A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM VACATING A PUBLIC UTILITY EASEMENT FOR
SEWER PURPOSES RESERVED UNTO THE CITY OF
ANAHEIM IN RESOLUTION NUMBER 2005 -57 PURSUANT TO
CALIFORNIA STREETS AND HIGHWAYS CODE SECTIONS
8330 ET SEQ.- SUMMARY VACATION (Abandonment No. ABA
2008 00178)
WHEREAS, the Anaheim Redevelopment Agency has requested the vacation of a
public utility easement for sewer purposes reserved unto the City of Anaheim in Resolution Number
2005 -52, recorded on October 3, 2005 as Instrument Number 2005000780845 of Official Records,
Orange County, State of California, generally located at 325 -425 South Vine Street in Anaheim,
California, in order to clear title to the land; and
WHEREAS, the public utility easement to be vacated is no longer required for present
or prospective public utility purposes; and
WHEREAS, the public utility easement to be abandoned is superseded by the
relocation of the easement in that the Anaheim Redevelopment Agency has dedicated a replacement
easement as required to serve the new community; and
WHEREAS, there are no other public facilities located within the public utility
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Anaheim does hereby order the vacation of the public utility easement, reserved in Resolution
Number 2005 -52, recorded on October 3, 2005 as Instrument Number 2005000780845 of Official
Records, Orange County, State of California, as shown in Exhibit "A" and, attached hereto and
incorporated herein by this reference.
BE IT FURTHER RESOLVED that the City Clerk be, and she is hereby authorized
and directed, to cause a certified copy of this Resolution to be recorded in the Office of the Recorder
of the County of Orange.
BE IT FURTHER RESOLVED that from and after the date the certified copy of this
Resolution is recorded in the Office of the Recorder of the County of Orange, the vacation shall be
complete, and the public service easement vacated shall no longer constitute a public service
easement.
THE FOREGOING RESOLUTION is approved and adopted by the City Council of
the City of Anaheim this 10thday of June 2008, by the following roll call vote:
