RES-2008-065RESOLUTION NO. 2008R- 065 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AUTHORIZING THE CITY MANAGER OR HIS DESIGNEE TO SUBMIT A GRANT APPLICATION ON BEHALF OF THE CITY OF ANAHEIM FOR LOCAL ASSISTANCE FUNDS UNDER THE CALIFORNIA CLEAN WATER, CLEAN AIR, SAFE NEIGHBORHOODS, AND COASTAL PROTECTION BOND ACT OF 2002, THE WATER, SECURITY, CLEAN DRINKING WATER, COASTAL AND BEACH PROTECTION ACT OF 2002, AND THE SAFE DRINKING WATER, WATER QUALITY AND SUPPLY, FLOOD CONTROL, RIVER AND COASTAL PROTECTION BOND ACT OF 2006 (PROP 84) FOR THE BURRIS PIT PARK DEVELOPMENT (FINAL PHASE) AND IF AWARDED, AUTHORIZING THE ACCEPTANCE OF SUCH GRANT ON BEHALF OF THE CITY AND AMENDING THE 2008 -2009 BUDGET ACCORDINGLY WHEREAS, the people of the State of California have enacted the California Clean Water, Clean Air, Safe Neighborhood Parks, and Coastal Protection Act of 2002 (Proposition 40) in 2002, and the Water, Security, Clean Drinking Water, Coastal and Beach Protection Act of 2002 (Proposition 50), and the Safe Drinking Water, Water Quality and Supply, Flood Control, River and Coastal Protection Bond Act of 2006 (Proposition 84) which provides local assistance funds for the Rivers and Mountains Conservancy Grant Program; and WHEREAS, the San Gabriel and Lower Los Angeles Rivers and Mountains Conservancy (RMC) has been delegated the responsibility for the administration of the grant program in its jurisdiction (the "Grant setting up necessary procedures; and WHEREAS, said procedures established by RMC require the Anaheim City Council to authorize, by resolution, the submission of an application to the State of California for the Grant for the final phase of the Burris Pit Park development (the "Project and WHEREAS, the City Council desires to accept any such Grant which may be awarded to the City; and WHEREAS, if awarded the Grant, Anaheim will enter into a Contract with the State of California to complete the Project; and WHEREAS, the City Council desires to amend the annual budget of the City to reflect and incorporate any Grant so awarded to the City, and to increase the annual appropriations and expenditure in the appropriate City program to reflect such award. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim as follows: 1/ 1/ 1. The Anaheim City Manager or his designee is hereby authorized to submit an Application for the Grant from the RMC Grant Program under the California Clean Water, Clean Air, Safe Neighborhood Parks, and Coastal Protection Act of 2002 (Proposition 40), or the Water, Security, Clean Drinking Water, Coastal and Beach Protection Act of 2002 (Proposition 50), or the Safe Drinking Water, Water Quality and Supply, Flood Control, River and Coastal Protection Bond Act of 2006 (Proposition 84) for the Project, and is further authorized to execute any actions necessary for the purpose of obtaining such Grant, including any extensions and amendments thereof. 2. The Project is consistent with local or regional land use plans or Programs. 3. The Project is consistent with Common Ground and Phase II Final Reports. 4. Anaheim has or will have sufficient funds to operate and maintain the Project. 5. Anaheim has reviewed, understands and agrees to comply with the General Requirements and General Policies in the Rivers and Mountains Conservancy Grant Program Guidelines. 6. The City Manager or his designee is hereby authorized and directed to execute any agreements, assurances or other documents as may be necessary in connection with the acceptance of the grant, if such grant is awarded to the City; and which may be necessary for the completion of the Project. 7. The annual budget of the City of Anaheim for fiscal year 2008 -09 shall be amended by increasing the appropriations and authorized expenditures in Program No. 216 213 4786 -1799 in such amount as is equal to the amount of grant funds to be received by the City. 2 THE FOREGOING RESOLUTION is approved and adopted by the City Council of the City of Anaheim this 1 3th day of May 2008, by the following roll call vote: AYES: Mayor Pringle, Council Members Hernandez, Sidhu, Galloway, Kring NOES: NONE ABSTAIN: NONE ABSENT: NONE CITY CLERK OF THE CITY OF ANAHEIM 68930.1 3 MAYOR OF THE ANAHEIM
