4936ORDINANCE NO. 4936 AN ORDINANCE OF THE CITY OF ANAHEIM AMENDING VARIOUS CHAPTERS OF TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO STRUCTURAL SETBACK AND YARD REQUIREMENTS FOR FRONT -ON GARAGES IN RESIDENTIAL AREAS. SECTION 1. That Subsection 18.21.063.010 of Section 18.21.063 of Chapter 18.21 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended to read as follows: 11.010 Minimum Depth of Required Front Yard. All structures shall maintain a minimum setback of at least twenty-five (25) feet from any recorded, dedicated or planned public highway right-of-way line, any recorded private accessway easement, or recorded hiking and equestrian trails easement; provided, however, that the minimum setback to any 'front -on' garage may be not less than twenty (20) feet when equipped with a roll -up garage door." SECTION 2. That Subsection 18.22.063.010 of Section of 18.22.063 of the Chapter 18.22 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended to read as follows: 11.010 Required Setbacks and Yards. All structures shall maintain a minimum setback of at least fifteen (15) feet from any public right-of-way line, recorded private accessway easement, or recorded hiking and equestrian trails easement; provided, however, that the minimum setback to any 'front -on' garage shall not be less than twenty-five (25) feet when equipped with a standard, tilt -up garage door and not less than twenty (20) feet when equipped with a roll -up garage door." SECTION 3. That Subsection 18.23.063.013 of Section 18.23.063 of Chapter 18.23 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended to read as follows: ".013 'Front -on' Garages. The minimum setback to any 'front -on' garage shall be not less than twenty-five (25) feet when equipped with a standard, tilt -up garage door and not less than twenty (20) feet with a roll -up garage door." SECTION 4. That Subsection 18.24.063.011 of Section 18.24.063 of Chapter 18.24 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended to read as follows: 11.011 Minimum Garage Setback. The minimum setback to any garage excepting 'front -on' garages shall be not less than ten (10) feet. the minimum setback to any 'front -on' garage shall not be less than twenty-five (25) feet when equipped with a standard, tilt -up garage door and not less than twenty (20) feet when equipped with a roll -up garage door." SECTION 5. That Subsection 18.25.063.011 of Section 18.25.063 of Chapter 18.25 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended to read as follows: 11.011 'Front -on' Garages. The minimum setback to any 'front -on' garage shall be not less than twenty-five (25) feet when equipped with a standard, tilt -up garage door and not less than twenty (20) feet when equipped with a roll -up garage door." SECTION 6. That Subsection 18.26.063.011 of Section 18.26.063 of Chapter 18.26 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended to read as follow: 11.011 'Front -on' Garages. The minimum setback to any 'front -on' garage shall be not less than twenty-five (25) feet when equipped with a standard, tilt -up garage door and not less than twenty (20) feet when equipped with a roll -up garage door." SECTION 7. That Subsection 18.27.063.012 of Section 18.27.063 of Chapter 18.27 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended to read as follows: 11.012 'Front -on' Garages. The minimum setback to any 'front -on garage shall be not less than twenty-five (25) feet when equipped with a standard, tilt -up garage door and not less than twenty (20) feet with a roll -up garage door." -2- SECTION 8. That Subsection 18.06.050.0123 of Section 18.06.050 of Chapter 18.06. of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended to read as follows: ".0123 Tandem parking of not more than two (2) vehicles deep shall be ermitted for required covered parking when the two (2 spaces are assigned to the same dwelling unit. Required open spaces shall be permitted in tandem to covered spaces and shall be provided in a driveway having minimum dimensions of sixteen (16) feet wide and twenty-five (25) feet long where the covered spaces in a garage equipped with a standard, tilt -up garage door and sixteen (16) feet wide and twenty (20) feet long where no door or a roll -up garage door is used." SECTION 9. That Section 18.01.080 of Chapter 18.01 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended by the addition of the following item to be defined as a "G" word and placed therein alphabetically in said Section to read as follows: "'Garage, front -on.' A garage which permits vehicular access thereto in a direction substantially perpendicular to the front lot line of the plot on which the garage is located." SECTION 10. That Title 18 of the Anaheim Municipal Code be amended by deletion of the following Subsections: Subsections 18.21.063.011, .012, .014, and .015 of Section 18.21.063 of Chapter 18.21; Subsection 18.22.063.011, .012, .014, .015, and .020 of Section 18.22.063 of Chapter 18.22; Subsections 18.23.063.0131, .0132, .0134, and .0135 of Section 18.23.063 of Chapter 18.23; Subsections 18.24.063.0111, .0112, .0114, and .0115 of Section 18.24.063 of Chapter 18.24; Subsections 18.25.063.0111, .0112, .0114, and .0115 of Section 18.25.063 of Chapter 18.25; Subsections 18.26.063.0111, .0112, .0114, .0115, of Section 18.26.063 of Chapter 18.26; Subsections 18.27.063.0121, .0122, .0124, and .0125 of Section 18.27.063 of Chapter 18.27. SECTION 11. PENALTY It shall be unlawful for any person, firm or corporation to violate any provision or to fail to comply with any of the requirements of this ordinance. Any person, firm or corporation violating any provision of this ordinance or failing to comply -3- with any of its requirements shall be deemed guilty of a misdemeanor and upon conviction thereof shall be punished by a fine not exceeding Five Hundred Dollars ($500.00) or by imprisonment not exceeding six (6) months, or by both such fine and imprisonment. Each such person, firm or corporation shall be deemed guilty of a separate offense for each day during any portion of which any violation of any of the provisions of this ordinance is committed, continued or permitted by such person, firm or corporation, and shall be punishable therefor as provided for in this ordinance. SECTION 12. SEVERABILITY The City Council of the City of Anaheim hereby declares that should any section, paragraph, sentence or word of this ordinance, hereby adopted, be declared for any reason to be invalid, it is the intent of the Council that it would have passed all other portions of this ordinance independent of the elimination herefrom of any such portion as may be declared invalid. SECTION 13. SAVINGS CLAUSE Neither the adoption of this ordinance nor the repeal hereby of any other ordinance of this City shall in any manner affect the prosecution for violations of ordinances, which violations were committed prior to the effective date hereof, nor be construed as a waiver of any license or penalty or the penal provisions applicable to any violation thereof. The provisions of this ordinance, insofar as they are substantially the same as ordinance provisions previously adopted by the City relating to the same subject matter, shall be construed as restatements and continuations, and not as new enactments.
