4855ORDINANCE NO.4855 AN ORDINANCE OF OF THE CITY OF ANAHEIM ESTABLISHING THE ECONOMIC DEVELOPMENT BOARD, ENACTING PROVISIONS RELATING THERETO, AND REPEALING SECTION 1.04.995 OF CHAPTER 1.04 OF TITLE 1 OF THE ANAHEIM MUNICIPAL CODE THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: SECTION 1. That Section 1.04.995 of the Anaheim Municipal Code be, and it is hereby repealed and the Industrial Development Board is hereby abolished. SECTION 2. That a new Section 1.04.995 of the Anaheim Municipal Code be, and it is hereby added to Chapter 1.04 of Title 1 of the Anaheim Municipal Code to provide as follows: 111.04.995 ECONOMIC DEVELOPMENT BOARD .010 ESTABLISHMENT The Economic Development Board is hereby established pursuant to Section 900 of the Charter of the City of Anaheim. .020 MEMBERSHIP The Economic Development Board shall consist of nine (9) members, none of whom shall hold any paid office or employment in the City government and none of whom need be electors of the City of Anaheim. .030 APPOINTMENT AND REMOVAL The members of the Economic Development Board shall be appointed by the City Council and shall be subject to removal at any time by motion of the City Council adopted by the affirmative votes of the majority of the entire City Council. .040 TERM OF APPOINTMENT Each member of the Board shall serve for a term of four years and until their respective successors are appointed and qualified; provided, however, that the terms of the Board members first appointed shall expire as designated by the City Council at the time of their appointments as follows: Three on the thirtieth day of June of the first year following appointment; Two on the thirtieth day of June of the second year following appointment; Two on the thirtieth day of June of the third year following appointment; and Two on the thirtieth day of June of the fourth year following appointment. .Oso VACANCIES Any vacancy occurring before the expiration of the term of a Board member shall be filled by appointment by the City Council for the remainder of such term. .060 ORGANIZATION AND MEETINGS The Board shall, as soon as practical after its organization and each year thereafter, elect a Chairman and Vice Chairman in accordance with the provisions of Section 904 of the Anaheim City Charter. Meetings of the Board shall be conducted in accordance with Section 904 of the Anaheim City Charter; provided, however, that the Board shall meet at least one time during each calendar year. A regular meeting time may be established by the Board. A majority of the members of the Board shall constitute a quorum. .070 NO SALARY Members of the Board shall serve at no salary. .080 POWERS AND DUTIES The Economic Development Board is an advisory body and, as such, shall have the power and duty to: a) Hold public meetings and advise the City Council, the Industrial Development Authority and other boards and commissions of the City concerning matters relating to industrial development. b) Review and make recommendations to the City Council and Industrial Development Authority concerning any industrial development bonds. c) Advise the City Council on all matters concerning economic development which may affect the economic health of the City of Anaheim. d) Perform such additional duties and functions as may be required from time to time by resolution of the City Council. -2- e) Receive administrative support and assistance from the staff of the Community Development and Planning Department for purposes of performing the duties and functions specified herein." SECTION 3. SEVERABILITY The City Council of the City of Anaheim hereby declares that should any section, paragraph, sentence or word of this ordinance of the Code, hereby adopted, be declared for any reason to be invalid, it is the intent of the Council that it would have passed all other portions of this ordinance independent of the elimination herefrom of any such portion as may be declared invalid.
