlawful for any person, irm or corporation to
violate any provision or to fail to comply with -,-,any of the
requirements of this ordinance. Any person, firik or corporation
violating any provision of this ordinance or fail4ig to comply with
any of its requirements shall be deemed guilty of ,_misdemeanor and
upon conviction thereof shall be punished by a fine"iot exceeding
Five Hundred Dollars ($500.00) or by imprisonment noiN exceeding six
(6) months, or by both such fine and imprisonment. Ea);h such

person, firm or corporation shall be deemed guilty of a separate
offense for each day during any portion of which any violation of
any of the, provisions of this ordinance is committed, continued or
permitted 1�y such person, firm or corporation, and shall be
punishable'�herefor as provided for in this ordinance.
SEC'NON 4. SEVERABILITY
The Ci'Xy Council of the City of Anaheim hereby declares
that should any ection, paragraph, sentence or word of this
ordinance, hereb:adopted, be declared for any reason to be invalid,
it is the intent the Council that it would have passed all other
portions of this o inance independent of the elimination here from
of any such portion s may be declared invalid.
SECTION S. \ SAVINGS CLAUSE
Neither the ad tion of this ordinance nor the repeal
hereby of any other ordi nce of this City shall in any manner
affect the prosecution fo\anyviolation
ions of ordinances, which
violations were committedo the effective date hereof, nor
be construed as a waiver icense or penalty or the penal
provisions applicable to on thereof. The provisions of
this ordinance, insofarare substantially the same as
ordinance provisions prevdopted by the City relating to the
same subject matter, shalstrued as restatements and
continuations, and not asctments.
