4953ORDINANCE N0. 4953 AN ORDINANCE OF THE CITY OF ANAHEIM ADDING CHAPTER 18.80 TO TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING. FOLLOWS: THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS SECTION 1: That Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended by the addition of Chapter 18.80 to read as follows: "CHAPTER 18.80 'PD-C/RM-2400' PARKING DISTRICT-COMMERCIAL/RM-2400 ZONE 18.80.020 PERMITTED USES AND STRUCTURES. .010 Open Air, ing of Transient Automobiles: Temporary iles: Providedareaskclassified 'PD -C' shall not be used for 'used car sales areas.' .020 Any Use Permitted in the 'RM -2400' Multiple -Family Residential Zone, and when so used, subject to all of the provisions contained in said 'RM -2400' Zone. 18.80.050 CONDITIONAL USES AND STRUCTURES. The following buildings, structures and uses may be permitted in this zone subject to approval of a conditional use permit in compliance with the standards and required showings for such permits as specified in Chapter 18.03 and in conformance with the site development standards of this zone. .010 Boarding and Lodging Houses. Children. .020 Child Nurseries, With Six (6) or More .030 Churches. .040 Golf Courses. .050 Planned Unit Development. .060 Private Educational Institutions. .070 Private Lodges, Clubs, Fraternities and Sororities. 18.80.060 SITE DEVELOPMENT STANDARDS. The area of any site shall be not less than the minimum lot area requirements of the 'RM -2400' Multiple -Family Residential Zone. All other site development standards shall be in accordance with the provisions prescribed herein: .010 When premises are used exclusively for parking purposes, the provisions of Section 18.060.030 'Required Improvement of Parking Areas' and Section 18.06.040 'Parking Space and Access Design' shall apply. .020 For dwellings and accessory buildings; the provisions of the 'RM -2400' Multiple -Family Residential Zone shall apply. 18.80.100 DEDICATIONS AND IMPROVEMENTS. Dedication of streets, public utility easements and other public works and improvements shall be required in connection with any work pertaining to the erection, construction, reconstruction, moving, conversion, alteration or addition to any building or structure within this zone in accordance with the provisions of Section 18.04.080 of this Code. 18.80.110 DEVELOPMENT REVIEW AND PERMITS. Prior to commencing any work pertaining to the erection, construction, reconstruction, moving, conversion, alteration or addition to any building or structure within this zone, all building and site plans shall be subject to review by the Building Division of the Planning Department of the City and permits shall be secured from the Chief Building Inspector of the City of Anaheim in compliance with the provisions of Section 18.04.090 'Development Review and Permits - General'; provided further, that where there are existing buildings and structures on a site for which more intensive development is proposed under the provisions of this zone, no building permit shall be issued until the Chief Building Inspector and the Fire Chief have certified that the existing buildings and structures are safe for occupancy and for human habitation." -2- SECTION 2. PENALTY It shall be unlawful for any person, firm or corporation to violate any provision or to fail to comply with any of the requirements of this ordinance. Any person, firm or corporation violating any provision of this ordinance or failing to comply with any of its requirements shall be deemed guilty of a misdemeanor and upon conviction thereof shall be punished by a fine not exceeding One Thousand Dollars ($1,000.00) or by imprisonment not exceeding six (6) months, or by both such fine and imprisonment. Each such person, firm or corporation shall be deemed guilty of a separate offense for each day during any portion of which any violation of any of the provisions of this ordinance is committed, continued or permitted by such person, firm or corporation, and shall be punishable therefor as provided for in this ordinance. SECTION 3. SEVERABILITY The City Council of the City of Anaheim hereby declares that should any section, paragraph, sentence or word of this ordinance, hereby adopted, be declared for any reason to be invalid, it is the intent of the Council that it would have passed all other portions of this ordinance independent of the elimination here from of any such portion as may be declared invalid. SECTION 4. SAVINGS CLAUSE Neither the adoption of this ordinance nor the repeal hereby of any other ordinance of this City shall in any manner affect the prosecution for violations of ordinances, which violations were committed prior to the effective date hereof, nor be construed as a waiver of any license or penalty or the penal provisions applicable to any violation thereof. The provisions of this ordinance, insofar as they are substantially the same as ordinance provisions previously adopted by the City relating to the same subject matter, shall be construed as restatements and continuations, and not as new enactments.
