AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM AMENDING CERTAIN CONDITIONS OF APPROVAL AS
SET FORTH IN ORDINANCE NO. 34359 AS AMENDED,
RELATING TO ZONING RECLASSIFICATION PROCEEDINGS NO.
74-75-26.
WHEREAS, the City Council did adopt its Resolution
No. 75R-134 determining that a change or changes in the zone or
zones therein mentioned and described should be made after a duly
noticed hearing and receipt of the report and recommendation of
the City Planning Commission; and
WHEREAS, said Resolution did impose certain
conditions and requirements precedent to the adoption of an
ordinance changing said zone or zones, which conditions and
requirements have been satisfied; and
WHEREAS, the City Council has heretofore adopted
Ordinance No. 3435 changing said zone or zones on the real
property therein described subject to those certain conditions as
set forth in said Ordinance; and
WHEREAS, the City Council heretofore amended certain
conditions of approval as set forth in Ordinance No. 3435 by the
adoption of Ordinance No. 4573; and
WHEREAS, the City Council did thereafter adopt
Resolution No. 88R-317 amending certain conditions of approval as
theretofore imposed in Resolution No. 7SR-134 as amended by
Resolution No. 85R-45 relating to said zone changes; and
WHEREAS, said Resolution No. 88R-317 authorizes an
amendment to Ordinance No. 3435, as amended, relating to said
conditions of approval.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF
ANAHEIM DOES ORDAIN AS FOLLOWS:
SECTION 1.
That condition of approval Number 8 as set forth in
Ordinance No. 3435, as amended by Ordinance No. 4573 be, and the
same is hereby, amended to read as follows:
"8. That subject property shall be developed with
general offices substantially in accordance with plans and
specifications on file with the City of Anaheim marked Revision
No. 5 of Exhibit No. 1, and Exhibit Nos. 3 and 4."
SECTION 2.
That new condition Nos. 11 and 12 be, and the same
are hereby, added to Ordinance No. 3435, as amended by Ordinance
No. 4573, to read as follows:
"11. That ten (10) foot radius curb returns shall
be constructed for the driveway on Sunkist Street and the most
easterly driveway on Lincoln Avenue."
"12. That prior to issuance of a building permit,
the City Traffic Engineer shall make a determination as to whether
the traffic signalization at the intersection of Lincoln Avenue
and Sunkist Street should be modified to provide for signalized
left turns in both streets. If such modification is found to be
appropriate, the property owner/developer shall pay a proportional
share (twenty-five percent [2501) of the cost to complete such
modification prior to final building inspection."
SECTION 3.
That, except as expressly amended herein, Ordinance
No. 3435 shall remain in full force and effect.
SECTION 4.
The City Clerk shall certify to the passage of this
ordinance and shall cause the same to be printed once within
fifteen (15) days after its adoption in the Anaheim Bulletin, a
newspaper of general circulation, printed, published and
circulated in said City, and thirty (30) days from and after its
final passage, it shall take effect and be in full force.
