2002-136RESOLUTION NO. 2002R- 136 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM ADOPTING NEW FEE SCHEDULES FOR THE PUBLIC WORKS DEPARTMENT OF THE CITY OF ANAHEIM. WHEREAS, it is the policy of the City Council of the City of Anaheim to provide for the amount of fees to be established by resolution; and WHEREAS, the City Council has by resolution heretofore established various fees in the Public Works Department of the City of Anaheim; and WHEREAS, it is the desire of the City Council to revise and update said fees at this time; and WHEREAS, the fees hereinafter reestablished do not exceed the estimated reasonable cost of providing the service for which the fee is charged; and WHEREAS, prior to approving said fees, the City Council has held at least one public meeting at which oral or written presentations could be made concerning said proposed fees as part of a regularly scheduled meeting of the City Council; and WHEREAS, the City of Anaheim has heretofore complied with the applicable requirements of Chapter 8 of Division 1 of Title 7 of the Government Code of the State of California entitled Procedures for Adopting Various Fees; WHEREAS, the City Council further finds and determines that this establishment and amendment to fees is exempt from the provisions of the California Environmental Quality Act pursuant to Section 21080(b) (8) of the California Public Resources Code. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that fees to be charged and collected by the Public Works Department of the City of Anaheim shall be as set forth in Exhibit A, which is attached hereto and incorporated by reference herein. BE IT FURTHER RESOLVED that fees established in this resolution shall become effective on the sixtieth day following the date of adoption of this Resolution, and shall supersede and rescind all other fees whensoever approved by the City Council concerning the collection of the hereinabove specified fees in the Public Works Department of the City of Anaheim. BE IT FURTHER RESOLVED that the City Council hereby declares that should any one or more fees established by this resolution or any portion of this resolution be declared for any reason to be invalid, it is the intent of the Council that it would have adopted all other fees and portions of this resolution independent of the elimination herefrom of any such fee or such portion as may be declared invalid. THE FOREGOING RESOLUTION is approved and adopted by the City Council of the City of Anaheim this llth day of June , 2002.
