4728FOLLOWS: ORDINANCE NO. 4728 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AMENDING SECTION 16.24.010 OF CHAPTER 16.24 OF TITLE 16 OF THE ANAHEIM MUNICIPAL CODE RELATING TO PARAMEDIC FEES THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS SECTION 1 That Section 16.24.010 of Chapter 16.24 of Title 16 of the Anaheim Municipal Code be, and the same is hereby, amended to read as follows: 1116.24.010 PARAMEDIC FEES Paramedic fees are hereby established to be charged in connection with paramedic services provided by the Anaheim Fire Department. The amount of such fees shall be set by resolution of the City Council on the basis of voluntary subscription or actual use of the service. There shall be two types of user fees as follows: 1. The "Voluntary Subscription Fee" shall be offered to residents and businesses on a voluntary basis for the purpose of assuring subscribers they will not incur higher direct fees should they require paramedic services. Payment of the Voluntary Subscription Fee by the following businesses shall entitle such businesses only to paramedic services rendered to the employees thereof without additional charge: a. Hotels, as defined in Section 2.12.040 of the Anaheim Municipal Code; b. Health care service plans, which shall include any business which provides, or arranges for the provision of, health care services, including emergency medical care, to patients, subscribers Or enrollees for a fee The Fee for Services as described hereinbelow shall be charged for paramedic services rendered to guests, customers, patients, patrons, visitors or others using the facilities of such businesses. 2. The "Fee for Services" shall be a charge designed to recover costs associated with the delivery of paramedic services to persons and businesses that do not participate in or are otherwise covered by the Voluntary Subscription Fee system. Such fees shall be based on: a. Emergencies requiring Basic Life Support services by paramedics and/or engine companies of the Anaheim Fire Department; and b. Emergencies requiring Advanced Life Support services and paramedic accompaniment to a medical facility. Any person or business requesting or benefitting from the services for which a Fee for Services is charged shall be jointly and severally civilly liable and indebted to the City of Anaheim for such Fee for Service." SECTION 2. SEVERABILITY The City Council of the City of Anaheim hereby declares that should any section, paragraph, sentence or word of this ordinance of the Code, hereby adopted, be declared for any reason to be invalid, it is the intent of the Council that it would have passed all other portions of this ordinance independent of the elimination herefrom of any such portion as may be declared invalid. SECTION 3. CERTIFICATION The City Clerk shall certify to the passage of this ordinance and shall cause the same to be printed once within fifteen (15) days after its adoption in the Anaheim Bulletin, a newspaper of general circulation, published and circulated in said City, and Thirty (30) days from and after its final passage, it shall take effect and be in full force.
